RESOLUTION NO. �'u—
WHEREAS, the water supply of the city of Newport Beach
has become contaminated and is no longer fit for human use; and
WHEREAS, the City of Newport Beach is now obtaining its
domestic water supply from outside sources, and such outside
sources may and have the right at any time to cease furnishing
water for said city; and
WHEREAS, the City of Newport Beach has developed water in
sufficient quantities to supply said city, on land owned by said
city, and being that certain tract of land containing ninety -three
.(93) acres and located on the southeast corner of Adams and Wright
Street in Orange County, California, and being in the Northwest
quarter of Section 8, Township 6 South, Range 10 West, S. B. B.&
and
WHEREAS, the City of Newport Beach has no means of using
said water at the present time and said crater can only be used
by the laying of pipe lines and the acquiring of rights of way
and other equipment necessary to make said water available for
the use of the residents of the city of Newport Beach; and
WHEREAS, in the opinion of the city council of the City
of Newport Beach the need to obtain said water immediately for
the use of said city is necessary, and said City Council does not
have time to advertise for bids for the doing of the necessary
work, in order that said water may be brought into the City
and used by the.residents thereof; and
WHEREAS, it is further the opinion of the City Council
of the city of Newport Beach that the contamination of said
crater supply and the inability to contract definitely for a Crater
supply, constitutes and is a great public calamity and an
emergency exists by reason thereof.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the

City of Newport Bach that the public interest and necessity

demand the immediate expenditure of public money for the purposes
3
specified in this resolution, in order that life, health and
4
property in the city of Newport Beach may be safeguarded.

BE IT FURTHER RESOLVED: That the City Council of the City
6
of Newport Beach appropriate the sum of Sixteen Thousand Dollars
7
($16,000.00) for the following purposes, to —wit: The acquisition
8
and construction of approximately 9450 feet of eighteen inch cemen
9
pipe line, including the acquisition and construction of pumping
10
equipment, as well as the acquisition of rights of way and the
11
construction of all buildings necessary or convenient in conneotio
12
with said work.

BE IT FURTHER RESOLVED: That the City Council of the City
14
of Newport Beach does not have sufficient time to call for bids
15
for the doing of the work mentioned in the previous paragraph,
16
and that the public interest and necessity demand the immediate
17
expenditure of public money, for the acquisition and construction
18
of said work, in order to safeguard life, health and property in
19
the city of Newport Beach.

BE IT FURTHER RESOLVED: That said Sixteen Thousand
21
Dollars ($16,000.00) appropriated by said City out of the
22
ordinary annual income and revenue of said City, be used for the
23
purpose of paying for the necessary materials and labor to be
24
performed in the acquisition and construction of said water works,
25
including the acquisition of necessary rights of way, as well as
26
the construction of necessary buildings and machinery, for the
27
bringing of said water into the City of Newport Beach for the use
28
of the inhabitants thereof, all in accordance with the plans and
29
specifications heretofore approved by the City Council of the city
30
of Newport Beach, which plans and specifications are on file with
31
the City Engineer of the City of Newport Beach, and by reference
32
1 thereto are made a part hereof.

same are hereby approved as to form and contents, and it is
Ordered that the same be executed by the Mayor and City Clerk
Of said City of Newport Beach in the name of and on behalf of
said City.

was duly and regularly passed and adopted by the City Council of
