RESOLUTION NO. A
WHEREAS, W. L. Valentine, who did on or about the 6th
day of October, 1941, enter into a' certain lease agreement with
the City of NewportBeach in regard to the renting of a certain
boat slip belonging to the city of Newport Beach for his boat
VOLADOR, and located southeasterly of Tract No. 9719 in the City
of Newport Beach on city owned property, has requested said city
to cancel said lease as of the 1st day of April, 1942, for the
reason that he has disposed of his said boat VOLADOR to the United
States government and has no further need for said boat slip; and
WHEREAS, the City of Newport Beach has also rented a
certain garage and facilities in connection with said boat slip
to the said W. L. Valentine under a certain agreement of lease
dated October 20th, 1941, wherein the City of Newport Beach is
designated as the party of the first part, and W. L. Valentine
is designated as the party of the second part, said garage and
other facilities being located easterly of Tract No. 919 in the
City of Newport Beach; and
WHEREAS, said garage and other facilities were rented
to the said W. L. Valentine in connection with said boat slip
and the two are used together, and in the event either lease
is cancelled it is the opinion and judgment of the City Council
of the city of Newport Beach that both lease agreements herein
mentioned should be cancelled in order that the city may re -rent
or re -lease said boat slip, garage and other facilities in
connection therewith; and
WHEREAS, it is the opinion and ,judgment of the City
Council of the city of Newport Beach that in as much as the Unitau
States government has taken the boat VOLADOR from the ownership
of the said W. L. Valentine, and the said W. L. Valentine has
no use or need for said boat slip and garage and other facilities,

that said lease agreements should be cancelled and the rents
paid in advance pro -rated as of April let, 1942,
NOW, THEREFORE, BE IT RESOLVED that that certain
lease covering the boat slip for the boat VOLADOR and heretofore
referred to, be and the same is hereby cancelled, annulled and
terminated as
of
the let
day of April,
1942;
and
BE
IT
FURTHER
RESOLVED that
that
certain lease agree-
ment dated the 20th day of October, 1941, wherein the City of
Newport Beach rented to the said W. L. Valeptine acertain garage
and other facilities, be, and the same is hereby cancelled
and terminated as of April let, 1942; and
BE IT FURTHER RESOLVED that the rents paid in advance
by the said WP L. Valentine for said boat slip be pro -rated as
of April let, 1942, and that there be refunded to the said W. L.
Valentine the sum of $1705.00 and a warrant drawn therefor.
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the City
Council of the City of Newport Beach at a regular meeting thereof
held on the 6th day of April, 1942, by the following vote, to -wit:
