HomeMy WebLinkAbout94-14 - Amending Title 20 of the Newport Beach Municipal Code Amending Districting Map No. 3, So as to Establish a 20 Foot Front Yard Setback on 12 Lots (11 Parcels) Adjacent to the Rivo alto Channel (Planning Commission Amendment No. 792)ORDINANCE NO. 94 -14 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, AMENDING TITLE 20 OF THE NEWPORT BEACH MUNICIPAL CODE AMENDING DISTRICTING MAP NO. 3, SO AS TO ESTABLISH A 20 FOOT FRONT YARD SETBACK ON 12 LOTS (11 PARCELS) • ADJACENT TO THE RIVO ALTO CHANNEL (Planning Commission Amendment No. 792) WHEREAS, Section 20.84.010 of the Municipal Code of the City of Newport Beach provides that Title 20 (the Zoning Code) may be amended by changing the zoning designation of Districts and other provisions whenever the public necessity and convenience and the public welfare require such amendment; and WHEREAS, the proposed 20 foot front yard setback on the eleven parcels (12 lots) in question will be consistent with the front yard setback established on other blocks fronting on The Rivo Alto Channel; and WHEREAS, the project has been determined to be Categorically Exempt • from the provisions of the California Environmental Quality Act (CEQA) under Class 5 (Minor Alterations in Land Use Limitations); and WHEREAS, pursuant to Section 20.84.030, the Planning Commission of the City of Newport Beach held a public hearing regarding Amendment No. 792 on February 10, 1994; and WHEREAS, on March 14 , 1994, the City Council of the City of Newport Beach held a public hearing regarding Amendment No. 792. NOW THEREFORE, the City Council of the City of Newport Beach does hereby ordain as follows: SECTION 1: The following described real property in the City of Newport Beach, County of Orange, State of California, • Lots 1 -5, Block 433 and Lots 1 -7, Block 434, Canal Section, located at 405 -409 Clubhouse Avenue and 3311 -3413 Finley Avenue, on the northeasterly side of the Rivo Alto Channel between 35th Street and Clubhouse Avenue, in West Newport, as shown on Districting Map No. 3, referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20 of said Code, is hereby amended so as to delete the existing 35 foot front yard setbacks measured from the original lot line of the subject properties, and that a 20 foot front yard setback be established on Districting Map No. 3 measured from the original lot lines, adjacent to The Rivo Alto Channel. SECTION 2: The Planning Director of the City of Newport Beach is hereby instructed and directed to change Districting Map No. 3 referred to in Section 20.01.050 of the Newport Beach Municipal Code and by such reference made part of Title 20, to reflect • the changes described in Section 1 above, and when said Districting Map has been so amended, the same shall be in full force and effect and be part of Title 20 of the Newport Beach Municipal Code. SECTION 3: The Mayor shall sign and the City Clerk shall attest to the passage of this Ordinance. This Ordinance shall be published once in the official newspaper of the City, and the same shall become effective thirty (30) days after the date of its adoption. SECTION 4. This Ordinance was introduced at a regular meeting of the City Council of the City of Newport Beach, held on the 28th day of Feb. , 1994, and was adopted on the 14th day of March , 1994, by the following vote, to wit: • AYES, COUNCIL MEMBERS HEDGES.
