IN THE MATTER OF ACQUISITION
AND IMPROVEMENT DISTRICT
NO.1 OF THE CITY OF NEWPORT BEACH
RESOLUTION OF INTENTION
NO. 622
BE IT RESOLVED, By the City Council of the City of
Newport Beach, as follows:
Section 1. That the public interest and necessity require,
and that it is the intention of the City Council of the City of
Newport Beach, to order the following acquisitions for the pur-
pose of widening and /or extending and. /or opening and /or acquiring
of that certain alley or street known as Seashore Drive, to wit:
First: The widening of Seashore.Drive between 36th Street
and 37th Street, by the acquisition of a strip of land twenty (20)
feet.-�ride on the Northerly side of said street, and the extending
of said Seashore Drive from 37th Street to 56th Street in said
City, and the opening of Seashore Drive and the acquiring of a
twenty (20) foot strip of land therefor extending from 37th Street
to 56th Street in said City, and the widening of Seashore Drive
between 56th Street and-Orange Avenue, by the acquisition of a
strip of land twenty (20) feet wide on the Northerly side of
said street, and the widening of Seashore Drive between Orange
Avenue and the Westerly boundary line of said City by the
acquisition of a strip of land ten (10) feet wide on the Northerly
side of said street.
Second: That the property necessary to be taken for such
widening, extending, opening and acquiring includes all those
parcels of land situate in the City of Newport Beach, County of
Orange, State of California, described as follows, to wit:

Beginning at a point in the westerly boundary of the
City of Newport Beach, said point being the point of inter-
section of the northeasterly prolongation of the northwest-
erly line of Block "N" as laid out and shown upon the Map
of the Seashore Colony Tract, recorded in Book 7, page 25
of Miscellaneous Maps, Records of Orange County, California,
and the southwesterly boundary line of the Pacific Electric
Railway Company's right of way as laid out and shown upon
said map; thence, southeasterly along said southwesterly boun-
dary of the Pacific Electric Railway Company's right of way,
as laid out and shown upon said map and as laid out and show
upon the Map of Ocean Front Tract recorded in Book 4, page
12, Miscellaneous Maps, Records of Orange County, California
and as laid out and shown upon the map of Third Addition to
Newport Beach, recorded in Book 3, page 31, Miscellaneous
Maps, Records of above mentioned County and State, and as
laid out and shown upon the Map of Newport Beach, recorded
in Book 3, page 26, Miscellaneous Maps, Records of said County
and State, to a point, said point being the point of inter-
section of the northeasterly prolongation of the north-
westerly line of 36th Street, as laid out and shown upon
said Map of Newport Beach, and the said southwesterly
boundary of the Pacific Electric Railway Company's right of
way; thence northeasterly along last mentioned northeasterly
prolongation a distance of 20.02 feet to a point; saidpoint
being the point of intersection of said northeasterly pro-
longation and a linet20 feet distant from and parallel to
said southwesterly boundary of the Pacific Electric Railway
Company's right of way; thence northwesterly along said
parallel line to its intersection with the northeasterly
prolongation of the northwesterly line of Orange Street, as
laid out and shown upon said Map of Seashore Colony Tract;
thence southwesterly along said northeasterly prolongation
a distance of 10 feet; thence northwesterly along aline
10 feet distant from and parallel to said southwesterly
boundary to its intersection wit-hi the northeasterly pro-
longation of the northwesterly line of Block "N °, as laid
out and shown upon said map of Seashore Colony Tract; thence
southwesterly along the last mentioned northeasterly pro-
longation a distance of 10 feet to the point of beginning.
Reference is hereby made to the specifications for said
acquisitions approved by the City Council of the City of Newport
Beach and on file in the office of the Clerk of said City of
Newport Beach for all details and for the estimated expense of laic
acquisition.
Section 2. That the district of lands which will be
benefited by such proposed acquisitions, to 'be known as the
"Assessment DistrictIl, shall, as proposed, include all that territc
in the City of Newport Beach within the following described exteric
boundary lines, to -wit:

Beginning at a point, said point being the most
easterly corner of Lot 1, Block 36, as laid out and shown
upon a map of Newport Beach, recorded in Book 3, page 26
of Miscellaneous Pups, records of Orange County, California;
thence in a straight line in a southwesterly direction to the
most southerly corlher of said Lot 1; thence in a straight
line in a northwesterly direction to the most westerly corner
of Lot 6, Block 44, as laid out and shown upon a map of
Third Addition to Newport Beach, recorded in Book 3, page 31
of Miscellaneous Maps, Records of said County and State;
thence in a straight line in a northwesterly direction to the
most westerly corner of Lot 6, Block 53, as laid out and show
upon a map of Ocean Front Tract, recorded in Book 4, page 12,
of Miscellaneous Maps, Records of said County and State;
thence in.a straight line, in a northwesterly direction to
the most westerly corner of Lot 6, Block 56 of said Ocean
Front Tract; thence in a straight line, in a northwesterly
direction to the most southerly corner of Lot 1, Block "A"
as laid out and shown upon a map of Seashore Colony Tract,
as recorded in Book 7, page 25 of Miscellaneous Maps,
Records of said County and State; thence in a straight line
ina northwesterly direction, to the most westerly corner
d?f Lot 4, Block "N" of said Seashore Colony Tract; thence
along the northwesterly line of said Block "N" and along
the northeasterly prolongation of said northwesterly line
to a point, said point being the point of intersection of
last mentioned northeasterly prolongation with the north-
easterly boundary of the Pacific Electric Railway Companyls
right of way; thence southeasterly along said northeasterly
boundary of the Pacific Electric Railway Company's right of
way to its intersection with the northeasterly prolongation
of the southeasterly line of Block 36 as laid out and shown
upon aforementioned map of Newport Beach; thence southwesterl
along last mentioned northeasterly prolongation to the point
of beginning.
Reference is herebymade to the map of said assessment
district approved by the City Council of the City of Newport Beach
and on file in the office of the Clerk of said City of Newport
Beach, which indicates, by boundary line, the extent of the
territory to be included in said proposed assessmeqt district and
which said map shall govern for all details as to the extent there.

Section 3. That to defray the.expenses of the things
11proposed to be done, as above set forth, bonds will be
issued to the total amount of the same, said bonds to
bear interest at the rate of seven per cent (7%) per annum,
payable semi - annually, the first interest payment to be made

on the 2nd day of January or the 2nd day of July (whichever
month first succeeds the date of the bonds) next succeeding one
year after the date of such bonds, the aggregate principal of all
bonds issued to be paid and discharged within fifteen (15) years
after the date of issuance, approximately one — thirteenth (1 /13th)
part of said aggregate principal to be payable annually. The
first payment on the aggregat,e� principal of the bonds issued
will be made three (3) years after date of issuance thereof.
That a special fund for the payment of said bonds will be
constituted by the levy of special- assessment taxes upon the
lands within the assessment district accotding to the assessed
value of said lands (exclusive of the improvements thereon).
The first payment on the aggregate principal of the bonds issued
will be made three (3) years after the issuance thereof.
Section 4, THAT MONDAY, THE `Wth DAY OF OCTOBER, 1930,
AT THE HOUR OF 7:30 O'CLOCK P. M. OF SAID DAY, IS THE DAY AND
HOUR, AND THE CHAMBERS OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, IN THE CITY HALL IN THE CITY OF NEWPORT BEACH,
IS THE PLACE HEREBY FIRED BY SAID CITY COUNCIL OF SAID CITY OF
NEWPORT BEACH WHEN AND WHERE.ANY AND ALL PERSONS HAVING ANY
OBJECTIONS TO THE PROPOSED ACQUISITIONS, TO THE EXTENT OF
THE ASSESSMENT DISTRICT, TO THE ZONES INTO WHICH SAIPDISTRIOT
18 70 BE DIVIDED, OR TO THE PERCENTAGES TO BE RAISED FROM EACH
OF SAID ZONES, OR TO ANY OR ALL OF THE FOREGOING, MAY APPEAR
BEFORE SAID CITY COUNCIL OF THE CITY OF NEWPORT BEACH AND BE
HEARD. ATTENTION IS HEREBY DIRECTED TO THE PROVISIONS OF
THE "ACQUISITION AND IMPROVEMENT ACT OF 1925", RELATIVE TO
OBJECTIONS AND PROTESTS.
Section 5. That the proceedings.for said acquisition
shall be had and taken under and in accordance with

an Act of the Legislature of the State of California known
and designated as the "Acquisition and Improvement Act of
19259, approved May 23, 1925, and said bonds shall also be
issued in accordance with the provisions of said Act.
Section 6. That. R. L. Patterson, a public
officer, to -wit: the City Engineer of the City of Newport
Beach, is hereby appointed ('Superintendent of Work" 2 without
compensation, and he is hereby ordered to cause to be con-
spicuously posted, in the form and manner provided in said
Act, notice of the adoption of this resolution, which said
notice shall consist of printed copies of this resolution,
entitled t'Notice of Public Improvements'.
Section 7. That the clerk of the City Council
of the City of Newport Beach shall certify to the adoption
of this resolution and shall cause the same to be published
by three insertions, the date of the first publication to be
not_ lessthan fifteen (15) days before the date fixed herein
for the hearing, in the Newport News, a weekly newspaper
published and circulated and printed in the City of Newport
Beach, which said newspaper is hereby designated for that
purpose and for making all other publications in or incident
to these proceedings.
I hereby certify that the foregoing resolution
was adopted by the City Council of the City of Newport Beach
at a regular meeting.held on the /Sd day of September, 1930,
by the following vote of the members thereof:
