3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEAOH, AWARDING THE CONTRACT FOR THE ERECTION
4 AND CONSTRUCTION OF A LIBRARY BUILDING IN THE CITY
PARK.

WHEREAS, the City Council of the City of Newport

Beach did in open session, at a regular meeting thereof held
8
9 on the lot day of April, 1929, publicly open and examine all
10 sealed proposals or bids for doing the work called for in that
11 certain Notice Inviting Bids, heretofore published, which said
12 notice was given pursuant to Resolution of the City Council
13
of the City of Newport Beach; and

14 WHEREAS, all sealed proposals or bids for the
15 doing of said work heretofore mentioned, were referred to a
committee of three (3) , composed of City

of the City of Newport Beach, H. L. Sherman, member
17
18 of the Library Committee and Roland Thompson, City Attorney of
the City of Newport Beach, for their report, consideration and
19
20 recommendation, which report and recommendation of said
21 committee was to be given at an adjourned regular meeting of
22 said City Council held on the 2nd day of April, 1929, at the
23 hour of 7:30 otclock P. M., and
24 WHEREAS, the recommendation of said committee
26 was and is that Nead Construction Company was the lowest
26 regular responsible bidder for the doing of said work and the
27 furnishing of said materials, and that the contract for the
28 doing of said work and the furnishing of said materials should
29 be given to said Nead Construction Company, at the price quoted
30 in their bid, to-wit , the sum of $4917.00.

NOW, THEREFORE, the City Council of the City of
Newport Beach do resolve`, as follows-
Section 1. That this Council hereby finds and
declares that Need Construction Company is the lowest regular
responsible bidder for the work hereinbefore described and this
Council hereby awards the contract fo4said work to Head
Construction Company, at the price bid, to —wit, the sum of
$4917.00.
Section 2. The work to be done and materials to
be furnished in the erection, construction and completion of
said library building is all set forth in the plans and
specifications herein on file, reference being made thereto for
further particulars, and the same is by such reference made a
part hereof.
Section 3. That the successful bidder, to—wit,
Head Construction Company, enter into a contract with the
City of Newport Beach, within gays from date hereof,
for the performance of the work and furnishing of materials
in accordance with its bid herein on file and the Notice
Inviting Bids, and the Plans and Specifications herein on file,
and that said contractor furnish a bond for labor and materials
in the amount of fifty per cent (50�) of the contract price,
and also furnish a bond for the faithful performance of said
work in the amount of twenty -five per cent (250) of the contract
price, which said bonds shall be in the form required by law and
shall be r.pproved by the City Council of the City of Newport
Beach.

Need Construction Company, to enter into a contract with the
said City of Newport Beach, for the performance of said work
and the furnishing of said materials, and the furnishing of

good and sufficient bonds as aforesaid, in the amounts as
aforesaid, within the time specified, shall forfeit all right
to said contract work and the money deposited by it at the time
of its bid shall become the money of said City of Newport Beach,
and be forfeited by said bidder, Nead Construction Company.
I hereby certify that the foregoing Resolution
was regularly introduced and passed by the City Council of the
City of Newport Beach at a regular meeting thereof held on the
2nd day of April, 1929, by the following vote, to —wit:
