RESOLUTION NO. 140.
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF NEWPORT
BEACH AWARDING THE CONTRACT FOR THE CONSTRUCTION OF THE CEMENT
PIPE SANITARY SEWERS, REINFORCED CONCRETE SEPTIC TANK, REIN-
FORCED CONCRETE PUMPING STATIONS, SLUDGE BED AND THE APPURTEN-
ANCES TO SAID WORK, BEING ALL OF THE WORK OR IMPROVEMENT CALLED
FOR AND DESCRIBED IN RESOLUTION NO. 133 OF THE SAID BOARD OF
TRUSTEES.
WHEREAS, the Board of Trustees of the City of Newport Beach
did on the 15th day of September, 1920, duly adopt a resolution,
being Resolution No. 136 ordering that all of the cement pipe
sanitary sewers described in Resolution No. 133 of said Board
of Trustees adopted July 6th, 1920, being the resolution of
Intention for the construction of said sewers, together with
all of the appurtenances thereto, the concrete septic tank,
the reinforeced concrete pumping station therein designated as
pumping station No. 1, the sludge bed, the reinforced concrete
pumping station therein designated as pumping station No. 2,
the reinforced concrete pumping station therein designated as
pumping station No. 3, together with all buildings, equipment
and appurtenances for the said work mentioned or described in
said Resolution No. 133, be constructed, which said Resolution
No. 133 is hereby referred to for a description of the said
proposed work or improvement and is herebyyexpressly adopted
and made a part of this resolution the same as though fully
set forth herein. And said Board of Trustees determined in
said Resolution of Intention No. 133 that the aforesaid work
or improvement in the opinion of the said Board of Trustees is
of more than local or ordinary public benefit and said Board of
Trustees then determined that the district which it, in said
Resolution of Intention declared to be the district to be
assessed to pay the costs and expenses of said work is the
district within the said City of Newport Beach benefited by
said work or improvement and to be assessed to pay the costs

and expenses thereof, to which Resolution of Intention ref-
erence is hereby made for a description of the said assessment
district. And said Board of Trustees did therein determine
and give
Notice that serial bonds to represent unpaid assessments,
and to bear interest at the rate of seven per cent per annum
will be issued hereunder in the manner provided byvthe Improve-
ment Act of 1915, the last installment of which bonds shall
mature fourteen years from the second day of July next succeed-
ing nime months from their date.
AND WHEREAS, by said Resolution No. 136 the City Clerk was
directed to publish and post a notice inviting proposals for
doing said work, as required by law and the time for opening
said bids was fixed at the hour of 7:30 P.M. of Monday the 11th
day of October, 1920;
AND WHEREAS, the Board of Trustees did receive bids for
said work on said date, which bids were rejected, and on the
7th day of March, 1921, the said Board of Trustees passed
Resolution No. 139 directing the City Clerk to publish and post
a notice inviting proposals for doing said work as in the first
instance, as required by law and the time fixed for opening said
bids was fixed at the hour of 7:30 P.M. of Monday the 28th day
of March, 1921;
AND WHEREAS, ttie Board of Trustees of the said City of New-
port Beach did in open session on the 28th day of March, 1921,
publicly open, examine and declare all sealed proposals or bids
offered for the aforesaid work;
NOW THEREFORE, be it resolved by the said Board of Trustees,
that the said Board hereby rejects all of said bids except the
next herein mentioned bid which said Board finds to be the
lowest regular bid of any responsible bidder and hereby awards

the contract for said work to the lowest, regular, responsible
bidder therefor, to wit:

AND BE IT FURTHER RESOLVED,that the City Clerk is hereby
directed to post notice of this award conspicuously for Hive
days on or near the Council Chamber door of the Board of Trustees
of said Uity, and also to cause the same to be published by one
insertion in the Newport News, a weekly newspaper, printed,
published and circulated in said City and which is hereby
designated for that purpose.
