RESOLUTION NO.
WHEREAS, the City Council of the City of Newport
Beach did by written advertisement, offer for sale to the highest
and vest bidder for. cash, certain real property belonging to said
City, and in said written advertisement more particularly.des -
cribed, and upon the terms and conditions set forth in said
written advertisement, a copy of which is attached hereto, marked
exhibit "A" and made a part hereof; and
WHEREAS,all bids were rejected at a regular meeting
of the City Council held at the City Hall in the City of Newport
Beach, on Monday, the 5th day of February, 1934, at the hour of
7:30 o'clock P. M., except the bids of Harvey D. Pease, W. E.
Lawrence and R. E. Woods; and
WHEREAS, said bids were rejected for the reason that
in. the opinion of the City Council of the city of Newport Beach
the amounts offered were inadequate and disproportionate to the
fair market value of the properties heretofore mentioned; and
WHEREAS, the bidsof said Harvey D. Pease, W. E.
Lawrence and R. E.Woods are in all respects made in accordance
with the offer of saidCity of Newport Beach aforesaid, and it is
fair and adequate, and the amount thereof constitutes a fair
consideration for the property,hereinafter more particularly
described; and
WHEREAS, said Harvey D. Pease bid the sum of $ 230.00
for Lot 8 in Block 12, Section 3, Balboa Island, in the City of
Newport Beach, Orange County, California; and
WHEREAS, said W. E. Lawrence bid the sum of $226.00
for Lot 15 in Block 6, Section 3, Balboa Island, in the City of
Newport Beach, Orange County, California; and

WHEREAS, R.E. Woods bid the sum of $176.00
for Lot 8 in Block Nine, Section 2, Balboa Island, in the City
of Newport Beach, Orange County, California.
NOW, THEREFORE, BE IT RESOLVED: That the City of
Newport Beach sell to said Harvey D. Pease, the said property
hereinabove described, for the sum of $230.00; and
BE IT FURTHER RESOLVED: That the City of Newport
,Peach sell to said W. E. Lawrence, the said property hereinabove
described, for the sum of $226.00; and
BE IT FURTHER RESOLVED! That the City of Newport
Beach sell to said R. E. Woods, the said property hereinabove
described, for which said R. E. Woods bid the sum of $176.00; and
BE IT FURTHER RESOLVED: That the said Harvey D. Pease,
W. E. Lawrence and R. E. Woods pay for deeds to said respective
properties as well as Certificates of Title thereto, should they
desire the same, and that they pay all other expenses and costs
of every nautre, description or.kind in connection with the tran
fer of said respective properties.
BE IT FURTHER RESOLVED: That upon payment to the
City of Newport Beach of the balance of said purchase price of
$230.00, to -wit, the sum of $190.00, the sum of $40.00 having
already been paid on account of said property purchased by the
said Harvey D. Pease, that the City of Newport Beach execute a
deed to said property to the said Harvey D. Pease.
BE IT FURTHER RESOLVED: That upon payment to the
Oity of Newport Beach of the balance of said purchase price of
$226.00, to -wit, the sum of $198.40, the sum of $27.60 having
already been paid on account of said property purchase& by the
said W. E. Lawrence,.that the City of Newport Beach execute a
deed to said property to the said W. E. Lawrence;
BE IT FURTHER RESOLVED: That upon payment to the
City of Newport Beach of the balance of said purchase price of

J176.00 , to -wit, the sum of $ 158.00 , the sum of $ 18.00 having
already been paid on accoimt of said property purchased by the
said R. E. Woods, that the City of Newport Beach execute a deed
to said property to the said R. E. Woods.
BE IT FURTHER RESOLVED: That the Mayor and City
Clerk of the City of Newport Beach be authorized and instructed
to execute and deliver a deed to said properties to the said
Harvey D. Pease, W. E. Lawrence and R. E. Woods, respectively,
on behalf of the City of Newport Beach, upon the payment by the
said Harvey D. Pease of the balance due from him, to writ, the
sum of $190.00 , and upon the payment by the said W. E. Lawrence
of the balance due from him, to -wit, the sum of $ 198.40 and
upon the payment by the said R. E. Woods of the balance due from
him, to -wit, the sum of $ 158.00 .
I hereby certify that the above and foregoing
Resolution was duly and regularly passed andadopted by the
City Council of the City of Newport Beach at a regular meeting
thereof held on the 5th day of February, 1934, by the following
vote, to -wit:

NOTICE
NOTICE IS HEREBY GIVEN: That in pursuance of a
Resolution of the City Council of the City of Newport Beach made
on the let day of January, 1934, which Resolution.is on file in
the office of the City Clerk of the City of Newport Beach, and
known and numbered Resolution No. 808, of said City, the under-
signed, City of Newport Beach will sell at private sale in
separate parcels to the highest bidder for cash, for each parcel
of land hereinafter described, on or after the 4th day of
January, 1934, and.up to the hour of seven o +clock P. M. on the
5th day of February, 1934, all the right, title and interest of
said City in said property hereinafter described, and upon the
terms and conditions hereinafter specified.
Said property is described as follows:

TERMS AND CONDITIONS OF SALE: Cash, lawful money of
the United States, 10% of the purchase price to accompany the
bids and balance to be paid within five (5) days from and after
the acceptance of said bid by the City Council of the City of
Newport Beach. Deed and Certificate of Title at the expense of
the purchaser, title to be clear and free of all encumbrances
of every nature, description or kind, as shown by that certain
Policy of Title Insurance issued by the Abstract and Title
Insurance Company of Santa Ana, California, and designated
No. 92384, which said Policy of Title Insurance is on file with
the Clerk of the City of Newport Beach, and the same is by
reference thereto made a part hereof.
All taxes and assessments on said property have been
paid up to and including the fiscal year 1932 -1933, and the pur-
chaser of said property shall assume the taxes and assessments
for the fiscal year 1933 -1934, and all taxes and assessments
subsequent thereto.
BIDS; All bids or offers must be in writing, enclosed
in a sealed envelope, addressed to the City Council of the City
of Newport Beach, which said bids shall be accompanied by a certi-
fied check for 10% of the amount thereof, and shall be left at th1
office of the City Clerk of the City of Newport Beach, City Hall,
Newport Beach, California, on or before the hour of seven o'clock,
P. M. on Monday, the.5th day of February, 1934.
The undersigned reserves the right to reject any and a:
bids, and upon any such rejection, the money accompanying said bit
will be returned.
