RESOLUTION NO. 4-///.
A RESOLUTION OF THE BOARD OF TRUSTEES OF THE
CITY OF NEWPORT BEACH DECLARING THEIR INTENTION
TO ORDER THE IMPROVE!MiT OF CERTAIN PORTIONS OF
BAY AVENUE, ! THIN SAID CITY, UNDER THE IMPROVE -
BENT ACT OF 1911, AND THE AMENDMEXTS TO SAID ACT.

The Board of Trustees of the City of Newport Beach do
resolve as follows:
SECTION I.
That the public interest and convenience require, and
it is the intention of the Board of Trustees of the City of
Newport Beach, California, to order the construction of the follow-
ing described work and improvement in said City, to -wit:
That Bay Avenue from the northeasterly prolongation of
the northwesterly line of. .A- Street,
longation of the southeasterly line
westerly line of Bay Avenue and the
said Bay Avenue, be graded and that
cement concrete curb be constructed

The grades to which the work provided for shall be done
and the improvements made upon said portion of Bay Avenue herein -
before described, which are provided for in this Resolution, are
the grades shown on the profiles therefor on file in the office
of the City Engineer, to which said profiles reference is hereby
0 made for the description of such grades.

All of the foregoing work and improvement is fully set
iforth, delineated and described on plans, profiles, cross- sections
• and detailed drawings, No. 336, on file in the office of the City
Engineer of said City, heretofore approved y the Board of Trustees
of the City of Newport Beach on the �/ .day of January, 1927,
by-Resolution No. (O , and in further accordance with
Specifications No. 39, adopted by Resolution No. 346, and on file
in the office of the City Clerk of said City. The said plans,
profiles, cross - sections, detailed drawings and specifications
are hereby referred to for the full and detailed description of
the said proposed work and improvement.
SECTION II
That the Board of Trustees also determine and declare
that serial bonds bearing interest at the rate of seven (7) per
cent per annum shall be issued to represent each assessment of
twenty -five (25) dollars or more remaining unpaid for twenty (20)
days after the date of the warrant. Said serial bonds shall
extend over a period ending nine (9) years from the second day
of January next succeeding the fifteenth(15th) day of the next
November following their date. Payments on the principal of
unpaid assessments and interest shall be made by property owners
to the City Treasurer and the same shall be disbursed by him, all
as provided in the said Improvement Act of 1911.
SECTION III
That the contemplated work and improvement hereinbefore
mentioned is, in the opinion of said Board of Trustees, of more
• than local or ordinary public benefit, and the expense of said
• work and improvement is made chargeable upon the district herein-
after described and said Board of Trustees do hereby declare said
district to be the district benefited by said work and improvement,
and to be assessed to pay the costs and expenses thereof, which
district is bounded and iescribed as follows, to -wit;

Beginning at the intersection of the center line of
A- Street and the Westerly prolongation of the northerly line of

that portion of Central Avenue (North Drive) lying easterly of
A- Street; thence easterly along the northerly line of Central Avenue
(North Drive) to the. southeast corner of Lot_ 7, Block 15, of the
Eastside Addition to the Balboa Tract, as per map thereof recorded
in piscellaneous Lraps, Book 4, page 20, Records of Orange County,
California; thence northerly along the easterly line of the last
mentioned Lot 7, and along the northerly prolongation of said
easterly line of Lot 7, to its intersection with the center line
of Bay Avenue; thence northwesterly along the center line of Bay
Avenue, and along the northwesterly prolongation of the center
line of that part of Bay Avenue lying easterly of A- Street, to its
intersection with the northwesterly line of A- Street; thence.
southwesterly along the northwesterly line of A- Street to the
northeast corner of Lot 7, Block 11, of the Balboa Tract, as per
map thereof recorded in Miscellaneous Maps Book 4, page 11, Records
of Orange County, California; thence northwesterly in a direct line
to the northwest corner of Lot 4, of the last mentioned Block 11;
thence southwesterly along the northwesterly line of the last
mentioned Lot 4, to the southwest corner of said Lot 4; thence
southeasterly in a direct line to the southeasterly corner of Lot 7,
of the last mentioned Block 11; thence southerly in a direct line
to the place of beginning, excepting therefrom any lands forming
any part of any public street or alley.
The above description is general only. A plat or map
of said District, No. 337, adopted by Resolution No. /7- /o
of the Board of Trustees of said City, indicating by a boundary
line the extent of the territory included in the proposed district,
is on file in the office of the City Clerk. Reference is hereby
made to said plat or map for a further full and complete description
of the said assessment district. The said map or plat so on file
shall govern for all details as to the extent of the said assessment
district.
SECTION IV.

Notice is hereby given
that on Monday, the
21st day of
February, 1927, at 7:30 o'clock,
P.M. in the Council
Chamber of
the City Hall of the said City of
Newport Beach, any
and all
persons having any objections to
the proposed work or
improvement,
or to the extent of the district,
or both, map appear
before the
said Board of Trustees and show cause
why said proposed
improvement

should not be carried out in accordance with this Resolution.
• SECTION V.
• The Newport News, a weekly newspaper, printed, published
and circulated in the Cityof Newport Beach, is hereby designated as
the newspaper in which this Resolution of Intention shall be pub-
lished,, and for the publication of all other notices, resolutions,
orders or other matter required to be published by the provisions
of the Improvement Act of 1911, hereinafter referred to, and the
City Clerk of said City is hereby directed to cause this Resolution
of Intention.to be published by two insertions in said newspaper
in the manner and form required by law. The Board of Trustees do not
deem it_ advisable that the Clerk mail copies of the notice df
improvement to owners, or reputed owners, and he is not required to
mail the same.
SECTION VI:
The Street Superintendent of said City shall, after the
adoption of said Resolution of Intention, cause to be conspicuously
posted along the lines of said contemplated work or improvement,
and along all the open streets within the hereinbefore described
assessment district, notices of the passage of this Resolution of
Intention, in the manner and form required by law.
SECTION VII.
All the proceedings for the aforesaid work and improve-
ment shall be had and taken under and in accordance with the pro-
visions of an Act of the Legislature of the State of California,
designated as the 'Improvement Act of 191111, approved April 7th,
1911, and Amendments thereto. —
