WHEREAS, there has this day been presented to the
City Council of the City ofrNewport Beach a certain Agreement
for expenditure of 1/4 cent Gas Tax Funds upon streets of
major importance other than State Highways, during the fiscal
year ending June 30th, 1937, wherein the City of Newport Beach
is referred to as the City, and the Department of Public Works
of the State of California is referred to as the Department;
and
WHEREAS, said Agreement provides that in accordance
with provisions of Section 194 and Section 195 of the Streets
and Highways Code, the Department shall expend or cause to be
expended within the cities of this State from the State Highway
Fund an amount equal to the net revenue derived from 1/4 cent
per gallon of tax on motor vehicle fuel upon streets of major
importance other than State Highways, as are agreed upon by
the Department and the Legislative Body of the City in the
proportions that the total population of each city bears the
total population of all cities in this State; and
WHEREAS, said agreement further provides for the projects
and estimated expenditures therefor, as in said agreement listed
and set forth; and
WHEREAS, said agreement further provides for the Donstruc-
ton of said projects therein described; and
t,HEREAS, the City Council of the City of Newport Beach
deems that it is for the benefit and best interests of said City
that said agreement be entered into.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
Clerk of the City of Newport Beach be, and they are hereby
authorized and instructed to execute said Agreement ommbbehalf of
the City of Newport Beach, and that upon the execution of the
same, that the City Clerk return the original and one copy
thereof to the State.
I hereby certify that the above and foregoing Resolution
was duly and regula4 -y passed and adopted by the City Council
of the City of Newport Beach at a regular meeting thereof held
on the 3rd day of A ugu.st, 1936, by the following vote, to -wit:
