3 WHEREAS, a certain Deed - Highway Easement, dated the
4 day of , 1938, from the City of Newport Bea
5 a municipal corporation of the State of California, to the State
6 California, granting, conveying and dedicating to the State of
7 California the right of way and incidents thereto, for public
8 highway upon, over and across all that certain real property
9 situated in the City of Newport Beach, County of Orange, State of
10 California, and more particularly described as follows, to -wit:
11 All that portion of Lot 3 in Block "C" of Tract
12 No. 470, as per map recorded in Book 17, page 28
of Miscellaneous Maps, records of Orange County,
13 included within a strip of land 100 feet wide,
being 50 feet wide on each side of the following
14 described center line:
15 Beginning at the intersection of the Northeasterly
prolongation of the Northwesterly line of Lot 1 in
Block "A" of said Tract No. 470 with the center line
16 of Coast Boulevard as shown on said map of Tract No.
470; thence from said point of beginning, along
17 said center line as shown on said map, S. 500 22' E.,
18 a distance of 31.78 feet; thence leaving said center
line of Coast Boulevard, Southeasterly along a tangent
curve concave Southwesterly, and having a radius of
19 1600 feet, through an angle of 350 001 3011, an arc
20 distance of 977.62 feet, to the point of tangency of
said curve with a line parallel with and distant 10.00
21 feet, Easterly, measured at right angles from the center
line of Coast Boulevard, 80 feet wide, as said Coast
22 Boulevard is shown on map of Tract No. 323, recorded
in Book 14, pages 40 and 41 of Miscellaneous Maps,
23 Records of said Orange County; thence along said
parallel line, S. 150 21' 30" E., 192.75 to the inter -
24 section thereof with the Westerly prolongation of the
Southerly line of Lot 5 in Block "L" of said Tract No.
25 323.
26 EXCEPTING from said 100 foot strip of land that portion
of said Lot 3 described in deed to Ester Mack recorded
27 in Book 117, page 265 of Official Records of said Orange
County,
28 was resented to the City Council of the City of Newport wport Beach,
29 California; and
30 WHEREAS, the City Council of the city of Newport Beach
31 deems that it is for the best interests of said city that said
32 easement be granted upon the terms and conditions therein set for

and other valuable considerations, including the widening of
Highway No. 101 through that portion of the City of Newport
Beach known as Corona del Mar.
NON, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the city of Newport Beach be, and they are
hereby directed, authorized and instructed to execute said
Deed - Highway Easement, in the name of and on behalf of the
City of Newport Beach, and that the City Clerk deliver a duly
executed copy thereof to the State of California, Division of
Highways.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopt d by
City Council of the city of Newport Beachpp at a
regular meeting thereof held on the �m day of
1938, by the following vote, to -wit:
