A:RNS07,UMON OF THE CITY COUNCIL OF THE CITY
OF NEWPORT.BEACH DECLARING VACANT FOR PUBLIC
STREET PURPOSES, A CERTAIN PORTION OF BAY
AVENUE YJITHIN SAID CITY.
WHEREAS, The Cite Council of the. City of Newport
Beach, on the 15th day of Jule, 1929,.at a regular meeting
of. said City Council held on that date, duly passed and
adopted a Resolution being Resolution No. 521 entitled,
"A Resolution of the City Council of the City ihf Newport
Beach declaring their intention to vacate , close up and
abandon for Public Street Purposes, a certain portion of Bay
,Avenue within said City ", and
WHEREAS, The Street Superintendent of the City of
Newport Beach after the pasnge of said Resolution caused to be -{
conspicuously posted along the line of said contemplated improve-
ment at not more than three hundred (500) feet in distance apart
upon said avenue, and not less than three (3) in all upon said
avenue, notices of the passage of said resolution, said notice
being headed, "Notice of Public Work ", in letters not less than
one inch in length and stating the fact of the passage of said
Resolution; its date, and briefly the work of improvement pro -
posed, being that of vacating the above named avenue, as here-
inafter described; and the said notice herein mentioned referred
to said Resolution for further particulars.; said Street Super-
intendent havinE; also caused a notice similar to that herein—
before referred to to be published by four (4) successive in-
sertions in the Newport Bews, a weekly newspaper printed, published
and circulated in said-City of Newport Beach (there being no
daily' newspaper so printed, published and circulated in said
City), and more than ten (10) days after the expiration of the
time of publication of said notice having elapsed and no ob-
jections to the said i,tprovcnent have been delivered to the
City Clerk of.the City of Newport Beach, and the said Board of
Trustees having acquired jurisdiction to order the vacation of
said avenue, as hereinafter described.
THEREFORE, The City Council of the City of Newport
Beach do ordain as follows:
SECTION 1.
That that portion of the public avenue hereinafter
described within said City be closed up, vacated and abandoned
for public street purposes; that the public interest and con-
venience require said closin, up, vacating and abandoning; the
said portion of said avenue so closed up, vacated and abandoned
for public street purposes is described as follows, to —wit : —
All of that portion of Bay Avenue within the
City of Newport Beach shown upon the map of'
East Newport, recorded in Book 3, page 37, of,-,.'
Miscellaneous Plops, Records of Orange County, %,
California, lying between the northerly pro -
�-longation of the westerly line of 4th Street, ,
now known as 8th Street, and the northerly pro -'
longation of the westerly line of Block 6 of said
East Newport, excepting that part thereof here-
tofore abandoned by Resolution No. 189 of the
Board of Trustees, dated. June 5th, 1922.
Excepting the right is hereby reserved by the City
of Newport.Beach to maintain, operate, repair,'and.remove•thb
existing 16 inch diameter water pipe line, so long as the same
remains as now located, across and under a parcel of land five � `
(5) feet in width, and lying two and one —half (2J) feet on
both sides of and adjacent to the following described center
line, to —wit:—

Beginning at a point in the westerly line
of 9th Street, which point is 116.8 feet
measured northerly along the westerly line
of 9th Street from the northerly line of
Central avenue; running thence south 81057'20"
east 416.84 feet to an intersection with the
northerly prolongation of the westerly line of
8th Street, which point of intersection is
/ •/2 feet, measured northerly along the
northerly prolongation of the westerly line
of 8th Street from the westerly prolongation
of the center line of Bay Avenue east of
8th Street.
SECTION 11.
That the public work herein provided for is the
closing up of the avenue herein described in Section 1, and
it appearing to the City Council that there are no costs,
damages or expenses occasioned by or arising; out of said work,
and that no assessment is.necessary to pay thercosts, damages,
or expenses of said work, and that therefore no commissioners
shall be appointed to assess benefits and damages.
SECTION 111.
TheCCity Clerk shall certify to the passage of this
Resolution and shall cause the same to be published by one
insertion in the Newport News, a weekly newspaper printed,
published and circulated in said City, amd which is hereby de-
signated for that purpose.
