RESOLUTION AR LEASE OF CERTAIN REAL
PROPERTY OF THE CITY OF NEWPORT BEACH.
RESOLTIrioN N0. L5-,31,
MEREA3, it satisfactorily appearing to the City
Council of the City of Newport Beach that it would be for the
furtherance of Harbor and navigation of said City of Newport
Beach to lease the real property hereinafter described; and
WHEREAS, it is proposed by the Lessee that said
real property be used for the purpose of constructing a first
class warm water concrete plunge, bulkheads, docks and wharves
on said property and other properties owned by the Lessee] and
WHEREAS, it further likewise appearing that said
plunge, bulkheads, docks and wharves, will be a public conve
and in furtherance of harbor and navigation purposes in said

WHEREAS, an adequate and sufficient consideration
has been offered to the City of Newport Beach by The Balboa
Beach Amusement Co., a California corporation, for a lease on the
real property hereinafter described; and
WHEREAS, it further appearing that thelands
herein leased are tide lands, granted to the City of Newport
by the State of California.
NOW, THEREFORE, BE IT RE8OLVED: That it would
be for the benefit and in furtherance of Harbor and navigation
interests of the City of Newport Beaoh, that the following des-
cribed real property belongint to the City of Newport Beach and
aituated is the City of Newport B each , County of Orange, State of
Oalifornia, and more particularly described as follows, to -wit:

All tide lands lying bet o en the southwesterly
line of Block "C" of the Balboa Tract, as laid
out and shown upon a map thereof, recordei in
Book 4, page 11 of miscellaneous maps, Records
of Orange County, California, and a line _oara-
llel to and 150 feet measured normal thereto,
southwesterly of the southwesterly line of Surf
Avenue as Surf Avenue is laid out.and shown upon
said Map of the Balboa Tract and between the
southwesterly prolongation of the southeasterly
line of Palm Street and the southwesterly prolong -
atio- of the northwesterly line of Washington
Street, as said Palw Street and Washington Street
are laid out and shown upon said Diap of Balboa
Tract; also all tide lands lying between the
southwesterly line of Block "B" of said Balboa
Tract and a line parallel to and 150 feet measured
normal thereto, southwesterly of the southwesterly
line of Surf Avenue, as Surf Avenue is laid out
and shown upon said 1,1ap of the Balboa Tract, and
lying between the southwesterly prolongation of the
northwesterly line of Lot 15 of Block 6 of said
Balboa Tract and the northwesterly line of Palm
Street as Palm Street is laid out and shown un_on

be leased for the sum of 5.00 per year to the Balboa Beach
Amusement Co., a California Corporation, of Newport Beach, Calif.
upon payment of the first year's rental, to wit, the sum of `6.00,
and that a good and sufficient lease be executed and delivered to
the Balboa Beach Amusement Company, a California corporation, by
thetiayor of the City of Newport Be<.ch, and the City Clerk of said
City respectively, leasing all of the right, title, and interest
of said City of Newport Beach in said real property, for the term
specified in the lease attached hereto, to-wit: Twenty -five (25)
years, and upon the conditions and ,,}venants in said lease con-
tained and set forth.
BE IT FURTHER RESOLVED that said Balboa Beach Amusenmt
Company, a California Corporation, be given immediate possession of
said demised premises; and
BE IT FURTHER RESOLVED that by the granting of said
lease, the use of the lands heretofore described by the Lessee
will not interfere with or prevent convenient access by the public
to the waters of the Pacific Ocean, and said demised lands shall
be used by Lessee only in conformity with the Act granting said
lands to the City of Newport Beach.
I hereby certify that the foregoing Resolution was
duly and regularly passed by the City Council of the City of
Newport Beach at a regular meeting thereof, held on the 23rd day
of September, 1929, by the following vote, to -wit:
