AN URGENCY ORDINANCE OF THE CITY COUNCIL OF
THE CITY OF NEWPORT BEACH AUTHORIZING POSTING
OF POLITICAL SIGNS IN RESIDENTIAL DISTRICTS.
•The City Council of the City of Newport Beach does hereby
ordain as follows:
SECTION 1: The City Council of the City of Newport Beach
finds and declares as follows:
A. A recent ruling of the United States Supreme Court
invalidating a municipal ordinance prohibiting the posting of
political signs in residential districts may affect this city's
ability to enforce provisions of its Sign Ordinance;
B. In the absence of this ordinance, the city may be
unable to prevent the proliferation of political and campaign signs
proceeding and following the municipal election scheduled for
• November 8, 1994;
C. The proliferation of political and campaign signs in
the absence of regulation could create traffic hazards and visual
blight which could depress property values.
D. This ordinance contains appropriate time, place, and
manner restrictions which allow adequate channels of communication
while insuring that the proliferation of signs does not adversely
impact the community.
E. The City Council is authorized to adopt interim
urgency ordinances relating to land use and zoning issues pursuant
to provisions of the City Charter and §65858 of the Government
Code.
SECTION 2: Notwithstanding the provisions of Chapter 20.06 of
• the Newport Beach Municipal Code, temporary political and campaign
signs may be posted in residential districts subject to the
following time, place, and manner restrictions:
A. Definition
The term "political or campaign sign" shall mean any

sign which supports or opposes a ballot measure or candidate for
political office, or contains material representing the speaker's
views or philosophy on political issues;
B. Restrictions
(1) One political sign may be posted on each parcel
• of residential property;
(2) Political and campaign signs posted in
residential districts shall not exceed 6 square feet in area;
C. Political signs shall not be placed adjacent to a
street, alley, driveway, or sidewalk in a manner that creates a
hazard to any person;
D. Political signs may be posted in residential
districts no more than 90 days prior to any municipal, school
district, special, or statewide election, and shall be removed no
more than 10 days after the election.
E. No person shall place or post any political or
campaign sign on any public sidewalk, street, property, or right-
of-way over which the city has jurisdiction.
SECTION 3: Notwithstanding the provisions of Section
20.06.08OB2B, temporary political or campaign signs may be posted
for a period not to exceed 90 days prior to any municipal, school
district, special, or statewide election, and shall be removed no
more than 10 days after the election.
SECTION 4• Term.
This ordinance will take effect immediately and shall remain
in effect for a period of 45 days or until a successor ordinance is
approved, whichever occurs first.
• SECTION 5: Severability.
The City Council of the City of Newport Beach hereby declares
that if any section, subsection, sentence, clause or phrase of this
Ordinance is, for any reason, held to be invalid or
unconstitutional, such decision shall not affect the validity or

constitutionality of the remaining portions of this Ordinance. The
City Council hereby declares that it would have passed this
Ordinance, and each section, subsection, clause or phrase hereof,
irrespective of the fact that any one or more sections,
subsections, sentences, clauses and phrases be declared
• unconstitutional.
SECTION 6: The Mayor shall sign and the City Clerk shall
attest to the passage of this ordinance. The City Clerk shall
cause the same to be published once in the official newspaper of
the City within fifteen (15) days after its adoption.
This Ordinance was introduced at a regular meeting of the City
Council of the City of Newport Beach held on the 8th day of
August , 1994, and adopted on the 8th day of August 1994,
by the following vote, to wit:
