3 WHEREAS, there has this day been presented to the City
4 Council of the city of Newport Beach a certain agreement between
5 the City of Newport Beach as party of the first part, and Ray
6 Kimball, as party of the second part; and
7 WHEREAS, said agreement provides that the first party
8 givees to the party of the second part the exclusive privilege
9 of using the pier or wharf extending into the Pacific Ocean
10 opposite McFadden Place in the city of Newport Beach, for the
11 period of one year from March let, 1941,to February 28, 1942,
12 for the purpose of loading and unloading passengers and patrons
13 from said pier to live bait boats owned by the second party; and
14 WHEREAS, the City Council of the city of Newport Beach
15 deems that it is for the best interests of said city that said
16 agreement be entered into and that said license be granted to
17 second party upon the terms, conditions and considerations therein
18 set forth.
19 NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City
20 Clerk of the city of Newport Beach be, and they are hereby
21 directed, authorized and instructed to execute said agreement
22 in the name of the city of Newport Beach, and that the City Clerk
23 deliver a duly executed copy thereof to the second party.
24 I hereby certify that the foregoing resolution was duly
25 and regularly passed and adopte by the City Council of the city
of Newport Beach at a p a regular meeting'thereof held
