I agree with the current Staff Report dated September 17, 2009 wherein it is states: the addition of live entertainment and extending the hours of operation for an additional hour is expected, to result in increased noise disturbances to the adjacent residences and neighborhood; and, the introduction of live entertainment (which will result in dancing even without a "dancing permit ") can potentially transform the restaurant into a nightclub, and due to the close proximity to a residential neighborhood, would result in a land use that is incompatible with the residential character of the neighborhood. Since mid 2007 I have been disturbed by loud, late night music and loud patrons, emanating from and around the Port Restaurant & Bar, as late as 12:30 a.m. Consequently, the attached article in the California Section of the LA Times, Orange County Edition, dated March 16, 2008 caught my eye. This article chronicles the problems Fullerton and Carlsbad encountered when restaurants were allowed to turn into nightclubs at 10:00 a.m. As quoted on the second page of the article, "These places have moved all their furniture, hired DJs and it's like a big fraternity party ". The numerous alcohol related problems are described. It is pointed out that restaurants in Carlsbad, like in Fullerton, began turning into nightclubs after 10 p.m., drawing younger and later- arriving crowds, more foot 1raffic and Yore alcohol related headaches. (emphasis added) However, even more critical to the amendments before you, the Port Restaurant and Bar is within a residential neighborhood, unlike the restaurant /nightclubs in Fullerton and Carlsbad. Since the City of Newport Beach is on notice as to the potential problems that can result if they allow the amendments to the use permit adding live entertainment (which will include dancing with or without a permit) and a 1:00 a.m. close time, there are serious liability issues to consider. These potential liability issues will arise if there is injury to persons (residents, including children) and/or damage to property and will potentially result in a monetary cost to the City for defense of such claims, as well as if liability is found in a court of law. If these amendments are allowed, there will also be the added cost to the City for the increase of law enforcement response to the Port Restaurant & Bar, as well as possible overtime costs for responding and/or additional officers. I would like the commission to consider a few key points which were not raised: - This facility is "embedded" in a residential neighborhood as compared to the other restaurants in CdM which are on Coast Highway - The history of complaints with the current operation - The fact that if a restaurant closes at midnight, not everyone has cleared the scene at midnight, and the noise of patrons leaving is one of the main complaints, the management cannot be expected to stop chatting, laughing, good -byes and the inevitable person who can't operate their car alarm. - Starbucks and the various "workout facilities' (which is also within earshot of my residence) open at 6:00 (with employees and trainers arriving even earlier) therefore the "night" in between is being squeezed from each side. - It appears that the majority of the supporters are from outside the immediate neighborhood and most of the people who are against the proposal are from the immediate neighborhood and that a CUP is an extra privilege granted by a community, not a right. I attended last month's meeting and heard all the public comments but unfortunately, I won't be able to attend this next meeting. I'm am not a regular patron of The Port Restaurant but I have lived on the 400 Block of Heliotrope for most of the last 30 years. (Twelve years at 437 Heliotrope, nearly across the street from the restaurant site and for the last 16 years a bit further down the block at 418 Heliotrope.) In addition, my 88 year old father currently resides in the front house at 435 Heliotrope. At the August meeting, I heard comments from several of my neighbors' regarding late night noise from music or departing patrons and I am very sympathetic to their discomfort. On the other hand, I guess I need to say the neither my father nor I have been personally inconvenienced by anything related to The Port Restaurant's activities. In fact, I have been impressed with the care this management seems to have exercised to provide a high quality dining venue within our community and to be a considerate neighbor. If they are granted their permit modification request and continue to be proactive in their efforts to manage their presence in this residential community, I would have to say, that's good enough for me. Zadeh; as the owner of the Port Restaurant & Bar (collectively the "Port "), seeks to amend the Use Permit to: (1) extend the Port's hours of operation by one hour from midnight to 1:00 a.m.; (2) to continue the previous use of live entertainment;' and (3) to open for lunch on the weekends. Contrary to the proposed Findings of ' It is the position of the Port that as a nonconforming use, its right to "live entertainment" is protected because this right existed before the ordinance became effective in 1985 and continued following its effective date until enforcement was 1 the Planning Department Staff Report ( "Staff Report "), the Port does not seek the introduction of "DANCING." There was never any intention of the Port becoming a nightclub. This point was made on the record by Mr. Zadeh at the last Planning Commission hearing conducted on August 20, 2009, and repeated during subsequent conversations with the Planning Department staff. The Port intends to continue offering fine dining at reasonable prices to a growing customer base, the majority of whom are young professionals and /or local residents. By providing tasteful, low -key background music in the form of live entertainment (one person /duo acoustic /jazz) or a DJ making music selections, the Port hopes to attract additional patrons during these challenging economic times. The Port has also been willing to cooperate with its residential neighbors in an effort to accommodate all reasonable concerns involving the operation of the business. The Port employs approximately 25 individuals and is highly regarded by the business community. The Port is an active participant in many civic causes and events. (See letters of support from the Corona Del Mar Chamber of Commerce, Corona Del Mar Business Improvement District and Newport Beach Chamber of Commerce). At the hearing conducted on August 20, 2009, the Staff Report recommended denial of the Application based on the erroneous description of the Port as a nightclub with DANCING. The Staff also based its recommendation on two citations of the Code Enforcement (issued during winter 2009 for live entertainment) and Police which are, currently both being appealed to the City and challenged in court by Mr. Zadeh respectively. These citations should be excluded from consideration since such matters have not been finally determined. No dispute exists that the results of the sound tests involving the Port produced results in compliance with the City's Community Noise Control Ordinance. (Municipal Code Chapter 10.26). There is also sufficient off -site parking directly across the street from the Port to satisfy the Municipal Code's requirement of 40 parking spaces for a building of the Port's size. The commercial building next to the off -site parking does not require weekend or evening parking. The Port has finalized an agreement with its off- site parking landlord for a three year extension of the off -site parking. In addition, the Port's Use Permit sought under Newport Beach Municipal Code section 20.82.060 during the spring of 2009. Live entertainment has always been a part of this site's restaurant history when it operated under the various names: Pirate's Inn, Trees, Mistral and Svelte. (See letters of Judy Chamberlain and Frank and Dana Ramos). The request for live entertainment is included in the Port's Application to amend its Use Permit solely as a precaution, not because the Port believes it to be necessary for compliance. 2 The Port is a four star Zagat -rated restaurant. provides the Port with an alternative. The Use Permit expressly states at page 3, paragraph 3 that: "If the applicant loses the use of the subject parking spaces at a later date can and cannot obtain the required number of parking spaces at another approved location, the net public area of the restaurant facility shall be reduced so as not to exceed the net public area that currently exists on the site" Actually, the Port does not believe parking to be a critical issue because the majority of patrons walk to the location. The Port requested a continuance of the hearing for approximately 30 days to correct certain mischaracterizations in the record concerning its Application and to present evidence of the continuous performance of live entertainment at the site (for more than 30 years), the negative economic consequences associated with denial of the Application, as well as to augment the previously submitted sound test, to submit evidence of its security system and to provide additional letters and testimony of support from patrons and community organizations, including the Corona Del Mar Business Improvement District, the Corona Del Mar Chamber of Commerce and the Newport Beach Chamber of Commerce. The Port has not yet made its formal presentation to the Commissioners. The Commissioners unanimously continued the hearing for 30 days until September 17, 2009, for the purpose of allowing the Port additional time to prepare its case in support of the Application. THE PORT SHOULD BE ALLOWED TO CONTINUE ITS LIVE ENTERTAINMENT AS A "NON - CONFORMING USE" AND SHOULD NOT BE UNFAIRLY DISCRIMINATED AGAINST BY BEING DENIED AN EXTRA HOUR OF OPERATION FOR WINDING DOWN ITS BUSINESS IN A GRADUAL AND ORDERLY MANNER Live Entertainment as a "Non - Conforming Use" The Port's property rights include the right to have live entertainment at its venue. The Port's Use Permit was obtained in 1977, prior to the regulation of live entertainment by the City. The City Attorney's office reports that 1997 version of Municipal Code Section 20.82.060 requiring eating and drinking establishments to obtain a permit for live entertainment was passed in 1985. As a consequence, the Port's right to provide live entertainment should not be restricted. The rights of users of property are those which existed at the time of the ordinance. Such rights are well recognized and have always been protected. Edmonds v. County of Los Angeles, 40 C2d 642, 651 (1953). Users are entitled to exercise those rights which lawfully existed before the ordinance became effective and such rights continue following the effective date of the ordinance. In this case, live entertainment has always been a part of the attraction of the previous restaurants operating at the Port site. Any attempt to restrict such use is therefore invalid. Only during the last few months 3 due to the questionable motives of a few residents, has the Port's right to provide live entertainment become an issue. In these stressful times, it seems more important than ever for people to have ,a place to go to relax and take their minds off the pressures of the day. The Port seeks to provide such an environment with good food and pleasant music. a THE APPLICATION SHOULD BE GRANTED BECAUSE "IT WILL NOT BE DETRIMENTAL TO THE PUBLIC HEALTH, SAFETY, PEACE, MORALS, COMFORT, OR WELFARE OF PERSONS RESIDING OR WORKING IN OR ADJACENT" TO THE PORT. A. The Findings of the Staff Report are Seriously Flawed. 1. The Staff Report concerning the extension of the hours of operation and live entertainment is based on four reasons, none of which are valid or well- founded. For example, reasons 1 and 2 appearing on page 20 of the Staff Report involve the sound test previously submitted. It is agreed that "the sound test submitted by the applicant indicate (sic) that live entertainment can be performed within the restaurant in compliance with the City's Community Noise Control Ordinance," yet the Staff Report expresses concern about the opening of the dining room and bar area to the outdoor atrium patio. This objection is without merit because the latest sound test was conducted with the doors and windows of the Port wide open. As was the case with the original sound test, the recent sound tests conducted on September 15, 2009 ( "Second Sound Test ") also fall well within the City's requirements. The Second Sound Test was conducted at the property occupied by the principal complaining resident in order to determine whether noise could be heard from the Port. The answer was no. The finding of the Staff Report also ignores the counter measures the Port will be taking to ensure that restaurant sounds are contained within the confines of the Port. (See Project Description attached to the Application). It is proposed . that a "new door will be added at the front patio entry to achieve better crowd control and further minimize sound from the restaurant. A platform stage with acoustical wall and ceiling panels will also be integrated into the existing first floor plan as a well sound insulated entertainment area." 3 As a restaurant, the live music cannot be unduly loud because it would otherwise interfere with the patrons' ability to engage in dinner conversation. 4 2. The second reason cited in the Staff Report improperly questions the validity of the sound tests. The.sound tests in this case were conducted under similar if not identical conditions to those of a regular business evening at the Port. The Port has augmented the record with the Second Sound Test since the last hearing conducted on August 20, 2009. The Second Sound Test was made using both a DJ and live music with all the windows and doors open in the Port's bar and dining room areas in order to simulate the proposed remodel. The Second Sound Test was made from the property of the few complaining residential neighbors. All the sound tests demonstrate that the noise levels from the Port fall well within the City's acceptable levels for commercial businesses. It should be noted too that the standard for any sound test should be an objective one: would the average, reasonable resident consider the sound so loud and offensive as to constitute a nuisance? It is not just a matter of whether any sound can be heard because all urban areas have noise as contrasted with rural areas having a reduced population. Perhaps, the complaining residents are particularly sensitive to sound or the noise levels could be controlled simply by closing a door or window. Other residents living in close proximity to the Port have expressed no concern about the noise of the Port. Is an extension of one hour of operation that significant especially when the primary reason for such request is to allow patrons to leave the Port in a gradual and orderly manner. Without mentioning any names, other eating and drinking establishments in relatively close proximity to the Port close down at 2:00 a.m., not 1:00 a.m. as the Port requests. The Port's request for an extension of one hour of operation is reasonable to maintain a competitive advantage. In addition to the owner's rights, an ordinance setting closing hours for an establishment providing live entertainment raises free speech issues under the both the federal and state Constitutions. Due deference must be given to those individuals seeking to exercise those rights and any regulation thereof must be narrowly . and explicitly drawn so as not to impinge on those rights. The references to people's talking and laughing in the Staff Report are therefore inappropriate. Patrons have the right to assemble and engage in free speech in a commercial setting. The Port is zoned as a commercial area and surrounded by five other commercially zone buildings. Its rights to conduct business should not be diluted simply because it happens to be close to a residential area like most businesses in Corona del Mar, especially when the evidence clearly shows that it has taken reasonable steps to accommodate the concerns of the surrounding residents, such as maintaining security, its willingness to provide additional security and installing sound -proof measures to control noise. The complaints of a few residents based on the unfounded and clearly prejudicial assertions that the Port ' will allow DANCING and be operating as a nightclub are designed to undermine the welfare and enjoyment of the community as a whole. The Corona del Mar area has always been faced with incompatible uses requiring a balancing of interests. No one interest should be allowed to predominate over others especially when such interest is in the minority. The commercial district regulations after are all are designed to strengthen.the City's economic base, and provide employment opportunities close to home for residents of the City and surrounding communities. The basis for the Staff Report's recommendation of denial on page 21 of the Staff Report is not accurate. The Port has finalized a three year extension of its off -site parking agreement. The commercial office space referenced in the Staff Report will not need evening or weekend parking. To the extent that parking ever becomes an issue, the Use Permit already contains an alternative for the Port to scale back its operations accordingly. "Any concern about property values should take into consideration what the impact on property values would be of another shuttered business. The area has experienced a decline in the number of restaurants and bars over the past couple years as reflected by the poor and vacant condition of those structures. N IPA THE REQUESTED AMENDMENTS ARE CRITICAL TO THE CONTINUED OPERATION OF THE PORT The Port currently employs approximately 25 individuals. These employees look to the Port for their livelihood. With dependents, this number increases to close to 100. The Port also contributes to the City, County and State through the payment of business, real property and sales taxes. For example, the real estate taxes for the Port site are approximately $20,000.00 per year. There can be little question that these are difficult times for most businesses, particularly those located in California. One need only survey the surrounding area to note the number of establishments closed down. According to data from the Corona del Mar Business Improvement District ( "BID ") that Mr. Zadeh is a director of, 102 businesses have closed over the last three years and there are 376 current members. BID has direct information that at least 16 businesses closed within the last year due to adverse economic conditions. Furthermore, 580 businesses in the area closed their doors over the last ten years. Many restaurants have gone under during the past couple years. Many are in very poor physical condition, subject to deterioration, vandalism and rodents. As the Port's graphics will show, the Port is currently operating at a break even point. Without an, extra hour of operation and the continuance of live music, its ability to survive as a viable business is clearly in question. The pertinent inquiry is whether Corona Del Mar needs another vacant storefront. If.the Port is closed, what if anything will replace it? As the record in this case amply reflects, the Port has always been operated with taste and in a respectful manner. Mr. Zadeh is a long time homeowner in the Corona del Mar area who contributes a great deal in the way of time, money and good will to the community. By contrast, the Port site can either become vacant or be occupied by a business which contributes which may not add anything special to the area. The Port's requested amendments to the Use Permit are modest and should be approved. V. CONCLUSION The Port's Application should be approved as submitted. The Port has.demonstrated that the proposed amendments to its Use Permit are reasonable and will not be detrimental to the public health, safety, peace, morals, comfort or welfare of persons residing or working in or adjacent to the Port. Chris called me the afternoon of September 10`h and stated that the testing could not take place on Friday because it wasn't good for the "other people" involved and he thought it would be on Tuesday the 15th , but it was not finalized. I told him that Tuesday night was not good for me as I work 60 miles away and work late, I have an early morning appointment the next day and my young grandchildren, who live in the same home as I do and have bedrooms on the second floor, would be asleep as they have school the next day. He more or less said it is what it is but, agreed to get back to me as to the exact date. We monitored the ambient noise level at an average of 50.0 dba and had very little detectable sound coming from the restaurant with no increase on the monitor from ambient level. The home owner at 429 Heliotrope was not available to allow monitoring at their residence but we were able to check outside at the property line with the same results as the previous residence. We further checked 2 other locations as we approached the restaurant and again, had no detectable noise increase. l:onctusion We found the noise levels remain consistent with our previous measurements. We also conclude the noise levels generated by a DJ system or Live entertainment will be audible from time to time, but they should not be perceived as loud.
