✓ RESOLUTION NO.
WHEREAS, Mr. John Sherrod Harris of Properties, Inc.,
736 South Hill Street, Los Angeles, California, has offered to the
31ty of Newport Beach certain real property more particularly
bed and outlined on a map, Exhibit "A ", on file with his
said offer, upon the following terms and conditions, to —wit:
"Purchase Price: $'p1200 .- To be paid in cash upon
delivery of deed — this deal to
be closed on or before thirty
(30) days from this date (Sept. 17,
1941)
Cliff bungalow: On or before 30 days after the
above transaction is closed, you are
to move this bungalow, at your own
expense, from its present location
toward the other bungalow on the cliff,
a distance which will leave the bunga-
low you move on solid ground. After
being moved, said bungalow is to be
securely and properly set on wooden
pillars and it is understood that you
are not to put a cement foundation
under said bungalow. You have our
permission to cut down or move any
tree that may be in the way of your
moving said building.
Shed: The lean —to next to the garage you
are to take down and pile all lumber
therefrom back of the garage building —
this fob to be done at no expense to
us and the work to be completed within
30 days after the close of the first
transaction above mentioned.
Sloping of the bluff and widening of the ramp which you
see fit to do is to be done at no expense to us *..; after
the bungalow and shed situations have been given proper
attention."
NOWs THEREFORE, BE IT RESOLVED: That it is for the best
Ilinterests and benefit of said city that said offer be accepted for
I`the consideration and upon the terms and conditions outlined in said
30 Iloffer above referred to.
31 1 BE IT FURTHER RESOLVED: That the price offered, and the
32 conditions under which said land is proposed to be transferred to

the City of Newport Beach, is in all respects fair and just, and
not disproportionate to the value of the lands proposed to be
acquired.
BE IT FURTHER RESOLVED that upon the delivery of a deed
to said described property by Properties, Inc., that a warrant
be drawn in favor of Properties, Inc., in the sum of $1200, and
that said warrant be sent to Properties, Inc., at the address
above given.
BE IT FURTHER RESOLVED: That the City Engineer of the
City of Newport Beach be, and he is hereby instructed and directed
to carry out all the other provisions stated in said offer, and
accepted by said city, within the time and in the manner therein
specified.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council of
the city of Newport Beach at a regular meeting thereof held on the
6th day of October, 1941, by the following vote, to —wit:
