3 WHEREAS, application has been made to the City

Council of the
City of Newport
Beach by certain
interested
parties

for a license
or privilege for
the period of one
year,. to
load and
6 unload passengers and patrons going to and from the city owned
7 . pier extending into and over the waters of the Pacific Ocean,
8 located opposite McFadden Place, in the city of Newport Beach,
9 California; and
10 WHEREAS, in the winter time there are insufficient
11 live bait boats to take care of patrons and passengers, while in
12 the summer time there is.a superfluity of boats for said purpose;
13 and
14 WHEREAS, many irresponsible operators of boats
15 carry live bait patrons in the summer time, and the City of
16 Newport Beach has no regulation over said boats or the operators
17 or owners thereof; and
18 WHEREAS, the City Council of the City of Newport
19 Beach believes that it is for the best interests of the fishing
20 public and for the common benefit of the public, and as a police
21 regulation, to grant to one person the exclusive privilege of
using said pier for the loading and unloading of passengers to
22
23 and from live bait boats; and
WHEREAS, the City Council of the city of Newport
24
Beach further believes that it is for the best interests of the
25
26 City of Newport Beach and for the common benefit of the public
generally that the privilege and license herein mentioned be
27
given to the highest, best and most responsible bidder, pursuant
28
29 to notice inviting bids duly made and given.
30 NOW, THEREFORE, BE IT RESOLVED: That the City
Clerk of the city of Newport Beach be authorized and directed to
31
give Notice Inviting Bids for the privilege and license herein

4 BE IT FURTHER RESOLVED: That all bide shall be
5 in conformity with the specifications of the City Council on file
6 with the City Clerk of this Council, which specifications are
7, designated, °SPECIFICATIONS FOR ALL BIDDERS FOR LICENSE OR
8 PRIVILEGE FOR EXCLUSIVE RIGHT TO USE.McFADDEN PLACE PIER FOR
9 CERTAIN PURPOSES."

13 resolution was duly and regularly passed and adopted by the
14 .City Council of the City of Newport Beach at a regular meeting
