Resolution ordering work done,'No.
A Resolution of the Board of Trust "e'es of the city of .New-
port Beach, declaring that the public interest and alsothe public
convenience requires, that certain work be done in and upon a portion
of certain public streets in the city of Newport Beach, and order-
ing the doing of said work.
The Board of Trustees of the city of Newport Beach do
resolve and declare as follows:
That rhereas,' the public interest and also the public
convenience requires, that certain portions of 29th and 29th Streets
be brought to grade and capped and also that sidewalks and curb be
built upon and along said certain portions of said streets, and
Whereas,- the Board of Trustees of the city of.Newport,
Beach did, on the 13th day of January, A.D. 1913, pass-and adopt
a resolution of intention to do said work, which resolution of in-
tention described the work to be done; and
Whereas, said resolution of intention was posted conspic-
bously.for two days, cn or hear the chamber door of the council
chamber, to -wit: the mebting place of the Board of Trustees of the
city of Newport Beach, and was also published by two insertions in
the NEWPORT NEVIS, a weekly newspaper published and circulated in the
city of Newport Beach, which.newspaper was designated in said re-
solution of Intention by said council for that purpose; and
Thereas, the Street Superintendent of the city of New-
port Beach did thereupon cause to be conspicuously posted along
the line'of; the work or improvement contemplated by said resolu-
tion of intention, at not more than 100 ft. in distance apart,
-but not less than three in all, notices of the passage of said
resolution of intention, which notices were headed: "Notice of
Street work" in letters not less than one inch in length and did,
in legible characters, state, =the fact of the passage of said re-
solution of intention, togetVer with its date and briefly describ-
e8 the work or improvement proposed, and did further refer to the

cause a notice similar in substance to be published by one insert -
01 ion in the NEWPORT NEWS) gwweekly newspaper published and circulatdd
in the city of Newport Beach, which newspaper was also designated in
said Resolution of Intention for ghat purposei and
Whereas, more than twenty days have expired after the time
of the publication of said notice by said Street,Superintendent, and
Whereas, more than twenty -five days have expired after the advertis-
ing and posting of said Resolution of Intention, and no objection
or objections, written or otherwise, have been entered or made by any
person or persons,
Now therefore be it resolved: That the Board of Trustees
of the city of Newport Beach have acquired jurisdiction to and do
hereby order, the following work to be done or improvement made:
It is ordered that all of that portion of 28th and 29th
Streets, public streets of the city of Newport Beach which lies and
is between Ocean Avenue also a public street therein, and Southern
Pacific right of way, be filled in and brought to a sub -grade of
eix inches below the official line and grade of said 28th and 29th
streets, and then capped with a crown of earth eix inches thick,
rolled and tamped to a true and even surface, on the line of and
to the official height and grade of said dtreets established and
provided for by Section 4 of Ordinance 18 of the city of Newport
Beach, and on file in the office of the Clerk thereof; provided
that this resolution ordering work done, shall not apply to that
portion of 28th and 29th Streets whichis now filled, graded and
capped as herein specified.
IF It is ordered that a cement sidewalk and'cement curbing
be constructed upon and along that portion of 28th and 29th Streets
public streets of the city of Newport Beach, which lies betwean
Ocean Avenue, a public street in said city, and Southern Pacific
right of way, the cement sidewalk and curbing shall be constructed
upon and along both sides of said 28th and g9th Streets, and upon

the sidewalk reservation, established and provided for on said
streets by subdivision "c" ofSection 1, Ordinance No. 24 of the
city of Newport Beach, and now on file in the office of the Clerk
thereof. The cement sidewalk shall be constructed upon and along
the inn,erportion of said sidewalk reservation and adjoining and
parellel with the property line on said streets and shall be 5 ft.
and 6 in. in width; the cement sidwalk shall be constructed in
accordance withthe specifications for constructing cement sidwalks
in the city of Newport Beach, as established and provided for by
Subdivision a and b of Section 4, Ordinance 24 of said city, and
now on file in the office of the Clerk; which specifications are
and shall be as follows:
(a) The earth foundation shall befilled in and tamped solid
to such a height as when surfaced, shall conform to the grade vs-
tablished for said streets.
(b) The cement surfacing of said sidewalk shall consist of
a foundation layer 21" thick of concrete, composed of seven parts
of fine, clean gravel to one part of best Portland cement, and fin-
ished with a layer z" thick composed of equdl parts of clean, sharp
sand and best Portland cement floated and trowled to a true, even
surface, sloping from the property line towards the street in the
ratio of 3 /16th of an inch fall to each foot in width of the sidtivalk.
The cement curb shall be constructed upon said sidwalk
reservation along and parellel with the outer or street line thereof
and shall be (onstructed in accordance with the specifications for
constructing cement curbing, established and provided for by sub -
division "c "of Sec. 4 6f Ordinance 24, of the city of Newport Beach,
and now on file in the office. of the Clerk thereof, which specific-
ations are and shall be as follows:
(c) The cement curb stall consist of a core 10" thick at the
bottom and 6" thick at the top and 15" deep, set with the batter
towards the street, and the top, when finished, in line with the
sloping surface of the walk.
the core to be concrete, composed of seven parts of fine, clean gra-
vel to one part of best Portland cement, the top and upper 10"
of the batter or street surface to be dressed Zv thick with a cement
finished composed of equal parts of sharp, clean sand and beat Port-
land cement.
b Provided that this resolution ordering work done,shall
not apply to that portion of 29th and 29th Streets upon and along
which a cement sidwalk and a cement curb has already been constructed
as specified herein. All of which portions of said streets are ex-
cepted herefrom.
Be it further resolved that the work or improvement herein
ordered, the same not being for the construction of sewers, that
plans and specifications and careful estimates of the costs and ex-
penses thereof need not be furnished.
Be it further resolved, that the Clerk of the city of
Newport Beach post this resolution conspicuously for two days, on
or near the door of the Council chamber of the Board of Trustees
and publish the same by two insertions in the Newport News, a weekly
newspaper published and circulated in the cityof Newport Beach,
which weekly newspaper is hereby desigBated for that purpose.
The above and foregoing resolution ordering work done
