HomeMy WebLinkAbout647 - Acquisition & Improvement District 2IN THE KATTER OF ACQUISITION AND ) 7 IMPROVEMEENT DISTRICT NO. 2 OF THE ) RESOLUTION NO. k/ CITY OF NEWPORT BEACH, CALIFORNIA. ) RESOLUTION ORDERING ACQUISITIONS WHEREAS, the City Council of the City of Newport Beach, California, did on the lat day of December, 19300 adopt its Resolution of Intention, being Resolution No. 644, in the matter of Acquisition and Improvement District No. 2, which said district is entirely within the•City of Newport Beach, wherein and whereby it.was determined that the public interest, convenience and necessity required and that it was the intention to order certain acquisitions set forth specifically in said Resolution of Intention, all of which is more particularly described in the said Resolution of Intention, said acquisitions to be made under and in pursuance of the provisions of the "Acquisition and Improvement Act of 1925 ", as amended, and WHEREAS, this City Council has' in conclusion of the hearing had 1931, and as a determination of all questions arising thereat, by resolution duly adopted and which it will enter upon its minutes, declared its findings that the owners of more than one -half of the area of the prop- erty included within the assessment district have not made written objections going to the entirety of the things proposed to be done, and also in the said resolution has determined the extent and boundaries of the assessment district, and that all of the aforesaid shall be as they are more fully set forth in the said Resolution of Intention and in the maps and specifica- tions referred to in said Resolution of Intention, to which last mentioned resolution reference is hereby made for all particulars, and 1 • WHEREAS, at the meeting of this City Council, to -wits r on the f_�5 day of r�G > ✓� ' 1931, this City Council did make its final determination respecting the abovementioned matter by its resolution hereinabove mentioned and hereby re- ferred to; NOW, THEREFORE, the City Council of the City of New- port Beach, does hereby order the doing of the things proposed to be done in the aforesaid Resolution of Intention and in the manner set forth in said Resolution of Intention and in the maps and specifications and the plat or map of the assessment district referred to in said Resolution of Intention, which said Resolution of Intention and maps, specifications and map of the assessment district are hereby referred to for a description of the ac- quisitions and the exterior boundaries of the assessment dis- trict, and Also, that the public interest, convenience and necessity require and the said City Council does hereby order that the acquisitions referred to in the said Resolution of Intention in the matter of Acquisition and Improvement District No. 2 and as shown and described in the specifications therefor now on file in the office of the City Clerk of the City of Newport Beach, be made, and that the property necessary to be acquired is set forth in the.said Resolution of Intention, to which said Resolution of Intention and to the maps and specifications referred to therein reference is hereby made for a description of the said property so to be acquired; and The City Council of the City of Newport Beach does hereby order that ARTHUR M. ELLIS, an Attorney at Law, bring an action in the name of the City of Newport Beach in the Superior Court of the State of California,.in and for the County of Orange, E • for the condemnation of the property necessary and convenient to be taken for the acquisitions herein ordered and to do all things necessary to prosecute said action to final determination.
