The City Council of the City of Newport Beach does ordain as • follows: Section 1. Section 9.04.390 Severability. 1 Section 9.04.010. Adoption of the 1991 Uniform Fire Code. Pursuant to the provisions of Sections 50022.1 through 50022.5, of the Government Code of the State of California, there is hereby adopted and incorporated by reference into this chapter, that certain Code entitled "Uniform Fire Code," (1991 Edition) referred to in this chapter as the "Fire Code" specifically including Appendices, Division I through Division VI, save and except such portions as are hereafter deleted, added or amended. Also included in this code adoption is the 1992 Uniform Code Supplement. One (1) certified copy of which is to be on file in the office of the City Clerk of the City of Newport Beach and open for public inspection. Section 9.04.020. Amendment of Section 2.304(b) of the Uniform Fire Code. Section 2.304(b) of the Fire Code is amended by inserting therein the following to read: "All of the most current National Fire Protection Association Codes, Standards, Recommended Practices, Manuals, Guides and Model • Laws promulgated by the National Fire Protection Association, a copy of contained in the National Fire Codes, published and which is on file with the Newport Beach Fire Department." Section 9.04.030. Amendment to Section 9.103 of the Uniform Fire Code. Section 9.103 of the Fire Code is amended by adding the definition of "Authorized Representative" as follows: "Authorized Representative shall mean those persons described in Sections 2.104, 2.105 and 2.106 of this Code." Section 9.04.040. Amendment to Section 9.105 of the Uniform Fire Code. Section 9.105 of the Fire Code is amended by adding the • definition of "Corporation Counsel" as follows: "Corporation Counsel as used herein shall mean the City Attorney of the City of Newport Beach." 3 Section 9.04.050. Amendment to Section 10.103 of the Uniform Fire Code. Section 10.103 of the Fire Code is amended to read as follows: "No person shall use or operate any hydrant or other valves on any water system intended for use by the Chief for •installed fire suppression purposes and which is accessible to any public highway, alley or private way open to or generally used by the public, unless such person first secures a permit from the controlling water agency. This section does not apply to the use of a hydrant or other valves by a person employed, and authorized to make such use, by the water company which supplies water to such hydrants or other valves." Section 9.04.060. Amendment to Section 10.302 of the Uniform Fire Code. Section 10.302 of the Fire Code is amended by adding Subsection (b) as follows: "Section 10.302(b) Key Box System. Key box shall contain two • sets of the following: 1. Keys to locked points of ingress whether on the interior or exterior of the building. 2. Keys to locked mechanical equipment rooms. 3. Keys to locked electrical rooms. 4. Keys to elevator controls. 5. Keys to other areas as directed by the Chief. Section 9.04.070. Amendment to Section 10.203 of the Uniform Fire Code. Section 10.203 of the Fire Code is amended by adding the following: "Entrance Gates /Chains. All emergency vehicle access gates, lock approved by the Fire Chief. Where gates are electrically operated, an approved fire department key switch and an approved 3 gated communities, chains across fire lanes, and gates that •private provide access to the beach and /or wildland areas, shall have a lock approved by the Fire Chief. Where gates are electrically operated, an approved fire department key switch and an approved 3 strobe light receiver shall be installed and tested by the fire department." Section 9.04.080. Amendment to Section 10.501 of the Uniform Fire Code. Section 10.501 of the Fire Code is amended by adding • subsection (d) to read as follows: "Section 10.501(d) Provide and install electrical outlets (120 volt, duplex) that are connected to the emergency generator circuitry /system, when generator is required by Section 1807 or 1907 of the Uniform Building Code, in the following locations: 1. In the main exit corridor of each floor, adjacent to each exit enclosure. 2. In each elevator lobby. 3. In public assembly areas larger than 1500 square feet. 4. In every fire control room. 5. In such other areas as may be designated by the Chief. Outlets shall be RED in color." Section 9.04.090. Amendment to Section 11.103 of the Uniform • Fire Code. Section 11.103 of the Fire Code is amended to add the following: "Notwithstanding the provisions of this Chapter, no person shall do or allow any such burning without a permit issued in compliance with the Rules and Regulations of South Coast Air Quality Management District." Section 9.04.100. Amendment to Section 11.204 of the Uniform Fire Code. Section 11.204 of the Fire Code is amended by adding sub- section (f) to read as follows: 1111.204. (f) CAMP /RECREATIONAL FIRES. No person shall make, •set or maintain any beach or camp /recreational fire at any place within the City except in areas where proper containers are provided for such fires by the City and where City signs are plainly posted indicating such fires are permissible." 4 Section 9.04.110. Amendment to Section 11.303(c)(5)(d) of the Uniform Fire Code. Section 11.303(c)(5)(d) of the Fire Code is amended to read as follows: "ATRIUM AND MALL FURNISHINGS. Section 11.303(c)(5)(d). The • potential heat of combustible furnishings and decorative materials within atriums and malls shall not exceed 9000 BTU per pound when located within an area of the atrium or mall that is more than 20 feet below ceiling- mounted sprinklers. EXCEPTION: Furnishings certified as flame- retardant to the satisfaction of the Chief may be used in atriums and malls." Section 9.04.120. Amendment to Section 77.106 of the Uniform Fire Code. Section 77.106 of the Fire Code is amended to read as follows: "The storage of explosives and blasting agents is prohibited anywhere in the City of Newport Beach unless a permit authorizing use and /or storage has been issued by the Chief." Section 9.04.130. Amendment to Section 79.501 of the uniform • Fire Code. Section 79.501 of the Fire Code is amended to read as follows: "Section 79.501. The storage of Class I and Class II liquids in above ground tanks outside of buildings is prohibited within the boundaries of the City of Newport Beach unless a permit authorizing use and /or storage has been issued by the Chief." Section 9.04.140. Amendment to Section 79.601(a) of the Uniform Fire Code. Section 79.601(a) of the Fire Code is amended to add the following: "Section 79.601(a) Location. "The underground storage of flammable liquids shall be prohibited in any residential district • or any residential area of a P -C district, as defined in Chapter 20.5 of this Code, within the City." Section 9.04.150. Amendment to Section 79.1401 of the Uniform Fire Code. 6". Section 79.1401 of the Fire Code is amended to read as follows: "Section 79.1401. This division shall apply to that portion of a property where flammable and combustible liquids are received by tank vessel, pipe lines, tank car or tank vehicle and are stored • or blended in bulk for the purpose of distributing such liquids by tank vessel, pipeline, tank car, tank vehicle or container. No new bulk plant for flammable liquids shall be constructed within the boundaries of the City of Newport Beach except as permitted by the Chief." Section 9.04.160. Amendment to Section 79.910(d) of the Uniform Fire Code. Section 79.910(d)5 of the Fire Code is amended to add the following: "The dispensing of Class I, II or III -A liquids from tanks aboard boats, barges or other floating craft is prohibited within the boundaries of the City of Newport Beach except in an emergency subject to approval by the Chief." • Section 9.04.170. Amendment to Section 82.102(a) of the Uniform Fire Code. Section 82.102(a) of the Fire Code is amended to read as follows: "Section 82.102.(a) Permit. No person shall install or maintain a liquified petroleum gas container, except portable containers of not more than twenty (20) gallons water capacity, unless natural gas is unavailable in the area or unless such installation is needed for special industrial process or use, unless a permit has been issued by the Chief. An application for permit shall be accompanied by plans and specifications and the Chief may impose such conditions as may be necessary to protect • health, safety and welfare." 11 Section 9.04.180. Amendment to Appendix II -C of the Uniform Fire Code. Appendix II -C 6 (a) of the Fire Code is amended to read as follows: "Appendix II -C 6 (a) Any portions of a float more than 150 • feet from fire apparatus access or a marine service station shall be provided with an approved wet standpipe system installed in conformity with applicable standards in Uniform Building Code Standard No. 38 -2 and Article 10 of the Fire Code." Section 9.04.200. Amendment to Section 10.507 of the Uniform Fire Code. Section 10.507 of the Fire Code is amended by adding subsection (i) to read as follows: "Section 10.507 (i) System Design. Automatic sprinkler system design shall comply with the requirements of the applicable codes and the following: 1. The total demand for hydraulically designed sprinkler systems shall not exceed 90% of the available pressure and water • supply. 2. Sprinkler system design including any required additional water for hose or standpipes shall not exceed the rated capacity of a fire pump used to supply the system. Section 9.04.210. Amendment to Section 2.105 of the Uniform Fire Code. Section 2.105 of the Fire Code is amended by adding the following Subsection: "Section 2.105. (a) Sworn members of the Newport Beach Fire Department shall have the power to issue citations for violations of the Fire Code." Section 9.04.220. Amendment to Article 2 of the Uniform Fire • Code. Article 2 of the Fire Code is amended by adding Section 2.111 to read as follows: "Section 2.111. Fees. The Newport Beach City Council shall 7 establish by resolution, and from time to time amend, fees for the administration of this Chapter. Fees required by this Chapter shall be in addition to those required by any other Chapter of this code." Section 9.04.230. Amendment to Section 10.301 of the Uniform • Fire Code. Section 10.301 of the Fire Code is amended by adding Subsection (c) as follows: "Section 10.301(c) Chains. Chains, cables, or ropes that extend across driveways or other vehicle entrances, shall be made visible by placing a 12 inch by 12 inch reflective sign every six (6) feet or portion thereof. The lowest point or center span shall be at least 20 inches above the ground." Section 9.04.240. Amendment to Section 10.503 of the Uniform Fire Code. Section 10.503 of the Fire Code is amended by adding the following: "Section 10.503. All fire - extinguishing systems, including automatic sprinkler systems, Class I, II and III combined standpipes, Halon systems and other special automatic extinguishing systems, and basement pipe inlets shall be approved and shall be subject to periodic tests as may be required. A condition of approval of Halon systems shall be satisfactory passage of a full discharge test utilizing an approved test gas or an accepted room integrity test prior to final acceptance of the system. Such tests are only required when the room protected by the Halon system is not equipped with an automatic sprinkler system. The location of all fire department hose connections shall be approved by the Fire Chief." Section 9.04.250. Amendment to Section 10.509(b) of the • Uniform Fire Code. Section 10.509(b) of the Fire Code is amended to add the following text: "Section 10.509(b). Sprinklers shall not be installed when E:3 the application of water or flame and water to the contents may constitute a serious life or fire hazard. Other fire extinguishing systems compatible with the hazardous materials being stored or i used, and approved by the chief shall be provided." Section 9.04.260. Amendment to Section 10.204(a) of the • uniform Fire Code Section 10.2j04(a) of the Fire Code is amended to read as follows: "Section 10. 04(a) Dimensions. The unobstructed width of a fire apparatus ac ess road shall be not less than 20 feet. In the area of fire hydrants, the width shall be increased to 26 feet. The minimum widthliof a gate or opening that fire apparatus would be expected to use shall be not less than 14 feet unobstructed. This minimum width may be increased depending on the length of the approach. The unobstructed vertical clearance shall not be less than 13 feet 6 in hes unless approved by the Chief." Section 9.04.270. Amendment to section 10.301(a) of the Section 10. T (a) the Fire Code is amended to read as follows: "Section 10.301(a) General. Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to bE plainly visible and legible from the center of the street or road fronting the property. Said numbers shall contrast with their background. The minimum size numbers shall be 4 inches in heigilt." Section 9.04.280. Amendment to Section 80.103(c) and (d) of Section 80. 03(c) and (d) of the Fire Code is amended to read as follows: "Section 80.103(c). Hazardous Materials Management Plan. When required by the (Chief, each application for a permit pursuant to •this article shad include a Hazardous Materials Management Plan (HMMP) in accordance with Appendix II -E and shall contain any additional elements as required in the California Health and Safety 9 Code, Article 1, Chapter 6.95 for Business Plan. Section 80.103(d). Hazardous Materials Inventory Statement. When required by the Chief, each application for a permit pursuant to this article shall include a Hazardous Materials Inventory Statement (HMIs) in accordance with Appendix II -E and shall contain •any additional elements as required in the California Health and Safety Code, Article 1, Chapter 6.95 for Business Plan." Section 9.04.290. Amendment to Section 14.108(a) of the Uniform Fire Code. Section 14.108(a) of the Fire Code is amended by adding the following text: "Section 14.108(a) General. The fire alarm system shall be tested annually and a report shall be sent to the Fire Marshal within 30 days of the test." Section 9.04.300. Amendment to Section 80.104 of the Uniform Fire Code. Section 80.104 of the Fire Code is amended by adding subsection (a) and (b) as follows: • "Section 80.104 (a). Hazardous materials shall not be released into a sewer, storm drain, ditch, drainage canal, lake, river or tidal waterway, or upon the ground, sidewalk, street, highway or into the atmosphere. EXCEPTIONS: (same as in code) Section 80.104 (b) . Secondary containment may be required for those amounts under the exempt quantities in sections 80.302 through 80.315 if deemed necessary by the fire chief. Code. Section 9.04.310. Amendment to Article 29 of the Uniform Fire Article 29 of the Uniform Fire Code is amended as follows: • Scope Sec. 29.101. Garages used for service or repair of motor vehicles and classified as Group B, Division 1 or Group H, Division 4 Occupancies shall be in accordance with this article. 10 Permits Sec. 29. 102. For permits to use a structure as a place of business for the purpose of servicing or repairing motor vehicles, see Section 4.108, permit g.l. Flammable and Combustible Liquids • Sec. 29.103.(a) General. Storage, use and handling of flammable or combustible liquids shall be in accordance with Article 79, Divisions I through IX and this section. (b) Dispensing inside of Building. Class I liquids shall not be dispensed or transferred within a repair garage, except as provided in Section 79.903(h). When Class II and Class III -A liquids are dispensed in lubrication or service rooms, electrical and fuel- burning equipment shall comply with Sections 79.905 and 79.906. For operations involving dispensing of fuel into the fuel tanks of motor vehicles, see Article 79, Division IX. (c) Storage and Use in Building with Basements or Pits. When Class I liquids are stored or used within a building having a • basement or pit into which flammable vapors could travel, the basement or pit shall be provided with ventilation designed to prevent the accumulation of flammable vapors therein. (d) Storage and Handling of Liquids Drained from Vehicle. 1. Motor vehicle fuel. Motor vehicle fuel shall not be drained in Group B division 1 Occupancies. Liquids drained from motor vehicle fuel tanks in Group H, Division Occupancies shall be stored and handled as required for Class I liquids in accordance with Article 79. 2. Lubricating oil. Lubricating oil which has bee drained from motor vehicles in Group B, Division 1 or Group H, Division 4 Occupancies shall be stored and handled as required for Class III -B • liquids in accordance with Article 79. 3. Mixed Liquids. Containers and tanks containing a mixture of fuel and lubricating oil shall be installed in accordance with the requirements of Article 79 for Class I liquids. 11 (e) Storage. Liquids stored inside of building shall be kept in containers or tanks complying with Article 79, Division II and III. Liquids stored outside shall be kept in containers or tanks complying with Article 79, Division IV or V. Tank drainage lines terminating inside a building shall be • equipped with a nonremovable -type cap, such as a hinged cap. (f) Spill Control. Spill control shall be provided in accordance with Section 79.115. (g) Oily Waste Materials. Oily rags and similar materials shall be stored in metal - lined, or other approved containers equipped with tight- fitting covers. Sources of Ignition Sec. 29.104.(a) General within 18 inches of the floor. Sources of Ignition shall not be Smoking and open flames shall be prohibited in areas used for servicing internal combustion engines. (b) Welding. Welding operations shall be conducted only in Group H, Division 4 occupancies, and shall be in accordance with • Article 49." Section 9.04.320. Amendment to Section 10.504 of the Uniform Fire Code. Section 10.504 of the Uniform Fire Code is amended by adding subsection (d) as follows: "Section 10.504(d). Testing and Maintenance of Private Fire Hydrants. 1. General Requirements. To assure proper functioning, wet barrel hydrants shall be tested at least annually, and dry barrel hydrants tested semi- annually in the early spring and fall, and immediately after installation, relocation or repair. The Fire Chief may require a more frequent testing schedule if it is •determined to be necessary to assure the proper functioning and maintenance of private fire hydrants. Hydrant owners shall report to the Fire Department and Utilities Department as out of service when a hydrant is not functioning properly and when such previously 12 reported hydrant has been returned to proper condition. 2. Responsibility for Testing and Maintenance. The owners of any premises on which or on account of which private fire hydrants are installed, shall have the hydrants tested by a person who has demonstrated their competency in testing fire hydrants to the City. •These private hydrants shall be immediately serviced, overhauled or replaced whenever they are found to be defective. All costs of testing, repair and maintenance shall be borne by the property owner. The City will supply hydrant owners with a list of persons acceptable to the City to test private fire hydrants. The City will notify hydrant owners by mail when testing of a hydrant is needed and also supply hydrant owners with the necessary forms which must be filled out each time a hydrant is tested, relocated or repaired. 3. Testing and Maintenance Requirements. The persons testing private fire hydrants shall perform such tests and maintenance as required by the City. Testing and maintenance shall ensure private hydrants are ready for emergency use, provide unobstructed and • adequate water flow, are identifiable and accessible to Fire Personnel and all parts and connections are in working condition such that the operation of the fire hydrants may be readily accomplished by Fire Personnel. 4. Testing Notification. Any person testing a private fire hydrant shall notify the Fire Dispatcher and fire system alarm companies prior to and after work on the hydrant to avoid false alarms. 5. Certification of Private Fire Hydrant Testers. Each applicant for certification as a tester of private fire hydrants shall file an application with the Utilities Director of the City of Newport Beach. The certification shall be granted if the • applicant satisfies the following minimum requirements: a. Each applicant for certification as a tester of private hydrants shall have had at least two (2) years experience in fire hydrant testing, plumbing or pipe fitting or equivalent 13 qualifications; b. Each applicant for certification as a tester of private fire hydrants shall hold a valid certification from the American Water Works Association, California- Nevada Section, from a County certification program, a State licensing program or have equivalent • training in the opinion of the City and the Health Department; C. Each applicant for certification as a tester of private fire hydrants shall furnish evidence that he /she has available the necessary tools and equipment to properly test such devices. d. Competency in all phases of private fire hydrant testing and repair must be demonstrated by means of education and /or experience. Each tester shall be responsible for the competency and accuracy of all tests, reports and repairs performed by the tester. Section 9.04.330. Amendment to Appendix I -B of the Uniform Fire Code. Appendix I -B of the Uniform Fire Code is deleted. In its place the California Code of Regulations, Title 24 Sections 1733 • through 1747, are hereby adopted. Section 9.04.340. Amendment to Appendix III -B of the Uniform Fire Code. Appendix III -B of the Uniform Fire Code is deleted. In its place the City of Newport Beach Design Criteria, Standard Special Provisions & Standard Drawings for Public Works Construction, 1991 Edition, is adopted. Section 9.04.350. Amendment to Section 10.202 of the Uniform Fire Code. Section 10.202 of the Uniform Fire Code is amended by adding Subsection (b) as follows: "Section 10.202(b). Private Gated Communities. All private • gates and /or fire emergency access gates that have electricity, shall be equipped with an approved electronic strobe light receiver and a Knox key switch to open the gates) in an emergency. This installation requires a permit and a functional test when 14 completed." Section 9.04.360. Amendment to Appendix I -A 6 of the Uniform Fire Code. Appendix I -A 6(a) is amended by adding the following: "Appendix I -A 6(a) All Occupancies with sleeping areas shall ishave installed a functioning smoke detector per manufactures specification." Section 9.04.370. Amendment to Section 2.201 of the Uniform Fire Code. Section 2.201 of the Uniform Fire Code is amended by adding Subsection (i) as follows: "Section 2.201 (i). Marinas." Section 9.04.380. Amendment to Section 10.201 of the Uniform Fire Code. Section 10.201 of the Uniform Fire Code is amended by adding Subsection (b) as follows: "Section 10.201(b) Driveable Surface. Turf Block is not acceptable as a driveable surface for fire apparatus in lawns." • Section 9.04.390. Amendment to Section 79.910(e)4 of the Uniform Fire Code. Section 79.910(e)4 of the Uniform Fire Code is amended by adding an additional paragraph as follows: "Section 79.910(e)4 Marine Fuel Docks. An 24 1lx24" sign shall be predominantly displayed at the face of each marine vehicle -fuel dispensing station. The sign shall be reflectorized and have letters on a background of contrasting color. The size of the block lettering shall be as follows: The word "WARNING" 311, Text 2" and code sections in 1". The sign shall bear the following or equivalent wording: WARNING NO VESSEL SHALL BE MADE FAST TO A FUEL DOCK UNLESS ENGAGED IN FUELING OPERATIONS NBMC 9.04.010 and 1991 • UFC 79.910(e)4" Section 9.04.400. Severability. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or 15 unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Ordinance. The City Council hereby declares that it would have passed this Ordinance and each and every section, subsection, sentence, clause or phrase not declared •invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional. Section 2. The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. The City Clerk shall cause the same to be published once in the official newspaper within fifteen (15) days after its adoption. The ordinance shall become effective thirty (30) from its adoption. Section 3.
