' A Resolution of the City of Newport Beach, a municipal

corporation of the sixth class, in the State of California,
by the legislative branch thereof, to -wit: the Board of Trustees
2
of said city, determining and declaring that the public interest
_
and also the public necessity of the City of Newport Beach, Cali -
3
fornia, demands the acquisition and construction of a municipal
water works, for the city of Newport Beach, including wells,
4
engines, boilers, pumps and the necessary buildings and structures
in which to house the same, and also including pipes, conduits,
5
mains and laterals, and all other machinery, apparatus and ap-
pliances necessary and convenient to Earry out the objects and
6
purposes of said municipal water works, the cost of which muni-
cipal water works will be toogreat to be paid out of the ordinary
7
I annual income and revenue of the City of Newport Beach.

Also a Resolution of the City of Newport Beach, determin-
ing and declaring that the public interest and also the public
9
necessity of the city of Newport Beach, California, demands the
acquisition and construction of a municipal light works, including
10
generators, holders and retainers for creating and storing illum-
inating gas and the necessary buildings and structures in which
11
to house the same, and also including distributing pipes and
conduits and all other machinery, apparatus and appliances for
12
the creation, storing and distribution of illuminating gas,
necessary and convenient to carry out the objects and purposes of
13
said municipal light works the cost of which municipal light works
will be too great to be paid out of the ordinary annual income
14
and revenue of the City of Newport Beach.

Whereas, the public interest and also the public necessity
17
of the City of Newport Beach, a municipal corporation of the
18
sixth class in the State of California and of the inhabitants
19
I thereof, demands the acquisition and construction of a municipal
20
water works for the said city of Newport Beach, including wells,
21
engines' boilers, and pumps, and the necessary structures and
22
buildings in whic$ to hoiz e the same; and also including pipes,
23
conduits, mains and laterals, and all other machinery, apparatus
24
and appliances necessary and convenient to carry out the objects
25
and purposes of said municipal water works; the cost of which will
26
ii be too great to be paid out of the ordinary annual income and

I► revenue of the City of Newport Beach.

And, Whereas, the public interest and also the public

necessity of the City of Newport Beach, a municipal corporation

of the sixth class in the State of California, demands the ac-

quisition and construction of a municipal light works, for the

City of Newport Beach including generators, holders and re-

tainers, for the purpose of creating and storing illuminating gas
and the necessary structures and buildings in which to house the
same, and also including distributing pipes and conduits and all
other machinery, apparatus and appliances for the creati;;n, stor-
in,g and distribution of illuminating gas, necessary and con-
venient in carrying out the objects and purposes of said municipa
light works; the cost of which will be too great to be paid out
of the ordinary annual income and revenue of the City of Newport
Beach.
Therefore, be it resolved by the legislative branch of
the City of Newport Beach, to -wit; The board of Trustees of
said City, First:
Section 1.
Resolved, that it is hereby determined and de-
clared by the Board of Trustees of the City of Newport Leach,
that the publicinterest and the public necessity of the City of
Newport Beach, California, and the inhabitants thereof, demands
the acquisition and consti4ction by the City of Newport Beach, of
a municipal water works, including wells, engines, pumpt, and the
necessary buildings and structures in which to house the same,
and also including pipes, conduits, mains and laterals, and all
other machinery, apparatus and appliances necessary and con-
venient for carrying out the objects and purposes of said muni-
cipal water works.
Section 2.
Resolved, that it is hereby determined and de-
clared that the estimated cost of the acquisition and constructi
of said municipal water works, for the City of Newport Beach,
including engines, boilers, pumps, and the necessary structures
and buildings in which to house the same, and also including
pipes, conduits, mains and laterals and all other machinery, ap-
paratus and appliances necessary and convenient to carry out the

objects and purposes of said municipal water works, is the sum
of Forty Thousand Dollars ($40,000).
Section 3.
Resolved, that the objects and purposes of the
acquisition and construction of said municipal water works, is
to supply and furnish to the City of Newport Beach, and the in-
habitants thereof, a constant and sufficient supply of fresh
and wholesome water for domestic purposes, for sprinkling the
streets and to have adequate water under sufficient head and
pressure to protect all property within the corporate limits of
the City of Newport Beach, against fire.
Section 4.
Resolved, that the acquisition and construction
of said municipal water works, is necessary and convenient to
carry out the objects, purposes and powers of the City of Newport
Beach, and that the cost of the acquisition and construction of
said municipal water works, including engines, boilers, pumps and
the necesaary buildings and structures in which to house the same,
and also including pipes, conduits, mains and laterals and all
other machinery, apparatus and appliances necessary and conveni-
ent to carry out the objects and purposes of said municipal water
works, will be too great to be paid out of the ordinary annual
income and revenue of said city.
Section 5.
Resolved, that in order that the City of Newport
Beach pay the cost of the acquisition and construction of said
municipal water works, including engines, boilers, pumps and the
necessary buildings and structures in which to house the same,
and also including pipes, conduits, mains and laterals, and all
other machinery, apparatus and appliances necessary and proper
to carry out the objects of said municipal water works, sa id
Board of Trustees determines and declares that the public interest

and public necessity demands that the bonds of the City of New-
port Beach, in the aggregate sum of Fortyy thousand dollars,
($40,000) shall be issued and sold by said city to raise money to
pay for said municipal water works, and that for such purpose,
a special election by the qualified voters of the City of Newport
Beach, shall be hereafter called for the purpose of submitting
to the said qualified voters thereof, the proposition whether or
not the bonds of the City of Newport Beach, shall be issued and
sold in the aggregate sum of Forty thousand dollars, ($401000)
to pgy the cost of the acquisition and construction of said muni-
cipal water works.
Section 6.
Resolved, that all proceedings of the City of
Newport Beach, in the acquisition and construction of said muni-
cipal water works, are and shall be under and in accordance with
an act of the Legislature of the State of California, entitled:
"An act authorizing the incurring of indebtedness by cities,
towns and municipal corporations for municipal improvements, and
regulating the acquisition, construction and completion thereof ",
(Which became a law under constitutional provision without the
Governor's approval, February 25th, 1901,) and acts amendatory
thereof.
Be it further resolved by the legislative branch
of the City of Newport Beach, to -wit: the Board of Trustees of
said city, Second:
Section 1.
Resolved, that it is hereby determined and de-
clared by the Board of Trustees of the City of Newport Beach,
that the public interest and the public necessity of the City of
Newport Beach, California, and the inhabitants thereof, demands
the acquisition and construction by the City of Newport Beach,
of a municipal light works, including generators, holders and

retainers for creating and sabring illuminating gas, and the
necessary buildings and structures in which to house the same,
and also including distributing pipes, conduits and all other
machinery, apparatus and appliances for the creation, storing
and distribution of illuminating gas necessary and convenient in
carrying out the objects and purposes of said municipal light
works.
Section 2.
Resolved, that it is hereby determined and de-
clared that the estimated cost of the acquisition and constructi
of said municipal light works, including generators, holders and
retainers, for creating and storing illuminating gas, and the
necessary buildings and structures in which to house the same,
and also including distributing pipes, and conduits, and all oth
machinery, apparatus and appliances for the creation, storing and
distribution of illuminating gas, necessary and convenient to
carry out the objects and purposes of said municipal light works,
is the sum of Twenty -five thousand dollars, ($25,000).
Section 3.
Resolved, that the objects and purposes of the
acquisition and construction of said municipal light works, is to
furnish to the City of Ne,,ITot Beach, and to the inhabitants there
of, an adequate and sufficient supply of illuminating gas for
domestic use and with which to light the streets and public build
ings of the City of Newport Beach.
Section 4.
Resolved, that the acquisition and construction
of said municipal lightworks, is necessary and convenient to
carry out the objects, purposes and powers of the City of Newport
Beach, and that the cost of the acquisition and constructionrof
said municipal light works, including generators, holders, and
retainers for creating and storing illuminating gas, and the nec-

essary buildings and structures in which to house the same, and
also including distributing pipes and conduits and all other
machinery, apparatus and appliances for creating, storing and dis
tributing illuminating gas, necessary and convenient in the carry
ing out of the objects and purposes of said municipal light works
will be too great to be paid out of the ordinary annual income
and revenue of said City.
Section 5.
Resolved, that in order that the City of Newport
Beach pay the cost of the Acquisition and construction of said
municipal light works, including generators, holders and retainerE
for creating and storing illuminating gas, and the necessary
buildings and structures in which to house the same, and also in-
cluding distributing pipes, and conduits, and all other machinery,
apparatus and appliances for the creation, storing and distribu-
tion of illuminating gas, necessary and convenient in carrying
out the objects and purposes of said municipal light works, said
Board of Trustees determines and declares that the public interest
and the.public necessity demands that the bonds of the City of
Newport Beach, in the aggregate sum of Twenty -five thousand dol-
lars, ($25,000) shall be issued and sold by said City, to raise
money to pay for said municipal light works, and that for such
purpose, a special election by the qualified voters of the City
of Newport Beach, shall be hereafter called for the purpose of

pal light works, are and shall be under and in accordance with
an act of the Legislature of the State of California, entitled:

The above and foregoing resolution was passed, adopted and
approved this 18th day of October, 1909, at a regular meeting of
the Board of Trustees of the City of Newport Beach, by a two-
thirds vote of all the members of the said Board of Trustees of
the City of Newport Beach, to wit:

I, L. S. Wilkinson, Clerk of the City of Newport Beach, do
hereby certify that the whole number of members of the Board of
Trustees of the City of Newport Beach, California, is five, (5);
and that the foregoing resolution was passed by the 'card of Trus-
tees of said city at its regular meeting held on the 18th day of
October, 1909, by a vote of two - thirds of all the members of said
Board of Trustees.
That the same constitutes the full number of trustees
present at said meeting and that two - thirds of the whole number
of trustees of said city, voted in favor of the passage of said
Resolution; and said Resolution was, on the 18th day of October,
