RESOLUTION OF INTENTION NO. 12
A RESOLUTION of the Board of Trustees of the City of Newport
Beach, declaring its intention to open and extend 23rd Street in
said City; describing the work to be done or improvement to be
made and the lands deemed necessary to be taken therefor and
specifying the exterior boundaries of the district of lands to be
effected or benefited by said work or improvement and to be
assessed to pay the damages, costs or expenses thereof; directing
the posting and publication of notices according to law and des-
ignating the newppaper in which said publication shall be had.
The Board of Trustees of the City of Newport Beach does
hereby resolve and declare as follows:-
Section 1: RESOLVED: That the ptmblic interest and con-
venience require and that it is the intention of the Board of
Trustees of the City of Newport Beach to order the following work
to be done or improvement made, which work or improvement is de-
scribed as follows: The opening of 23rd Street in the City of
Newport Beach from its present southern terminus on the north
line of Ocean Avenue in the City of Newport Beach, across the
said ocean Avenue in the City of Newport Beach in a southeasterly
direction to the waters of the Pacific Ocean with a uniform width
of fifty feet.
Section 2: RESOLVED: That the land deemed necessary to be
taken therefor is described as follows, to -wit:-
Commencing at a point where the northwesterly line of 23rd
Street intersects the southwesterly line of Ocean Avenue as shown
on a map of Newport Beach recorded in Book 3 at page 26 of Miscel-
laneous Maps, records of Orange County, California; thence south-
westerly along the produced northwest line of 23rd Street 150 feet
more or less, to the waters of the Pacific Ocean; thence southeast•
erly along the shore of the pacific Ocean to a point on the pro-
duced southeasterly line of 23rd Street 150 feet, more or less, to
the southwesterly line of Ocean Avenue; thence northwesterly along
the southwesterly line of Ocean Avenue 50 feet to the place of be-
ginning and being the southeasterly 25 feet of Block "A" 23 and
the northwesterly 25 feet of Block "A" 22 as per map of Newport
Beach, recorded on the 16th day of February, A. D. 1904, at page
26 of Book 3 Miscellaneous Maps, records of Orange County, Cali-
fornia.
Section 3: RESOLVED: That the Board of Trustees of the
City of Newport Beach deem it proper that the boundaries of the
district of lands to be effected and assessed to pay the damages,
costa and expenses of opening 23rd Street in the City of Newport
Beach from its present southern terminus on the north line of

®cean Avenue in the City of Newport Beach, across said Ocean
Avenue in said City in a southeasterly direction to the waters of
the Pacific Ocean with a uniform width of fifty feet, shall in-
clude the whole City of Newport Beach and the exterior boundaries
of the City of Newport Beach as now established are hereby de-
clared to be the exterior boundaries of said district of lands.
Section 4: RESOLVED: That the Street Superintendent shall
cause to be posted along the line of said contemplated work and
improvement, at not more than 300 feet in distance apart but not
less than three in all, notices of the passage of this Resolution.
Said notices shall be headed "Notice of Public Work" in letters
of not less than one inch in length and shall, in legible char-
acters state the fact of the passage of this Resolution, its date,
and briefly the work or improvement proposed and shall refer to
this Resolution for further particu.7ars.
Section 5: RESOLVED: That, where as there is no daily news -1
paper published and circulated in the City of Newport Beach, the
Street Superintendent shall, theredbre, cause a notice similar
in substance to be published by four successive insertions in the
Newport News, a weekly newspaper published and circulated in the
City of Newport Beach, which Newport News is hereby designated for
that purpose.
The above and foregoing Resolution of Intention No. 12 was
passed and adopted the 22nd day of June, A. D. 1908, at a regular
meeting of the Board of Trustees of the City of Newport Beach by
the following vote, to wit:
AYES, C. A. Barton, F. W. Beckwith, John McMillan, A. N. Smith,
Jos. Ferguson

the foregoing Resolution of Intention is hereby approved
this 22nd day of June, A. D. 1908.

tained in my office, the foregoing Resolution No. 12
was duly and regularly adopted, passed, and approved by
the City Council of the City of Newport Beach, California,
at a regular meeting of said City Council held at the
regular meeting place thereof, on the 22 day of
June 9 1908 , by the following vote,
to wit:
