HomeMy WebLinkAbout412 - Pacific Drive VacationRESOLUTION NO. 111y • A RESOLUTION OF THE BOARD OF TRUSTEES OF THE • CITY OF NEWPORT BEACH DECLARING VACANT FOR PUBLIC STREET PURPOSES CERTAIN PORTIONS OF PACIFIC DRIVE 'WITHIN SAID CITY. `MEREAS, the Board of Trustees of the City of Newport teach, on the 20th day of December, 1926, at a regular meeting of said Board held on that date, duly passed and adopted a resolution, being Resolution No. 402, entitled, °A Resolution of the Board of Trustees of the City of Nei -port Beach declaring their intention to vacate,.close -up and abandon for public street purposes certain portions of Pacific Drive, within said City"; and TAEREAS, the Street Superintendent of the City of Newport Beach, after the passage of said Resolution, caused to be conspicuously posted along the line of said contemplated improvement, at not more than three hundred (300) feet in distance apart and not less than three (3) in all, notices of the passage of said Resolution, said notice being headed "Notice of Public 17orks"in letters not less than one (1) inch in length, and stating the fact of the passage of said Resolution, its date and briefly the work of improvement proposed, being that of vacating the above named street as hereinafter described, and the said notice herein mentioned referred to said Resolution for further particulars; said Street Superintendent having also caused a notice similar to that hereinbefore referred to to be published by four (4) successive • insertions in the Newport News, a weekly newspaper printed, published and circulated in said City of Newport Beach (there being no daily • newspaper so printed, published and circulated in said City, and Smore than ten (10) days after the exUiration of the time of publication of said notice having elapsed and no objections to the said improvement have been delivered to the City Clerk of the City of Newport Beach, and the said Board of Trustees having acquired �, 1 - i • Jurisdiction to order the vacation of said street as hereinafter described; NOIT, THEREFORE, the Board of Trustees of the City of Newport Beach do resolve as follows. SECTION I. That that portion of the public street hereinafter described, within said City, be closed -up, vacated and abandoned for public street purposes, and the portions of said street so closed -up, vacated and abandoned for public street purposes are described as folloTs: All that portion of Pacific Drive described as beginning at a point in the center line of said Pacific Drive, which point is North 50 degrees 'Fest, a distance of 104.32 feet from the inter - section of the center line of said Pacific Drive and the center line of Carnation Avenue (formerly called 30th Avenue) (measured along the center line of said Pacific Drive); thence South 26 degrees 28 minutes west, 47.25 feet, to a point in the northeast- erly line of that part of Pacific Drive heretofore vacated by Resolution No. 378, of the Board of Trustees of the City of Newport Beach; thence North 63 degrees 32 minutes Test, along the northeasterly line of the hereinbefore mentioned part of Pacific Drive vacated by Resolution No. 378, a distance of 80.84 feet, to a point; thence northerly around a circular curve with a radius of thirty (30) feet concave to the East, a distance of 13.46 feet, to a point; thence North 26 degrees 28 minutes East, a distance of 23.17 feet, to a point; thence South .78 degrees 47 minutes East, •� a distance of 64.33 feet, to a point; thence South 50 degrees East, a distance of twenty -two (22) feet, to the place of beginning. Also, all that portion of said Pacific Drive described as beginning at a point in the southwesterly prolongation of the 2 - __ �. •, a 15 • northwesterly line of Begonia Avenue (formerly called 29th Avenue), which point is South 40 degrees crest, a distance of sixty (60) feet (measured along the southwesterly prolongation of the northwesterly line of Begonia Avenue) from the intersection of the northeasterly line of Pacific Drive and the northwesterly line of Begonia Avenue; thence North 63 degrees 32 minutes Feet, along a line, to its intersection with the southwesterly line of Pacific Drive; thence South 24 degrees 59 minutes East, along the southwesterly line of Pacific Drive, to its intersection with the southwesterly pro- longation of the northwesterly line of Begonia.Avenue; thence North 40 degrees East, along• the southwesterly prolongation of the north- westerly line of Begonia Avenue, to the place of beginning. SECTION II That the public 'cork herein provided for is the closing- up of the portions of street herein described in Section I, and it appearing to the Board of ,Trustees that _th,ere are no costs, damages or expense occasioned by or arising out of said work, and that no assessment is necessary to pay the costs, damages or expenses of said "cork., and that, therefore, no commissioners shall be appointed to assess benefits and damages. SECTION III The City Clerk shall certify to the passage of this Resolution and shall cause the same to be published by one (1) insertion in the Newport News, a weekly newspaper printed, pub- lished and circulated in said City, and which is hereby designated for that purpose. .• Adopted this day of'{ 1927. e BOarc. of Trustees.
