RESOLUTION NO. 1004

WHEREAS, there has this day been presented to the City
3
Council of the city of Newport Beach a certain agreement dated the
4
2nd day of November, 1936, wherein the City of Newport Beach is
5
referred to as the party of the first part, and C. H. Currie and
6
F. S. Currie are referred to as the parties of the second part;
7
and
8
WHEREAS, said agreement provides that the first party has
9
employed the second parties to prepare certain plans and speci-
10
fications in connection with a certain public improvement in the
11
city of Newport Beach, to -wit, the additions to the municipal
12
sewer system of the city of Newport Beach, and work incidental
13
thereto; and
14
WHEREAS, first party has found it necessary that said
15
plans and specifications be altered; and
16
WHEREAS, first party further desires that second parties
17
act in a consulting capacity with the City Engineer of the City
18
of Newport Beach in the erection and construction of the disposal
19
plant to be erected in connection with said public improvement;
20
and
21
WHEREAS, said agreement provides the compensation to be
22
paid second parties and also sets forth the terms and conditions
23
thereof; and
24
WHEREAS, it is deemed for the best interests of said
25
City of Newport Beach that said agreement be entered into, upon
26
the terms and conditions therein set forth.

NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
28
City Clerk of the City of Newport Beach be, and they are hereby
29
directed and authorized to execute said agreement in the name
30
of and on behalf of the city of Newport Beach.

I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council
of the City of Newport Beach at a xmgular meeting thereof held
on the 2nd day of November, 1936, by the following vote, to -wit:
AYES, COUNCILMEN: Gordon, Claire
Whitson, Garfield, Williamson
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None
