RESOLUTION OF AWARD OF CONTRACT
NO.
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, AWARDING THE CON -
TRACT FOR THE WORK DESCRIBED IN RESOLUTION OF
INTENTION N0. 3279•
RESOLVED, that the City Council of the City of Newport
Beach, California, having in open session on the 3rd day of I
September, 1946, opened, examined and publicly declared all sealed
proposals or bids for the following work to be done and improvements
to be made in said City, to wit:
The grading and paving with asphaltic concrete pavement
with a decomposed granite base, cement concrete alley approaches,
vitrified clay pipe house sewer connections, water service connec-
tions, cast iron pipe water mains, fire hydrants, fittings and
appurtenances and appurtenant work in connection therewith in
alleys and streets in Sections 1 to 5 inclusive, of Balboa Island
and Tract No. 742, all as more particularly described in Resolution
of Intention No. 3279, passed and adopted by the City Council of
said City on the 4th day of February, 1946, and on file in the
office of the City Clerk of said City.
For further particulars reference is hereby made to
said Resolution of Intention No. 3279 and to said plans, profiles,
and sections No. 409 sheets 1 to 25 inclusive, and Standard Plans
Nos. 1016 and 1061 on file in the office of the City Engineer of
said City of Newport Beach, and to the specifications for the said
work heretofore adopted by the said City Council and on file in
the office of the City Clerk of said City, and all of said plans,
profiles, sections and specifications heretofore approved by the
City Council of said City are incorporated herein and made a part
Ihereof and reference is hereby made thereto for a more-particular
description of said work.

Said City Council has determined and declared that the

contemplated work and improvement heretofore mentioned was in the

opinion of said City Council of more than local or ordinary public
4
benefit and the said City Council has made the expenses of said
5
work chargeable upon a district. Forthe: particular description
6
of the said district reference is hereby made to said Resolution
7
of Intention No. 3279•

Said City Council has determined and declared that
9
serial bonds bearing interest at the rate of six (6,%) per cent
10
per annum and extending over a period ending nine (9) years from
11
the second day of January next sucmeding the next October 15th
12
following their date, will be issued hereunder in the manner
13
provided by the "Improvement Act of 19110, being Part 5, Division
14
7 of the Streets and Highways Code of the State of California,
15
to represent each assessment of Twenty -five ($25.00) Dollars or
16
more remaining unpaid for thirty (30) days after the date of the
17
warrant.

1 All of the work herein ordered shall be done and carried
19
through in pursuance of an act of the Legislature of the State of
20
California, designated the "Improvement Act of 1911 ", being Parts
21
1, 2, and 3 of Division 7 of the Streets and Highways Code.

Said City Council hereby rejects all of the said proposals
23
or bids, except the next hereinafter mentioned, and hereby awards
24
the contract for the said work and improvement to the lowest,
25
regular and responsible bidder, to -wit: to Sully - Huller Contracting
26
Company at the prices named in its said bid for said work, on
27
file in the office of the City Clerk of said City.

The City Clerk of said City is hereby directed to cause
29
a NOTICE OF AWARD of contract to be published in the manner and
30
form required by said Code, by two insertions in the Newport- BAlboa
31
News -Times a semi - weekly newspaper published and circulated in
32
said City of Newport Beach, and hereby designated for the purpose
by the said City Council.

PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof held
this 3rd day of September, 1946, by the following vote, to wit:
AYES, COUNCILMEN: Allen, Siler, Isbell, Robertson
Reed.
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: None
APPROVED:

I HEREBY CERTIFY'that the above and foregoing Resolution
Awarding Contract was passed and adopted by the City Council of
the City of Newport Beach, California, at the time and by the
vote above stated.
