3 WHEREAS, there has this day been presented to the City
4 Council of the city of Newport Beach a certain agreement dated
5 April 28th, 1941, by and between Sully Diller Contracting Co.,
6 a corporation, of Orange, California, therein referred to as the
7 party of the first part, and the City of Newport Beach, a
8 municipal corporation, therein referred to as the party of the
9 second part; and
10 WHEREAS, said agreement provides that the party of the
11 second part hires and retains the party of the first part for the
12 purpose of furnishing all required labor, materials, transporta-
13 tion, plant, tools and services for the grading, paving and
14 construction of cement concrete gutter on Ocean Front between
15 22nd Street and McFadden Place in the city of Newport Beach, in
16 accordance with the plans and specifications prepared by the
17 City Engineer of the city of Newport Beach and on file with the
18 City Clerk of the city of Newport Beach, for the doing of said
19 work of improvement, a copy of which specifications is attached
20 to said agreement and made a part thereof; and
party of the first part in said agreement named.

WHEREAS, said agreement specifically sets forth the

terms, conditions and price for the doing of said work; and
22
WHEREAS, the City Council of the city of Newport
23
Beach deems that it is for the best interests of said city that
24
said agreement be executed, and that the work therein specified
25
be done by the party of the first part, upon the terms and
26
conditions therein set forth.

NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
28

City Clerk of the city of Newport Beach be, and they are hereby
29
directed, authorized and instructed to execute said agreement
30
in the name of and on behalf of the City of Newport Beach, and
31
that the City Clerk furnish a duly executed copy thereof to the
32
party of the first part in said agreement named.

1 I hereby certify that the above and foregoing
2 resolution was duly and regularly passed and adopted by the
3 City Council of the city of Newport Beach at an adjourned
