RESOLUTION NO.
WHEREAS, Keith Spalding has made application to the City
Council of the City of Newport Beach for a cancellation of taxes
on the yacht GOODWILL owned by him on the first Monday in March,
1942, and docked in the City of Newport Beach, Orange County,
California, on said last mentioned date; and
WHEREAS, the said Keith Spalding has represented to the
City Council of the City of Newport Beach that said yacht GOODWILL
has been chartered by the Navy Department of the United States
Government for the duration of the war, and that he is receiving
no compensation for this charter from the Government; and
WHEREAS, said Keith Spalding has asked for a cancellation
of taxes on said yacht Goodwill for the reason that it is now
property owned by the United States Government; and
WHEREAS, Sections 4986 and 4986.2 of the California
Statutes of 1941, provide in substance that all or any portion
of any uncollected tax, penalty or costs heretofore or hereafter
levied, may, on satisfactory proof, be cancelled by the officer
having custody of the records of the City on order of the govern-
ing body of the city with the written consent of the City Attorney
on property acquired after the lien date by the United States of
America; and
WHEREAS, the City Council of the city of Newport Beach
has obtained satisfactory proof of the

WHEREAS, it likewise appearing that the City Council
of the City of Newport Beach has the right under the Statutes
aforesaid to cancel any portion of the tax lien on said boat
GOODWILL by reason of the facts aforesaid, and that the City
Attorney of the City of Newport Beach has consented to such
cancellation.
NOW, THEREFORE, BE IT RESOLVED that the Auditor of the
City of Newport Beach be, an he is hereby authorized, directed
and instructed to cancel .k' of the taxes now due and owing
from Keith Spalding to the city of NewportBeach on the boat
GOODWILL for the fiscal year 1942 -1943.
I hereby certify that the above and foregoing resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Be ch at a regular meeting thereof held on
the day of 19kH_, by the following
