The Planning Commission and City Council completed their preliminary review of the
draft General Plan elements on January 31, 2006. Since then, the staff and consultant
team have incorporated the changes requested by the Commission, or by the Council
when that direction was different from the Commission's. The Draft General Plan has
been prepared, distributed to the Commission and Council, and made available for
public review. The Commission held a public hearing on the following elements on April
6, 2006: Harbor and Bay, Historical Resources, Recreation, Arts and Cultural, Natural
Resources, Safety and Noise.
DISCUSSION TOPICS FOR THIS PUBLIC HEARING
Three public hearings have been scheduled for review of the Land Use and Circulation
Elements, as they are the elements involving the most significant and complex
decisions. In order to facilitate the Commission's deliberations, staff recommends that
the following topic areas be discussed at the first of these hearings:

LAND USE ELEMENT
The Land Use Element is divided between city-wide goals and policies and those that
are specific to a District or Corridor. The city-wide goals and polices address such
issues as the character of the City, what uses are to be accomodated, how they are
distributed and how they are designed. These goals and policies can be found on pages
3 -5 through 3 -63 of the draft General Plan. Attached to this report are "comparison
copies" of the policies contained in the elements on this agenda. These copies show, in
strikeout and underline in the left column, the changes requested by the Commission.
The right column shows the policies as they appear in the public review draft of the
General Plan.
Land Use Diagram (Map)
The goal of the draft land use map is to portray the allowed land uses, as well as their
intensities and densities, graphically as much as possible, and create a planning tool
that is useable to City staff and decision makers and the public.
A greater variety of land use categories than in the existing Land Use Element have
been created to ensure that land use designations accurately portray the character of
development intended for a particular area. For example, though both the Corona del
Mar commercial area and Fashion Island are dominated by retail and service
commercial uses, they are very different functionally and in their scale, design and
character. Similar differences in scale and character can be found in residential, office
and mixed -use areas. This variety of land uses prompted the need to create a wide
range of land use designations to accurately portray the intended uses and densities
and intensities for particular areas. In order to better illustrate the designations, the map
has been broken down into twelve 11 x 17 inch area maps. In instances where no
change in density or intensity is proposed and the density or intensity allowed by the
existing General Plan does not fit into one of the newly created Land Use Designations,
properties have been identified on the Map with a number and have been included on
the Anomaly Table. This table represents properties where site speck densities or
intensities have been assigned. Although this Anomaly Table has been placed in the
Appendix of the draft General Plan, staff recommends that it be moved to the body of
the Land Use Element since it is an exhibit of the land use map. The outline for how to

use the map is located on page 3 -11 of the draft Land Use Element and repeated
below.
a. Identify the parcel and land use designation on the Land Use Plan map.
b. Refer to Figure LU2 through Figure LU15 and Table LU1 to identify the range of
permitted uses and permitted density or intensity for the land use classification.
The maximum amount of development shall be determined by multiplying the
area of the parcel by the density/intensity.
d. For Special Land Use sites identified on the Land Use Map by a symbol, refer to
Table A2 (Anomaly Locations), found in Appendix A to this General Plan, to
determine the precise development limits.
e. For residential development in the Airport Area., refer to the policies prescribed
by the Land Use Element that define how development may occur.
Land Use Designation — Parks and Recreation (PR)
After further consideration since the draft General Plan was published, staff is proposing
a change in the proposed PR land use designation as it relates to private uses. The new
language continues to allow incidental buildings but limits other more intense
development to that provided in the Anomaly Table. Staff believes this policy would
eliminate the need for general plan amendments for small buildings and structures
incidental to a private recreational use. Proposed changes to the published Draft
General Plan language are shown in st4keet:/underline below.
PUBLIC, SEMI - PUBLIC, AND INSTITUTIONAL
The PF designation is intended to provide public facilities, Not applicable

libraries, community centers, public hospitals, and utilities.

facilities that serve the public, including places for religious

Existing and Proposed Plan Comparison Table and Exhibits
Exhibit No. 2 to this report is a table that compares the draft General Plan square
footage and dwelling unit totals to those in the existing General Plan by Statistical Area.
The table includes only those Statistical Areas that are not either partially or wholly
within a sub -area in which land use changes are proposed or in an area that requires a
more detailed discussion. Included with the table are exhibits that provide more detail
than can be shown on the table for several of the more complex areas. The

next week.
Generally, a difference in a particular area occurs for one (or more) of the following
reasons:
• In solely residential areas, the differences are typically due to the correction of
errors in calculating the number of residential lots.
• A modest change in intensity or density as a result of placing a property, which
had a specific square footage limit, floor area ratio (FAR) or specific number of
dwelling units, in a proposed land use category with different limits.
• The inclusion of an existing land use or property in the draft General Plan that
does not appear in the existing General Plan.
• The deletion of FAR limits for properties designated as PF (Public Facilities) from
the proposed General Plan. The existing General Plan is inconsistent in regard to
applying FAR limits to public facilities such as schools and City land uses. Cities
are not required to follow their own land use regulations for their own public
facilities. Staff recommends that the General Plan show no floor area restrictions
for public facilities to provide the City Council and community with the ability to
meet the needs for public facilities over time since these needs may change,
without amending the General Plan.
Sub -Areas (District and Corridors)
The sub -areas are those areas studied as candidates for changes in either types of land
uses or density or intensity of uses. Each of the following areas has specific goals and
policies in the draft Land Use Plan to guide development. An existing General Plan to
draft General Plan comparison table has been attached to this report for the following

To assist the Commission in their discussion at the public hearing, staff and the traffic
consultant will be prepared to provide an estimate of trip generation changes based on
any land uses changes contemplated by the Commission. The Daily Trip Generation
Summary form the traffic study which shows trip calculations for the sub -areas resulting
from the project analyzed in the EIR is attached as Exhibit No. 3. In regard to the
Circulation Element, staff suggests the Commission not make recommendations on

circulation improvements and polices until a recommended land use plan has been
decided upon and the traffic generation consequences of that plan are known.
ENVIRONMENTAL IMPACT REPORT:
The public notice for the public hearings on the General Plan state that comments on
the DEIR will be received at all hearings. The DEIR has not been released for public
review yet, because we are gathering additional information and expanding analysis of
impacts to be sure the document is a clear and complete as possible. Therefore, there
should not be any public comment on the DEIR at this hearing. As the public begins to
review the DEIR, comments on it are expected at future hearings, as well as in writing.
Staff would appreciate hearing any comments from the Commission as early as
possible, to assist in preparing responses to comments and preparing the Final EIR for
the Commission's consideration
Public Notice:
Notice of this public hearing, and subsequent public hearings on the General Plan
update and EIR, was provided by a quarter page display advertisement in the Daily Pilot
on April 8, 2006. Government Code Section 65091 provides that, when the number of
property owners to whom notice would be required to be mailed is greater than 1,000
(which is the case with a comprehensive General Plan update), notice may be provided
by placing a one - eighth page advertisement in the local newspaper.
