We purchased the duplex (704 E. Ocean Front) next door to the Balboa Inn about 1974. o

We have had a very good relationship with the Balboa Inn until several years ago when thy:;,
Balboa Inn drastically changed their activities. The advent of loud amplified music cause t
disturbance to our tenants. .1..
The people in the lower unit were so disturbed by afternoon amplified music that they had to
move. This cost us several thousands of dollars. They had spoken several times to the people in
the hotel with no relief coming.
One weekend night, I was awakened by _a phone call at about 11:15 PM from our upstairs tenant
at 704 E. Ocean Front. He said that he could not sleep because of the great noise disturbance
form the Balboa Inn. Since I live on Balboa Island, I came right over to the area. There were
masses of people milling around on the boardwalk and on Main Street. The very loud amplified
music was the boom -boom type that shook our building. There was a guard (bouncer) at the
door allowing people in as others came out. The whole scene was as a night club. The Balboa
Inn had distributed flyers to surrounding communities inviting them to come to the Night Club
type activity.
Upon checking with the City, it was found that a previous Use Permit had prohibited such
activities.
A hearing was held and new guidelines were issued. (Since that time we have had no complaints
from our tenants.)
If the proposed Use Permit returns to the earlier conditions, we will be very upset and unhappy.
What are the specific conditions that are recommended ? Times, dates, type of music, etc.
What measures have been taken to keep the amplified music within the limits ?
How do you determine if the noise is above the limit ?
What happens if it is ?
What consequences are there if the disturbance happens time after time ?
What recourse do we have as disturbed neighbors ?
Again, under the current conditions, we have no complaints.
If the Balboa Inn can maintain the required level of noise that does not disturb our tenants in the
evenings and afternoons, we will be pleased.
We want the Balboa Inn to have a successful business, respecting the rights of the neighbors.
