RESOLUTION NO. 77.x;.
WHEREAS, the present sewer disposal plant of the
City of Newport:Beaoh is insufficient to take care of the sewage
going through said plant and by reason thereof a certain amount
of raw sewage is being discharged into the waters of Newport Bay
in the city of Newport Beach, in Orange County, California; and
WHEREAS, by reason of the discharge of the raw sewage
into said Newport Bay, portions of said bay have been quarantined
by Dr. Sutherland, Health Officer of the County of Orange, and
also Health Officer of the City of Newport Beach; and
WHEREAS, said Newport.Bay and the whole thereof, is
being used by bathers and many hundreds of men, women and children
use said bay oonstantly.for swimming, diving and bathing and other
recreational purposes; and
WHEREAS, the said Dr. Sutherland, Health Officer
aforesaid, has duly notified the City Council of the danger to the
general public using said bay by reason.of the raw sewage of the
City of Newport Beach being discharged therein; and
WHEREAS, said Dr. Sutherland has further notified said
City to remedy the condition mentioned, in relation to the disohar
of raw sewage into said bay; and'
WHEREAS, in the opinion and "judgment of the City
Council of the city of Newport Beach, the need to remedy the
condition complained of by the Health Department aforesaid, is
imperative, and said City Council does not have time to advertise
for bids for the purchase of proper equipment and the installation
thereof, to.prevent the discharge of said raw sewage into said
Newport Bay; and
WHEREAS, it is further the opinion of the City Council.
of_ the City of Newport Beach that the oontamination of the waters

of Newport Bay by the discharge of raw sewage therein, constitutes,
and is a great public calamity and an emergency.exists by reason
thereof.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport'Beach that the public-interest and necessity
demand the immediate expenditure of public money for the purposes
specified in this Resolution, in.order thatlife, health and pro-
party in the city of Newport Beach may safeguarded.
BE IT FURTHER RESOLVED that the City Council of the
City of Newport Beach appropriate the sum of Eighteen Hundred
Dollars 01800.00), for the following purposes, to -wit: The
purchase of a sewage chlorinator, vacuum solution feed with a
capacity of not less than one hundred (100) pounds of chlorine
per day of twenty -four (24) hours.
BE IT FURTHER RESOLVED: That the City Council
of the City of Newport Beach does not have time to call for bids
for the purchase of said ohlorinator mentioned in the previous
paragrap# and that the public interest and necessity demand the
immediate expenditure of public money for the purchase of said
sewage chlorinator, in order.to safeguard life, health and
property in the city of Newport Beach,
BE IT FURTHER RESOLVED: that the said $1800000
appropriated by said city, be appropriated out of the ordinary
annual income and revenue of said City, and that the same be used
for the purpose of paying.for said chlorinator hereinbefore
mentioned, all in accordance with the recommendations and demand
of the Health Department of the-County of Orange and the City of
Newport Beach, and that the chlorinator to be purchased, be
purchased -in accordance with the specifications furnished by R. L.
Patterson, City Engineer of the city of Newport Beach, which
specifications are on file herein and by reference thereto, made
a part hereof.

BE IT FURTHER RESOLVED:_ That.the City Engineer, R. L.
Patterson, be, and he is hereby directed, authorized and instruct(
to immediately purchase such chlorinator, and that the same be
shipped to the City of Newport Beach and installed, as soon as
possible to do so,
BE IT FURTHER RESOLVED that the City Engineer of the
City of Newport Beach be, and he is hereby authorized, directed
and instructed to enter into the necessary contract or contracts
for the purchase of..said chlorinator and for the installation
thereof, and any and all contracts in relation to the purchase
of said chlorinator, may be executed on behalf of the City of
Newport Beach by the Mayor and City Clerk of the City of Newport
Beach, in the name of and on behalf of said city.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the City
Council of the city of Newport Beach at a regular meeting thereof
held on the 2nd day of Septembwr, 1935, by more than a four - fifths
vote, to -wit:
