The paint spray booth replaces an existing paint booth. RECOMMENDED ACTION: Continue the public hearing on Use Permit No. 2001 -030 (PA2001 -158) to the meeting of May 9, 2002. APPLICANT: Mr. Jess Salem 101 Shipyard Way, B2 Newport Beach, CA 92663 PROPERTY OWNER: Lido Peninsula Company 201 Shipyard Way, #1 Newport Beach, CA 92630 LOCATION: Easterly side of Shipyard Way at the southern terminus of Lido Park Drive (southeastern tip of Lido Peninsula). LEGAL DESCRIPTION: APN 047- 010-09 GENERAL PLAN: Mixed Single Family Attached and Recreational Marine Commercial. ZONING DISTRICT: Planned Community Discussion The proposed project consists of the replacement of an existing paint spray booth with a new paint booth at the Newport Harbor Shipyard. The new booth will be located in approximately the same location as the previously- existing booth. The new structure will be 35 feet in height and is located within the 26/35 Height Limitation District. The height limit may exceed the 26 -foot limit up to 35 feet, provided that a use permit is approved. However, the public hearing notice did not advertise the request for the exceeded height. Therefore, it is necessary to re- notice the public hearing and to send out new pubic hearing notices. Staff is requesting the Planning Commission to continue the public hearing to the meeting of May 9, 2002, to allow the re- notice. Conclusion Staff requests that the Planning Commission continue the public hearing on UP2001 -030 to the meeting of May 9, 2002. Submitted by: PATRICIA L.
