RESOLUTION NO. G 3
IN THE MATTER OF ACQUISITION AND IMPROVEMENT
DISTRICT NO. 1 OF THE CITY OF NEWPORT BEACH.
RESOLUTION ORDERING ACQUISITION AND IMPROVEMENT
WHEREAS, at the time, place and in the manner set forth
in the resolution of intention adopted by this City Council
on the 15th day of September, 1930, in the Matter of Acquisition
and Improvement District No. 1 of the City of Newport Beach, a
full, fair and impartial hearing was accorded all persons having
any objections to those things proposed to be done, as set forth
in said resolution; and
WHEREAS, this City Council has adopted its resolution
passing upon all protests presented, both written and oral, and
has made its determination as to the extent of the assessment
district; and
WHEREAS, evidence has been received as to the publication
of said resolution of intention and the posting of the notice of
public improvement therein ordered posted, at the time and in
the manner prescribed by law, and as to the necessity for the
{ acquisitions and improvements contemplated, and the benefits to
be.derived therefrom; .
NUW, THEREFORE, IT BE RESOLVED, by the City Council of
the City of Newport Beach that it is hereby found, determined
(land ordered as follows:
1. That the said resolution of intention heretofore
Iladopted on the 15th day of September, 1930, has been duly and
Illegally published as required by law, and that the notice of

public improvement therein directed to be posted has been duly
and legally posted in the time, form, manner and number as
required by law, and that all protests or objections presented
have been disposed of in time, form and manner as required by
law, and that this legislative body has now acquired jurisdiction
to order the things proposed to be done as set forth in said
resolution of intention.
2. That the public interest and necessity require and it
is hereby ordered that the following acquisitions for the purpose
of widening and /or extending and /or opening and /or acquiring of
that certain alley or street known as Seashore Drive, be made,
to —wit: The widening of Seashore Drive between 36th Street and
37th Street by the acquisition of a strip of land 20 feet wide,
on the northerly side of said street and the extending of said
Seashore Drive from 37th Street to 56th Street in said city,
and the opening of Seashore Drive and the acquiring of a 20 foot
strip of land therefor extending from 37th Street to 56th Street
in said City, and the widening of Seashore Drive between 56th
Street and Orange Avenue, by the acquisition of a strip of land
20 feet wide on the northerly side of said street, and the
widening of Seashore Drive between Orange Avenue and the westerly
boundary line of said city by the acquisition of _a strip of land
10 feet wide on the northerly side of said street, all as set
forth and described in said resolution of intention adopted by
this City Council on the 15th day of Septemoer, 1930, and in the
specifications therein referred to, and that the property necessa:
to be taken for such acquisition and which is hereby ordered to
be acquired therefor is that described in section 1 of said
resolution of intention.
3. That the boundaries of the assessment district shall
be those set forth in the said resolution of intention and in the
specifications therein referred to, reference to which is hereby

4. That the City Attorney of the City of Newport Beach
is hereby ordered to bring an action in the name of the City of
Newport Beach, in the Superior Court of the State of California,
in and for the County of Orange, for the condemnation of the
property necessary to be taken for the acquisition herein ordered
and described in section 1 of said resolution of intention, and
to do all things necessary to prosecute said action to final
determination.
5. That the public interest and convenience require and
it is hereby ordered that. the City of Newport Beach, a municipal
corporation of the sixth class, plaintiff in the said condem-
nation action, take immediate possession and use of the property
herein ordered to be acquired, upon complying with the require-
ments of law applicable thereto, and that the said City Attorney
report to this City Council the amounts of money required there-
for, as soon as the same can be ascertained:

6. That to defray the expenses of the acquisitions Aordered
bonds will be issued to the total amount of the same, said bonds
to bear interest at the rate of seven per cent (7 %) per annum,
payable semi - annually, the first interest payments to be made
on the 2nd day of January, or the 2nd day of July; (whichever
month first succeeds the date of the bonds) next succeeding one
year after the date of such bonds, the aggregate principal of all
bonds issued.to.b8 paid- and discharged within fifteen (15) years
after the date of issuance, approximately one - thirteenth (1/13)
part of said aggregate principal to be payable annually. The
first payment on the aggregate principal of the bonds issued will
be made three (3) years after date of issuance thereof. A special
fund for the payment of said bonds will be constituted by the levy
of special assessment taxes upon the lands within the assessment
district, according to the assessed value of said lands,(exclusive

of the improvements thereon) as set forth in said resolution of
intention. The first payment on the aggregate principal of the
bonds issued will be made .three (3) years,after the issuance
thereof.
7. That the proceedings for said acquisition, work and
improvements shall be had and taken under and in accordance with
an act of the legislature of the State of California, known and
designated as the "Acquisition and Improvement Act of 192511,
approved, May 23, 1925, and said bonds shall also be issued in
accordance with the provisions of said act.
The above and foregoing Resolution was passed, adopted and
approved by the City Council of the City of Newport Beach, at
a regular meeting thereof held on the 20th day of October, 1930,
by the following vote, to —wit:
