RESOLUTION N04 gQ k?
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a certain Easement
dated the 9th day of January, 1937, by and between the Irvine
Company, a corporation, party of the first part, and the City
of Newport Beach, a Municipal corporation of the sixth class
of Orange County, California, the party of the second part; and
WHEREAS, said easement grants to the party of the
second part certain easements for sewer purposes only, across
certain property of the said party of the first part, in the
County of Orange, State of California, in said easement agreement
specifically described and set forth; and
WHEREAS, said easement agreement sets forth
the consideration and conditions upon which said easements
are given to the party of the second part; and
WHEREAS, the City Council of the City of Newport
Beach deems that it is for the best interests of said city
enter into said agreement with the Irvine Company.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor
and City Clerk of the city of Newport Beach be, and they are
hereby directed, instructed and authorized to execute said
Easement agreement in the name of and on behalf of the city of
Newport Beach, and that a duly executed copy thereof be delivered
to the party of the first part therein named.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
City Council at an adjourned regular meeting thereof held
on the 11th day of January, 1937, by the following vote`, to -wit:
