RESOLUTION NO. i o 12
WHEREAS, there has this day been presented
to the City Council of the City of Newport Beach a certain
agreement dated the let day of December, 1936, by and between
the City of Newport Beach, a Municipal corporation, in said
agreement referred to as the party of the first part, and the
Pacific Electric Railway Company, a corporation, therein
referred to as the party of the second part, or "Railway"; and
WHEREAS, said agreement provides that the Railway
owns and operates a line of railroad in the city of Newport
Beach, and that the first party contemplates widening Coast
Boulevard at 23rd Street and McFadden Place at the intersection
of Central Avenue, which will require certain easements over
certain parcels of the Pacific Electric Railway Company's
property; and
WHEREAS, said parties have reached an understanding
as to the matters hereinabove set forth, setting forth the
things to be done, which provisions are fully set forth in
said agreement; and
WHEREAS, the City Council of the City of Newport
Beach deems that it is for the best interests of said city that
said agreement be entered into.
NOW, THEREFORE, BE IT RESOLVED% That theMayor
and City Clerk of the City of Newport Beach be, and they are
hereby directed, instructed and authorized to execute said
agreement in the name of and on behalf of the City of Newport
Beach.
