RESOLUTION NO. 2850
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT
TO THE PROVISIONS OF SECTION 2808 OF "THE
SPECIAL ASSESSMENT INVESTIGATION, LIMITATION
AND MAJORITY PROTEST ACT OF 1931 ", BEING PART
1, DIVISION 4 OF THE STREETS AND HIGHWAYS CODE
OF THE STATE OF CALIFORNIA.
WHEREAS, the Health Officer of the City of Newport Beach
and of the County of Orange has presented to this City Council
a communication calling attention to the urgency of replacing
the existing cement concrete pipe sewer main now located in
Central Avenue southeasterly of the intersection of Short
Street and Central Avenue, wherein the said Health Officer
advises the City Council that serious deterioration of the
existing sewer main has resulted, and that numerous breaks
have occured in said sewer main, and recommends, regardless
of the cause of such breaks, the condition exists and is a
serious sanitary problem which must be corrected at the
earliest possible time; and
WHEREAS, the said City Council has before it a communica-
tion from the Division of Sanitation of the Department of the
State Board of Health, calling attention to the many breaks
that have occured in said existing sewer main, and which have
required the pumping of sewage into the street or into Newport
Bay, of which both practices endanger the public health, and
the said letter recommends a project for the replacement of
said sewer main as an urgent one, demanding all speed that can
be gotten to correct the situation.
is NOW, THEREFORE, BE IT RESOLVED: That the City Council of
the City of Newport Beach does hereby find and determine that
the necessity for the replacement of said sanitary sewer is

urgently needed for the preservation of the public health,
peace and safety,
AND BE IT FURTHER RESOLVED: That in the opinion of the
said City Council, the contemplated improvement is one in
which the probable assessments will not exceed the limitations
set up in the "Special Assessment Investigation, Limitation
and Majority Protest Act of 1931 ", being Part 1, Division 4
of the Streets and Highways Code of the State of California,
and that the proposed project is feasible, and that the
properties to be assessed within the Assessment District will
be able to carry the burden of the proposed assessments, and
that the limitations on the amount of the assessments set
up in said act may be dispensed with.
I HEREBY CERTIFY that the above and foregoing Resolution
No. 2850 was duly presented, passed and adopted by the City
Council of the City of Newport Beach, California, at an ad-
journed regular meeting thereof held on the 9th day of August,
1943, by the following vote:
AYES: Councilmen: Allen, Isbell, Reed, Kirk, Hall.
NOES: Councilmen: None
