RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECIARING ITS INTENTION TO CALL
A SPECIAL ELECTION AND SUMAIT TO THE ELECTORS
RESIDING IN THE TERRITORY KNOWN AS a BALBOA
BAYSHORESO THE QUESTION WHETHER SUCH TERRITORY
SHALL BE AMMM T0, INCORPORATED IN AND MADE
A PART OF THE CITY OF NEWPORT BEACH.
WHEREAS.. the City Council of the City of Newport Beach,
has received a written petition signed by not less than one- fourth
in number of the qualified electors residing within the territory
described therein and hereinafter described, as shown by the regis-
tration of voters of the County of Orange, State of California, in
which such territory is situated, for the annexation to and incor-
poration in the City of Newport Beach of the hereinafter described
contiguous, unimproved and inhabited territory, said territory being
more particularly described as follows, to -wit:
An that certain real property situated in the County of Orange,
State of California, and described as follows$
Parcel L An of Tract No. 1014, as shown upon a map recorded in
Book(, page 36'of Miscellaneous Maps, records of Orange County,
r 3 California, and a portion of Lot 171 in Block 54, and lands ad-
Joining, in Irvine's Subdivision of Ranchos San Joaquin and
Lomas de Santiago and Flint and Bixby's allotment of Rancho
Santiago de Santa Ana, as shown on a map recorded in Book 1,
page 88 of Miscellaneous Maps, records of Orange County, Calif-
ornia, said portion located Southerly of said Tract 1014 is
described ass Beginning at the most Southerly corner of said
Tract 1014, said point being also a point on the U. S. Bulkhead
line as established by the U. S. Engineer Office and approved by
the U. S. War Department May 22 1936; thence South 190 52$ 070
West along said bulkhead line to U. S. Bulkhead Station No. 130;
thence North 610 Olt 070 West along said Bulkhead line 422.11
feet; thence North 230 511 East 144.03 feet to a point in the
right of way line of Bay Shore Drive, said point being the
beginning of a curve tangent concave Northerly and having a
radius of 287.50 feet; thence Northeasterly along said curve
through a central angle of 500 28$ 200 a distance of 253.26 feet
to a point in the boundary of said Tract 10142 said point being
the Southeasterly and of that certain course North 27o 37$ 040
West 306.02 feet; thence Easterly and Southeasterly along the
boundary line of Tract 1014 to a point of beginning.

the line of the City limits of the City of Newport Beach;
thence South 390 421 308 West along the said line of City
Limits 7.55 feet more or less to an intersection with the
Northerly right of way line of the State Highway ORA -60-R;
thence Easterly along the said Northerly highway right of way
line to the point of beginning.
SUBJECT to the specific conditions set forth in said
petition, as follows, to -wits
(1) That the territory above described shall not, nor
shall any part thereof, be liable or responsible or be subject
to taxation to pay any portion of any bonded or other indebted-
ness of the said City of Newport Beach now existing or inewred
subsequent hereto and prior to the annexation of said territory
to said City of Newport Beach.
(2) That the streets within said territory, except those
now dedicated to public use, shall not be so dedicated by reason
of the annexation of said territory.
(3) That after said annexation, the said City of Newport
Beach shall cause the sewer and water lines now laid and to
be laid within said territory to be connected with the sewer
• and water system of said City, and thereafter said City shall
dispose of said sewage and shall supply water to said territory.

WHEREAS, said petition so presented to the said City
Council of said City of Newport Beach is in form and substance as
• required by the Statutes of the State of California applicable there.

WHEREAS, the said City Council of said City of Newport
Beach has received a reposEfrom the Planning Commission of said City
of Newport Beach approving the design of the subdivision of a portion
of said territory proposed to be annexed and the construction of the
buildings and the public improvements therein and recommending that
the said territory be annexed to and incorporated in said City of
Newport Beach.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, as followat
Section L That the said City Council of said City of
Newport Beach intends to and will call a special election in
the territory above described and will at said special election
submit to the qualified electors residing within said territory
proposed by said petition to be annexed to said City, and here.
inabove described, the question whether such territory shall
be annexed to, incorporated in and made a part of the City of
Newport Beach, subject to the conditions hereinabove set forth•
Section 2. That the boundaries of the territory so pro-
posed to be annexed to said City of Newport Beach are herein —
above particulary described and shall be hereinafter known
and designated as " Balboa Bayshores ", and such territory may be
referred to and indicated upon the ballots to be used at such
special election at which the question of such annexation is
submitted as " Balboa Bayshores ".
Section 3. That said special election will be held in the
territory proposed to be annexed and designated " Balboa Bay -
ehores" as aforesaid, on the 10th day of June, 1947, for the
purpose of submitting to the qualified electors residing within
said "Balboa Bayshores" the question whether such " Balboa Bay —
shores" shall be annexed to, incorporated in and made a part of
the City of Newport Beach, subject to the conditions hereinabove
set forth, which said special election shall be held in accord
ance,with the provisions of the " California Annexation Act of
1913" ( State. 1913, P. 587, and amendments thereto) and in
• accordance with the provisions of the election laws of the State
of California governing special elections.

Section 4. That notice is further hereby given that the
14th day of April, 1947, at the hour of 4too ovclock P. M. of
said day, in the Council Chambers in the City Hall of the City
of Newport Beach, is the time and place when and where any
person owning real property within said territory so proposed
to be annexed and hereinabove designated and described and
= having any objections to said proposed annexation may appear
before said City Council and show cause why such territory
should not be so annexed. At any time not later than the day
and hour hereinabove set for such hearing any owners of property
within said territory proposed to be annexed and hereinabove
described and designated, may make written protest against the
proposed election aforesaid• Each such protest must be in
writing and shall state the name or names of the owner or
owners of the property affected thereby and the location and
area of such property in general terms.
Section 5. That the City Clerk of the City of Newport
Beach be and he herby is directed to cause a copy of this
resolution to be published at least once a week for two success-
ive weeks prior to said hearing, in the Newport - Balboa Press,
a newspaper of general circulation published in said City of
Newport Beach, it being hereby found and determined by the City
Council of said City of Newport Beach that there is no news-
paper of general circulation published in said territory pro-
posed to be annexed and hereinabove described and designated.
Section 6. That if the City Council of the City of Newport
Beach finds at the time and place above specified in Section 4
hereof for the hearing of protests to the proposed annexation
of " Balboa Bayshores" to said City that protests are not made
by owners of a majority of the separate Pamela of property
within said territory proposed to be annexed and hereinabove
described, the said City Council will immediately can a
special election at the time hereinabove specified, and submit
to the qualified electors residing in said territory proposed
to be annexed the question whether such territory shall be
annexed to, incorporated in and made a part of said City of
Newport Beach, subject to the conditions hereinabove net forth.
On motion of Councilman ROBERTSON $
seconded by Councilman SILER , the foregoing Reso-
lution was introduced and passed by the City Council of the City of New-
port Beach at a regular meeting held on the 24th day of March, 1947,
and adopted by the following vote;
