, WHEREAS, there has this day been presented to tL.e City
Council of the City of riewport Beach, R certain Grant Deed wherein
the City of Newoor.t Beach grants to the GRIFFIT.: COMPANY, a
corporation, all that certain real property described as follows,
to -wit:
All that real property in the City of idernort Beach,
County of Orange, State of California, described as:
PARCEL NO. 1. All that portion of Lot 3, Tract No. 1117,
as shown on a. map recorded in Book 35, page 48 of I.Uscel-
la.nebus E aps, records of Orange County, California, and a
portion of that certain alley, 20 feet in width, vacated
by Resolution 3280, adopted by the City Council of the
City of Newport Beach, California., on February 4th, 1946,
said Resolution being recorded in Book 1400, page 189, Of-
ficial Records, records of said County, described as follows,
to-wit:
Beginning at the most Northerly corner of that certain
parcel of land as described in deed from the Griffith
Company to the City of Newport Beach, recorded E*anch 11th,
1946, in Book 1404, page 129, Official Records, records of
said County, which corner bears North 00 441 30" Test, 220.89
feet from the Southwest corner of Tract No. 907 as shown
on a map recorded in Book 28, page 25 to 36 inclusive of
Miscellaneous i..aps, records of said County, running thence
South 400 471 0711 East along the Northeasterly line of
said parcel of land 170.97 feet to a point in the Easterly
line of said Lot 3;
Thence South 00 441 3011 East along the Easterly line
of said Lot 3, 15.54 feet;
Thence North 400 471 0711 west, 170.97 feet to a point
in the Westerly line of that certain alley, 20 feet in
width and vacated by said Resolution No. 3280;
Thence North 00 441 3011 'lest along the Westerly line
of said alley, 15.54 feet to the point of beginning,'
PARCEL NO. 2. A parcel of land in Section 28, Township
6 South, Range 10 west, S. B. B. & Lei., described as follows,
to—wit.
Beginning at the most Southerly corner of that certain
parcel of land as described in deed from the City of
Newport Beach to the Griffith Company, recorded I::arch 11th,
1946, in Book 1404, page 130, Official Records, records of
Orange County, California, which corner bears North 00 441
3011 west, 220.89 feet from the Southwest corner of Tract
No. 907 as shown on a map recorded in Book 28, pages 25 to
36 inclusive of 'r.:isce7_laneous Kaps, records of said County,
running thence North 400 471 0711 Vest along the Southwesterly
line of said parcel of land, 148.96 feet;
Thence Yorth 660 441 3011 "est along the Southwesterly
line of said parcel of land, 160.00 feet to the most ?7esterly
corner of said parcel of land;
Thence South 890 151 3011 west along a line parallel with
the North line of the Hudson as shown on a map of Lancaster's
Addition recorded in Book 5, page 14 of I.:iscellaneous :,laps,
records of said County, 219.53 feet to a point in the Easterly
line of .Central Avenue;

Thence Southerly along said Easterly line of Central
Avenue along a curve concave to the East and having a
radius of 2754.93 feet through an arc distance of 10.11 feet;
Thence North 890 151 3011 East, 144.33 feet to the be-
ginning of a curve to the right;
Thence Southeasterly along a curve concave to the
Southwest and having a radius of 351.15 feet through an
arc distance of 306.17 feet;
Thence SoUth 400 478 07" East tangent to the last
mentioned curve, 77.63 feet to a point in the West line of
said Tract No. 907;
Thence North 00 441 3011 West along the West line of
said Tract No. 907, 15.54 feet to the point of beginning.

VMEREAS, the City of Newport Beach is the owner of certain
Ilproperties contiguous and adjacent to said real property so granted
Ito the Griffith Company; and
IMEREAS, the Griffith Company, Grantee in said Deed, has
(agreed with the City of Newport Beach to erect and construct a ma-
Isonry wall 4r feet high, approximately 510 feet in length, commenc-
ing at a point near Central Avenue, where the wall will parallel
Central Avenue and continuing therefrom along and contiguous to
the City owned property to a point located on a prolongation of
Villa Way; and when their grades have been established by the
City Engineer that said wall will be extended to a point located
on a prolongation of Via Oporto; and
M EREAS, the Griffith Company has agreed to construct said
walls along the line established by the City Engineer of the City
of Newport Beach, and in accordance with the plans and specifica-
tions prepared by the City Engineer of the City of Newport Beach,
at their sole cost and expense; and
'WHEREAS, Griffith Company has further agreed to erect and
construct said walls within the period of six months from date
hereof; and
WHEREAS, in the judgment of the City Council of the City
of Newport Beach the consideration offered by the Griffith Company
for said grant of land is just, fair and adequate, and not dis-
proportionate to its actual value; and

WHEREAS, in the ,judgment of the City Council of the City
of Newport Beach it is for the best interests of said City and
the residents and property owners thereof that said lands be
transferred to the Griffith Company in consideration of the
Griffith Company erecting and constructing the walls heretofore
mentioned;
N0W THEREFORE, BE IT RESOLVED, that the kayor and City
Clerk of the City of Newport Beach be, and they are hereby
directed, authorized and instructed to sign and execute on behalf
of the City of Newport Beach, the Grant Deed to the property here-
tofore described, to the Griffith Company.
I hereby certify that the foregoing Resolution was duly
and regularly passed and adopted by the City Council of the City
of Newport Beach at a regular meeting thereof held on the 26th
day of January, 1948, by the following vote, to —wit:

I, MARGERY SCHROUDER, City Clerk of the City of Newport

the foregoing Resolution No. 3559 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
