RESOLUTION ORDERING WORK
No. y7P"_ .
WHEREAS, the City Council of the City of .Newport
Beach on the 5th day of November, 1928, passed its Resolution of
Intention No. 4177 , to order the hereinafter mentioned work;
to be done and improvement to be made in, over and along certain
certain
portions of Marine Avenue and Park.Avenue and /public rights —of —way
within said city, which Resolution of Intention No. "177
was duly and regularly published twice in Newport News, a weekly
newspaper published and circulated in the Oity of Newport Beach,
all as required by law, as appears from the affidavit of
the general manager and president
of the publis ere of said weekly newspaper, and which affidavit
was filed in the office of the Clerk of the City of Newport Beach
on the a ( day of November, 1928; and
WHEREAS, after the passage and adoption of said
Resolution of Intention No. Iii 7 , the Street Superintendent
of said Oity of Newport Beach caused to be conspicuously posted
along the line of the contemplated work and improvement , at not
more than three hundred (300) feet in distance apart, and Z1.36
in all, notices of the passage of said Resolution of Intention
which said notice was headed, NOTICE OF IMPROVEMENT, in the manned`
form and substance as required by law and the work being chargeabl0
upon a district, also conspicuously posted copies of said notice
along all of the open streets within said district at not more
three hundred (300) feet in distance apart as appease from the
affidavit of 0"L' pp '1 1�2 �,.Y�, assistant Street
Superintendent, who personally posted said notice of improvement;

WHEREAS, sO , the said
assistant Street Superi tendent of.said City of Newport Beach,
commenced to post said notices on the /9-4� day of November, 1928,
and :completed the posting thereof on the /a 2L4 day of November,
1928, more than ten (10) days before the date set for hearing
protests or objections to the proposed work and improvement or
the extent of the district to be assessed, all as appears from
the affidavit of said w 2 vL , assistant
Street Superintendent of the City of Newport Beach, filed in the
office of the clerk of said City on the 13d- day of November, 1
and now on file therein; and
WHEREAS, the City Council of said City of Newport
Beach was duly and regularly in session at the Council Chamber
thereof at the hour of 7;30 o'clock P. if., on Monday, the 26th
day of November, 1928, being the time, hour and place named in
the Resolution of Intention and Notice of Improvement, when and
where any and all.persons having any objections to the proposed
work andimprovement or against the extent of the district to be
assessed for such work and improvement, may appear before the
City Council and show cause why said proposed work and improvem
should not be carried out in accordance with said Resolution
of Intention No. 1-172 ; and
WHEREAS, all protests or objections presented
having been disposed of, overruled and denied, in time, manner
and form as required by law, and the City Council of said
City of Newport Beach having acquired jurisdiction to order the
proposed. Work done and improvement,made;
IT IS HEREBY RESOLVED by the City Council of
the City of Newport Beach that the public interest and convenienc
requires the work done and improvement made particularly set fort
and described in Resolution of intention No., whioh`.is
dated the 5th day of November, 1928, on file in the office of

as particularly set forth and described in said Resolution of
Intention as aforesaid.
That the expense of said work and improvement is
by said Resolution ofI ntention made chargeable upon a district
which said district is described in and by the said Resolution of
Intention and is shown by a plat or map thereof on file in the
office of the City Engineer of said City and said plat or map
for the showing the extent of said district is hereby made a
part hereof.
The Clerk of the City of Newport Beach is hereby
directed to post a notice of said work, together with the
specifications therefor, conspicuously for five (5) days on or
near the Council Chamber door of said City Council , inviting
sealed proposals or bids for doing the work ordered. He is also
directed to publish twice a notice inviting such proposals and
referring to the specifications posted or on file in the Newport
News, a weekly newspaper published and circulated in the City of
Newport Beach and hereby designated for that purpose.
I hereby certify that the foregoing Resolution
Ordering Work was duly and regularly introduced, passed and
adopted by the City Council of the City of Newport Beach, at
a regular meeting of said City Council held on the 26th day of
November, 1928, by the following vote.
