A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT
BEACH, AWARDING THE CONTRACT FOR CERTAIN h0 RK ON CERTAIN PORTIONS
OF 28th.STREET,30th. STREET AND 31st. STREET WITHIN THE SAID
CITY OF NEWPORT BEACH.
WHEREAS,the Board of Trustees of the City of Newport Beach did
on the 23rd day of June, 1919, duly adopt a Resolution No. 109
ordering the following work to be done.:
That all those parts of the following described streets or
portions of streets within the said City be improved as follows,
to wit:
That that portion of the roadway of 28th Street included
a line 14 feet northerly and 14 feet southerly of and parallel
with the center line of said 28th Street,from a line 10 feet
southwesterly of and parallel with the northeasterly line of
Central Avenue to a line 80 feet easterly of and parallel with the
southeasterly line of Lafayette Avenue; and that that portion of
the roadway of 30th Street included between a line 14 foet north-
erly and 14 feet southerly of and parallel with the center line
of 3Cth. Street, from a line 1C feet southwesterly of and parallel
with the northwesterly prolongation of the northeasterly line of
Central Avenue, lying southerly of said 3Gth. Street to a line 80
feet easterly of and parallel wiht the southeasterly line of
Lafayette Avenue; and that that portion of the roadway of 31st.
Street included between a line 14 feet southerly of and parallel
with the center lienof 31st. Street,S'rom a line 10 feet westerly
of and parallel with the northerly prolongation of the easterly
line of Central Avenue, lying southerly of said 31st. Street, to
the northewesterly line of Lafayette Avenue, including those
portions of all street and alley intersections lying 14 feet
northerly and southerly of and parallel with the center lines of
the hereinbefore mentioned portions of 28th. Street, 3Cth Street

and 31st. Streeet, be graded to the official grade, and a surface
be constructed thereupon of a five (5) inch concrete pavement in
accordance with plans, profiles and cross - sections numbered 250,
251 and 252, adopted by Resolution No. 106 of the Board of Trustees
of said City, and on file in the offcie of the City Engineer of
said City, and in further accordance with Specifications No. 31,
adopted by Resolution No. 105 of the Board of Trustees of said
City, and on file in the offcie of the City Clerk of said City.
That the said contemplated work or improvemrettof said portions
of 28th Street, 30th Street and 31st. Street, ins in the opiUion
of the Board of Trustees of said City, of more than local ordinary
public benefit, said Board hereby makes the expense of dsaid work
or improvement chargeable upon a district, which district said
Board hereby declares to be the district benefited by said work
and imporvement, and to be assessed to pay the costs and expenses
thereof; which said district is bounded and described as follows,
to wit:
Beginning at the intersection of the center line of Central
Avenue and the westerly prolongation of the northerly line of Lot
5, Block 431, of a Map of Lancaster's Addition to Newport Beahh,
as recorded in Map Book 5, page 14, Records of range County,
California; thence easterly along the westerly prolongation of the
northerly line of the aforesaid Lot 5, and along the northerly
line of said Lot 5, to the northeasterly corner thereof; thence
easterly in a straight line, along the alleys in 'locks 431 and
530 of aforesaid Map of Lancaster's Addition to Newport Beach, to
a point in the center line of Lafayette Avenue, which point is
129.11 feet northeasterly of the center line of 31st. Street,
measured along the cneter line of Lafayette Avenue; thence south-
westerly along the cneter line of Lafayette Avenue to the inter-
section of the westerly prolongation of the northerly line of
Lot 4, Block 429, of a Map of Lancaster's Addition to Newport
Beahc hereinbefore referred tog thence easterly along the westerly

prolongation of the northerly line fo the aforesaid Lot 4, Block
429, and along the northerly line of said Lot 4, to the north-
easterly corner thereofg thence southwesterly in a straight line
to the southeasterly corner of Lot 6, Block 425, of the afore-
said Map of Lancaster's Addition to Newport Beach; thence westerly
along the southerly line of the aforesaid Lot 6, Block 425, to
the southwesterly corner thereof; thence northwesterly across
Lafayette Avenue to the southeasterly corner of Lot 3, Block 325,
of a Map of Lancaster's Addition to Newport Beach, hereinbefore
referred to; thence westerly in a straight line to the south-
westerly corner of Lot 8, of the aforesaid Block 325; thence
southwesterly across Villa Way to the southeasterly corner of
LGt 22, Block 225, of the aforesaid Map of Lancaster's Addition
to Newport Beach; thence southwesterly along the southerly line of
the aforesaid Lot 22, Block 225, to the southwesterly corner
thereof; thence southwesterly in a straight line across the Alley
to the southeasterly corner of Lot 7, Block 225, of _a Map of
Section A, Newport Beach, as recorded in Map Book 4,page 21,
Records of Orange County,California; t hence southwesterly along
the southerly line df the aforesaid Lot 7, Block 225, and along
the southwesterly prolongation of the southerly line of said Lot
7, to the intersection with the center line of Central Avenueg
thence northerly along the center line of Central Avenue to the
intersection with the westerly prolongation of the northerly
line of Lot 5, Block 431, of the aforesaid Map of Lancaster's
Addition to Newport Beach, the place of beginning, excepting
therefrom lands forming part of any public street or alley.
The said Board of Trustees determines that serial bonds
shall be issued to represent each assessment of $25.OG or more
for the costs of said work or improvement said serial bonds
shall extend over a period of nine years from the 2nd day of
January next succeeding the date of said bonds and shall bear

interest at the rate of seven per centum per annum, and an even
annual proportion of the principal sum thereof shall be payable
by coupon on the 2nd day of January of each year after their
date until the whole is paid, and the interest shall be payable
semi - annually by coupon on the second days of January and July
respectively of each year at the rate of seven per centum per
annum on all sums unpaid until the whole of said principal and
interest have been paid.
All of the prodeedings for the aforesaid improvement and for
the issuance of said bonds shall be taken under and inaccordance
with the provisions of an Act of the Legislature of the State of
California, known and designated as the "Improvement Act of 1911,"
and all acts amendatory thereof.
AND WHEREAS, by said Resolution the City Clerk was directed
to publish and post a noti2e inviting proposals for doing said
work, as required by the law and the time for opening said bids
was fixed at the horu of eight o'clock P.M. of Monday the 14th
day of July,1919, and the said Board did in open session of the
said 14th day of July, 1919, publicly open, examine and declare
all sealed proposals or bids offered for the aforesaid work, and
thereafter the said Board of Trustees did on the 1 7th day of July,
1919, duly adopt a Resolution No. 113 rejecting all of the said
proposals or bids received and directed the City Clerk to re-
advertise for proposals or bids for the preformance of the work
as in the first instance as required by law and the time for
opening said bids was fixed at the hour of eight o'clock p.m.
of Monday the 4th day of August, 1919;
AND WHEREAS, the Board of Trustees of the said City of
Newport Beahh in open session on the 4th day of August, 1919,
has publicly opened,examined and declared all sealed proposals
or bids offered for the aforesaid work;

Now therefore, be it resolved by the said Board of Trustees, that
the said Board hereby rejects all of said bids except the next
herein mentioned and hereby awards the contract for said work to
the lowest, regular, responsible bidder therefor, to%. wit:.
TO Rogers Brothers Company
at the prices specified in their proposal on f11b for said work,
to wit:
Paving and grading, per square foot 25 8/10 cents
AND BE IT FURTHER RESOLVED, that the City Clerk is hereby
directed to post notice of this award conspicuously for five
days on or near the Council Chamber door of the Board of Trustees
of said City, and also to publish said notice by two insertions
in the Newport News a weekly newspaper, printed,published and
circulated in said City and which is hereby desingated for that
purpose.
Passed by the Board of Trustees of the City of Newport Beach
at their regular meeting held on the 6th day of August, 1919.
