RESOLUTION NO.

3 WHEREAS, there has this day been presented to the
4 City Council of the city of Newport Beach a certain agreement
5 dated April 7th, 1941, by and between SMITH BROTHERS BOAT WORKS,
6 a co- partmership, therein referred to as the party of the first
7 part, and the CITY OF NEWPORT BEACH, a municipal corporation,
8 therein referred to as the party of the second part; and
9 WHEREAS, said agreement provides that the party of the
10 second part hires and retains the first party for the purpose of
11 furnishing all required labor, materials, transportation, tools
12 and services in the construction of two (2) piers with landing
13 floats as shown on Drawing No. 60 -1241 in the office of the City
14 Engineer of the city of Newport Beach, said piers with landing floats
15 being on public property located on the north side of the Lido
16 Channel and easterly of Tract No. 919 in the city of Newport Beach
17 in accordance with the plans and specifications prepared by the
18 City Engineer of the city of Newport Beach, and on file with the
19 City Clerk of said city, for the doing of said work of improvement{
20 a copy of which specifications is attached to said agreement and
21
made a part thereof; and

22 WHEREAS, said agreement specifically sets forth the
23 terms, conditions and prices for the doing of said work; and
24 WHEREAS, the City Council of the City of Newport Beach
deems that it is for the best interests ofsaid city that said
25
agreement be executed, and that the work therein specified be done
26
by first party upon the terms and conditions therein set forth.

29 NOW, THERERORE, BE IT RESOLVED: That the Mayor and
City Clerk of the City of Newport Beach be, and they are hereby
30
directed, authorized and instructed to execute said agreement
31
in the name of and on behalf of the City of Newport Beach, and

that the City Clerk furnish a duly executed copy thereof to the
party of the first part in said agreement named.
I hereby certify that the foregoing resolution was
duly and regularly passed and adopted by the City Council of
the city of Newport Beach at a regular meeting thereof held on
7th day of April, 1941, by the following vote, to —wit:
