HomeMy WebLinkAbout3080 - Street & Alley Abandonment0 i 1 2 3 4 5 6 7 8 9 10 11 12 RESOLUTION NO. i0 S O A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, DECLARING ITS INTEivTION TO ORDER THE CLOSING UP AND ABANDONMENT OF A PORTION OF A CERTAIN STREET AivD CERTAIN ALLEYS IN THE CITY OF NEWPORT BEACH, AS FOLLOWS: A PORTION OF THIRD AVENUE AND A PORTION OF CERTAIN ALLEYS IN BLOCKS 531 AND 631, DECLARING IT TO BE FOR THE PUBLIC INTEREST AND CONVENIENCE, AND FIXING THE TIME AND PLACE OF HEARING OBJECTIONS TO SAID PROPOSED IMPROVEMENT, AND SPECIFYING THE EXTERIOR BOUNDARIES OF THE DISTRICT OF LANDS TO BE AFFECTED OR BENEFITED BY SAID WORK OF. Mr- PROVEMENT AND TO BE ASSESSED TO PAY THE DAMAGES, COSTS AND EXPENSES THEREOF. The City Council of the City of Newport Beach, pursuant 1311to the provisions of the Street Opening Act of 1889, approved 141JApril 4, 1941, Statutes 1941, Dhapter 79, Division 5, Part 1, 1511 Streets and Highways Code, does resolve and declare as follows: 1611 SECTION 1. CALIF. street and certain alleys in the City of Newport Beach, and it is the intention of the City Council of the City of Newport Beach to order the following described portions of a certain street and certain alleys in said City to be closed up and abandoned, to -rit: THIRD AVENUE All that portion of Third Avenue (formerly 55th Plaoe) 50 feet in width, extending between the prolongation of the southeasterly line of Carnation Avenue (formerly 30th Avenue) and the prolongation of the northwesterly line of Dahlia Avenue (formerly 31st Avenue), as shown upon a map of Corona Del Mar, recorded in Book 3, pages 41 and 42 of Miscellaneous Maps, Reoords of Orange County, California. -1- J, 1 ALLEYS IN BLOCKS 531 AND 631 2 All that portion of those certain alleys, 3 14 feet in width in Blocks 531 and 631 as laid out and shown upon a map of Corona Del Mar, 4 recorded in Book 3, pages 41 and 42 of Miscel- laneous Maps, records of Orange County, Cal- 1 ifornia, lying between the prolon ation of the northeasterly line of 2nd Avenue formerly 6 54th Place) and the prolongation of the south- westerly line of 4th Avenue (formerly 56th ? Place), as laid out and shown upon said map of Corona Del Mar, recorded in Book 3, Pages 41 8 and 42 of Miscellaneous Maps, Records of Orange Oounty, Oalifornia. 9 loll All portions of streets and alleys to be closed up 11 and abandoned are more clearly shown on a certain map approved 12 and adopted by the City Council of the City of Newport Beach for 13 II said closing up and abandonment by Resolution dated the 2nd day of 14 October, 1944, and designated Resolution No. 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF ROLAND THOMPSON 210 SPUR GEON BLDG. SANTA ANA. CALIF. SECTION 2. That the exterior boundaries of the district of lands to be affected or benefited by said work of improvement and to be assessed to pay the damages, costs and ex- penses thereof, are particularly described as follows, to-wit: All that certain real property situated in the City of Newport Beach, County of Orange, State of California, and more particularly described as follows, to -wit: Beginning at the most westerly corner of Block 531, as shown upon a map of Corona Del Mar, recorded in Book 3, Pages 41 and 42 of Miscellaneous Maps, records of Orange County, Oalifornia; running thence northeasterly along the northwesterly line of said Block 531 and the northwesterly line of Block 631 of said Corona Del Mar to the most northerly corner of said Block 631; thence southeasterly in a direct line to the most easterly corner of said Block 631; thence southwesterly along the southeasterly line of said Block 631 and the southeasterly line of said Block 531 to the most southerly corner of said Block 531; thence northwesterly in a direct line to the point of beginning. -2- r\ e • 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF ROLAND THOMPSON 210 SPURGEON BLDG. SANTA ANA. CALIF. SECTION 3. That said work of improvement is for the closing up and vacating of a portion of a certain street and portions of certain alleys hereinabove more particularly described, and it appears to the City Council of the City of Newport Beach that no assessment is necessary. SECTION 4. That the proceedings for the closing up of the aforesaid portion of a certain street and portions of certain alleys in the City of Newport Beach shall be had and taken under and in accordance with the "Street Opening Act of 1889 approved April 4, 1941, Statutes 1941, Chapter 79, Division 5, Part 1, Streets and Highways Code ". SECTION 5. The Street Superintendent of the Oity of Newport Beach shall cause to be conspicuously posted along the line of said contemplated work and improvement and at not more than three hundred (300) feet in distance apart, but not less than three (3) in all, notices of the passage of this resolution, in the form and manner as required by law; and he shall also cause a notice similar in substance to be published by inserting said notice for four successive times in the XWORT BALBOA NWJS TIDES, a semi — weekly newspaper published and circulated and of general circulation in the City of Newport Beach, California, which said newspaper is hereby designated for that purpose by the said City Council of the City of Newport Beach, which said notice shall contain a statement of the fact of the passage of this resolution of intention, the date hereof, and briefly describing the work of improvement proposed and referring to this Resolution for further particulars. SECTION 6. IL PI expiration of the time of the publication of said notice mentioned in Section 5 hereof, which objections shall be delivered to the Clerk of the City Council who shall endorse thereon the date of its reception by him, and at the next meeting of the City Council, after the expiration of said ten (10) days, lay said objections before said City Council who shall fix a time for hearing said objections, not less than one (1) week thereafter. The City Clerk shall thereupon notify the persons making such objections of the time and place of the hearing of said objections by the City Council and notice of said hearings shall be given by depositing a notice thereof in the post office of said City of Newport Beach, postage prepaid thereon, addressed to said objector.
