WHEREAS, LEROY PITCHER and RUTH PITCHER, husband and
3 wife, have this day offered to the CITY OF NEWPORT BEACH, the
4 sum of 2 0.00 for Lot
� 5 33• Tract 948 in the City of Newport Beach

as shown on Map recorded in Book 30, page 7 of Miscellaneous Maps
6
records of Orange County, California; and
7
WHEREAS, the said price is a fair and adequate price
8
as and for the purchase price of said lot; and
9
WHEREAS, the City Council of the City of Newport Beach
10
deems that it is for the best interests of said City that said
11
property be sold for the said sum of $250.00; and
12
WHEREAS, the price offered is just, fair and adequate
13
and is not disproportionate to the real value of the property
14
above described.

NOW, THEREFORE, BE IT RESOLVED: That said property
16
be sold to the said Leroy Pitcher and Ruth Pitcher, husband and
17
wife, for the sum of $250.00, free and clear of all encumbrances,
18
subject to the taxes for the fiscal year 1939 -40, and unpaid
19
improvement assessments of record. Also subject to conditions,
20
restrictions and reservations of record. The Mayor and the City
21
Clerk are hereby authorized and directed to execute and deliver
22
a deed for said property to the said parties upon receipt
23
of the consideration above set forth.
24 BE IT FURTHER RESOLVED: That the sum of $25.00 beipaid
25 to L. W. Briggs, as and for his commission for the "negotiating
26 of the sale of said real property to Leroy Pitcher and Ruth
27 Pitcher, his wife, as joint tenants, said sum being a fair and
28 reasonable commission to be allowed in said sale, and said broker!
29 being a licensed realtor of the City of Newport Beach.

1 I hereby certify that the above and foregoing
2 Resolution was duly and regularly passed and adopted by the
3 City Council of the City of Newport Beach at an adjourned regular
4 meeting thereof held on the 25th day of February, 1939 by the
