RESOLUTION NO. 6'-/G,
WHEREAS, there has been presented to the City Council
of the City of Newport Beach, a certain agreement dated the
17th day of December, 1930, by and between the Southern
Pacific Railroad Company, a corporation, and its Lessee,
Southern Pacific Company, a corporation, first parties, and
in said agreement collectively called "Licensor ", and the City
of Newport Beach, a municipal corporation of the State of
California, party of the second part, and in said agreement
designated "Licensee "; and
WHEREAS, the Licensor, in consideration of the
faithful performance by Licensee, of all of said agreements,
conditions and covenants therein contained, grants to Licensee
the right to re— construct , construct , maintain and use one (1)
twelve ince (129) sanitary sewer, in said agreement termed
"structure", said structure, to be constructed beneath the
property and tracks of Licensor at a depth specified by
Licensor, in the location more particularly described as
follows, to —wit:
All that certain piece or parcel of land situate,
lying and being in the City of Newport Beach, County
of Orange, State of California, and more particularly
described as follows, to —wit:
A strip of land 6.0 feet in width across the right
of way (100 feet wide) of the Southern Pacific Rail-
road Company's Newport Branch in the City of Newport
Beach, County of Orange, State of California, lying
3.0 feet on each side of a line that is parallel with
and distant northerly 7.0 feet from the northerly
line of that certain 80 foot right of way granted
to the State of California by the Southern Pacific
Railroad Company and Southern Pacific Company by
agreement dated August 16, 1926, and recorded in
Book 681, page 382, of Deeds, Records of said County,
said 6.0 foot strip of land being shown tinted red
on blueprint map of Los Angeles Division Drawing
A-728, Sheet No. 1, dated November 4, 1930, attached
hereto and made a past hereof.

NOW, THEREFORE, BE IT RESOLVED: That said agreement
be approved as written and that the City of Newport Beach sign
the same by its Mayor and by its City Clerk, in triplicate,
and that their signatures be acknowledged before a Notary
Public, and that said agreement in triplicate, upon their,
execution, by the City of Newport Beach as aforesaid, be sent
forthwith to the Southern Pacific Company, at Los Angeles,
California, for the signature of the Licensor.
I hereby certify that the foregoing Resolution was
duly and regularly passed by the City Council of the City of
Newport Beach at a special meeting thereof, held on the 17th
day of December, 1930, by the following vote, to —wit:
