AN ORDINANCE OF THE CITY COUNCIL AMENDING
DISTRICTING MAP NO. 9 TO PLACE THE SUBJECT
PROPERTY IN THE R -3 DISTRICT OF THE CANNERY
VILLAGE /MCFADDEN SQUARE SPECIFIC PLAN (SP -6)
DISTRICT (Planning Commission Amendment No. 686).
WHEREAS, the subject property his currently designated for "Multi-Family
Residential" uses under the Land Use Element of the General Plan; and
WHEREAS, only residential uses are permitted under the "Multi - Family
Residential' District; and
WHEREAS, under the Zoning Code, the subject property is currently in the
Retail and Service Commercial District of the Cannery Village Specific Area Plan (SP-
6) District; and
WHEREAS, residential uses are restricted to only the second floor in the Retail
and Service Commercial District of the Cannery Village Specific Plan (SP -6) District;
and
WHEREAS, due to this inconsistency, it would not be possible to develop the lot
in conformance with both the zoning and the General Plan; and
WHEREAS, one dwelling unit for each 1200 square feet of lot area would be
permitted on the subject property under both the R -3 District regulations and under the
Multi - Family Residential designation of the Land Use Element of the General Plan; and
WHEREAS, on October 19, 1989, the Planning Commission of the City of
Newport Beach held a public hearing regarding Amendment No. 686; and
WHEREAS, the public was duly noticed of the public hearing; and
WHEREAS, on November 13, 1989, the City Council of the City of Newport
Beach held a duly noticed public hearing;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1: Districting Map No. 9 is amended so as to place Lot 2, Block 20,
First Addition to the Newport Beach Tract, located at 2002 West Ocean Front, in the
R -3 District of the Cannery Village /McFadden Square Specific Plan (SP -6) District.
SECTION 2: The Mayor shall sign and the City Clerk attest to the passage of
this Ordinance. This Ordinance shall be published once in the official newspaper of the
City within fifteen (15) days of its adoption. This Ordinance shall not take effect until
thirty days (30) after the date of its adoption nor shall it take effect prior to the

recordation of a five foot wide sewer easement to be located across the northerly five
feet of the subject property or in another location acceptable to the Public Works
Department.
This Ordinance was introduced at a regular meeting of the City Council of the
• City of Newport Beach, held on the 13th day of November 1989, and was adopted on
the 27th day of November 1989, by the following vote, to wit:
