RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DETERMINING THE

NATURE, LOCATION AND EXTENT OF THE PROPOSED
IMPROVEMENT FOR THE CONSTRUCTION OF CERTAIN

WHICH IT IS PROPOSED TO CONDUCT THE PROCEEDINGS
PURSUANT TO THE PROVISIONS OF SECTION 2 OF

"SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931 ".

WHEREAS, the City Council of the City of Newport Beach,
13
California, did, on the .: -d—ay of 1940, instruct the
14
City Engineer of said City to procure and prepare a written report,
15
pursuant to Sections 2 and 3 of the "Special Assessment Investigg-
16
ation, Limitation and Majority Protest Act of 1931 ", as amendeQr -1.
17
and thereafter said City Engineer presented to this City Council
18
on the 1_= day of 2O ✓� 111 1940, Plan No. 409 consisting
19
of twenty (20) sheets, showing the said improvement as proposed and
20
also a map of the proposed Assessment District, No. 410, for
21
consideration; and

WHEREAS,, pursuant to the provisions of Section 2 of the
23
"Special Assessment Investigation, Limitation and Majority Protest
24
Act of 1931 ", as amended, the City Council must, by resolution or
25
ordinance, determine in general the nature, location and extent
26
of the proposed improvement; also generally define the boundaries
27
or the extent of the district or lands to be specially assessed
. 28
to pay the cost thereof, or any part of such cost, and determine
29
the statute under which it is proposed to conduct the proposed
30
proceedings;

NOVI, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE .AS FOLLOWS:
