• A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, CALIFORNIA, EMPLOY-
ING AND APPOIRTING A. S. MONROE, A CIVIL
' ENGINEER, FOR THE PURPOSE OF ASSISTING
VARIOUS OFFICERS OF SAID CITY, AND FOR THE
PREPARATION OF THE RESOLUTIONS, NOTICES AND
OTHER PROCEEDINGS INVOLVING CONSTRUCTION OF
VARIOUS IMPROVEMENTS THE COSTS OF WHICH ARE
TO BE PAID FROM SPECIAL ASSESSMENTS.
WHEREAS, it is contemplated that the City Council
of the City of Newport Beach, California, will, from
time to time in the future, institute and carry through
special assessment proceedings for the construction of
various improvements within said city; and
WHEREAS, it is recommended by the City Engineer
of said City that A. S. Monroe, a Civil Engineer, be em-
ployed and appointed.for the typing and preparing of the
resolutions, notices and other papers and proceedings for
any work or improvement involving special assessments under
any of the various improvement acts of the State of
California which are used in connection with the making
of improvements under special assessment proceedings;
NOW, THEREFORE, the City Council of the City of
Newport Beach, California, does hereby resolve, declare,
determine and order as follows:
SECTION 1. That until the further order of said City
Council repealing this resolution, A. S. MONROE, a Civil
Engineer, registered under the laws of the State of Calif-
ornia, be and he is hereby employed for the purpose of assist-
ing the various officers and employees of the said city and
• also for the purpose of typing and preparing the resolutions,
notices and other papers and proceedings for the construction
of each and all of the improvements presently being or here-

. after prosecuted, provided for, or undertaken by the City of
Newport Beach under the provisions of the "Improvement Act
• of 191111, and under any of the other various improvement
acts of said State which are used in connection with the
making of improvements under special assessment proceedings,
exclusive of figuring or spreading the respective assessments
to cover the respective costs and expenses for said respective
improvements, or the preparing of any bonds to be issued
thereunder.
SECTION 2. That the total compensation of the said
A. S. Monroe for such services, including expenses, is hereby
fixed at an amount equal to one and one -half per cent (1j-) of
the total respective total construction cost of said res-
pective improvements, exclusive of incidental expenses, which
said compensation shall be included as incidental expenses
and become a change against the respective assessment districts
formed for said respective improvements.
SECTION 3. That the payment of said compensation, as
to each of said respective assessment proceedings, shall be
made as follows:
(a) An amount equal to three- quarters of one per
cent (3/4 of 1 %) of the estimated amount of
any contract to be entered into for said im-
provement, shall be collected from the contractor
is confirmed by the said City Council and recorded
by the Superintendent of Streets of the said City.

be paid to the

the balance

of said compensation shall become
due
and pay-
able when the assessment for the
said
improvement
is confirmed by the said City Council and recorded
by the Superintendent of Streets of the said City.

(b) In the event that any of the proceedings ini-
tiated cease or are abandoned before the award-
ing of any contract for such improvements, the
City of Newport Beach shall only be liable for
the time actually incurred by the said A. S.
Monroe at the rate of Thirty -five ($35.00)
Dollars per day, of seven (7) hours each, for
the preparation of any such proceedings, together
with automobile allowance of five (5�) cents per
mile, which said amounts shall be submitted to
this City Council by an itemized statement of
such services and expenses, provided, that should
sgid proceedings cease or be abandoned the amount
to be paid by the City shall not exceed three -
quarters of one (3/4 of 1 %) per cent of the
estimated cost of said proposed improvements.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof held
