RESOLUTION NO. 3775
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH, CALIFORNIA, RE-
LATING TO THE ISSUANCE OF STREET IMPROVE-
MENT BONDS PURSUANT TO RESOLUTION OF
INTENTION NO. 3631 DETERMINING THE AMOUNT
OF UNPAID ASSESSMENT, PRESCRIBING THE
DENOMINATION OF SUCH BONDS AND PROVIDING
FOR THEIR ISSUANCE.
WHEREAS, pursuant to statute, "Improvement Bond Act of
1915', Division 10 of the Streets and Highways Code of the State of
California, notice of filing the list of unpaid assessments was
duly given in the manner and form required by law, that the warrant,
assessment and diagram as recorded on the 24th day of January, 1950
for the re- construction of two existing sewage pumping stations on
Balboa Island, in the City of Newport Beach, and that the said
warrant, assessment and diagram were returned to the Superintendent
of Streets, together with a written statement of all payments
received upon the said assessment, and after the full expiration of
thirty (30) days from the date of said warrant, the said Superintenc
ent of Streets duly made and filed with the City Clerk of said City
a complete list of all assessments remaining unpaid upon said
assessment, which list is now on file in the office of the City Clex
of said City. Now, upon evidence shown, this City Council determine
that the assessments herein mentioned were then unpaid, the total
aggregate thereof being the sum of Three Thousand Five Hundred
Ninety -one and 93/100 Dollars ($3,591.93).
That, since the filing of said list of unpaid assess-
ments with the said City Clerk, the following hereinafter enumerat
assessments have been paid:

aggregating the sun of Nine Hundred Seventy -five and 12/100 Dollars
($975.12) and no others have been paid since the filing of said
Street Superintendent's list of unpaid assessments, and that there
now remains unpaid the sum of Two Thousand Six Hundred Sixteen and
81/100 Dollars ($2,616.81) upon the assessments shown in said list,
other than those hereinabove noted as having been paid.
Reference is hereby made to Resolution of Intention
No. 3631 adopted by the City Council of said City on the 25th day
of October, 1948 for a description of the work herein mentioned,
and also to the list of unpaid assessments filed as above noted
for the assessments unpaid; and
WHEREAS, interested persons were notified in the
required by law to appear before the City Council of said City, in
the council chambers of the City Council in the City Hall, at the
hour of seven - thirty o'clock (7:30) P.M. of Monday, the 13th day
of March, 1950 and show cause why bonds should not be issued upon
the security of the aggregate of unpaid assessments herein noted;
WHEREAS, notice was duly given as required by law that
serial bonds to represent unpaid assessments, and bearing interest
at the rate of five per cent (5 %) per annum, will be issued here-
under in the manner provided by the "Improvement Bond Act of 1915`,
being Division 10 of the Streets and Highways Code of the State of
California, the last installment of which bonds shall mature two
(2) years from the second day of July next succeeding ten (10)
months from their date; and
WHEREAS, all interested persons having appeared before
this City Council and having been given full opportunity to show

cause why bonds should not be issued upon the security of the unpaid
assessments shown on the said list, and all objections presented
having been heard and considered,
NOW, THEREFORE, BE IT RESOLVED AND DETERMINED by the
said City Council, as follows:
1. That the City Council does hereby find and determined
that no cause has been shown why bonds should not be issued upon
the security of the unpaid assessments, and does hereby overrule
all objections thereto.
2. That serial bonds shall be issued upon the security of
said unpaid assessments to the said amount of Two Thousand Six
Hundred Sixteen and 81/100 Dollars ($2,616.81).
3. That the said bonds shall be six (6) in number, known
as Series R, and shall be dated the 13th day of March, 1950, and
bear interest at the rate of five per cent (57,) per annum, and the
denominations of said bonds and the dates of their respective
maturities thereof shall be as follows:

4. That the first coupon of interest on said bonds shall
be for interest from the 28th day of February, 1950 to the second
day of January, 1951, and the several coupons of interest thereafter
shall each be for the semi- annual interest.
5. That the signature of the Treasurer of said City upon
the coupons attached to the said bonds shall be a lithographed or
printed signature, in place of a signature by hand.
6. That the City Clerk be, and he is hereby, authorized
and directed to deliver forthwith the bonds hereinbefore mentioned
to Crowell - Weedon & Co., assignee of the contractor, in satisfaction
of the balance due upon its assessment and warrant.

That at all times herein mentioned, he was and
now is the duly elected and acting City Clerk of the City of
Newport Beach, California;
That, pursuant to statute, "Improvement Bond Act
of 191511, Division 10 of the Streets and Highways Code of the
State of California, he deposited in the United States mail
with postage fully prepaid, a Notice of Filing List of Unpai�c
Assessments upon the assessment recorded January 24, 1950, for
the re— construction of sewage plumping stations in Balboa Island,
as contemplated by Resolution of Intention No. 3631; that a
copy of the notice, attached hereto and made a part of this
affidavit as though fully described herein, was mailed to the
owner of each unpaid assessment, as shown in said assessment,
whose name and address appears on the last equalized tax or
assessment rolls of the City of Newport Beach; said notices
having been prepared and mailed pursuant to the requirements of
Sections 8591 and 8592 of the ('Improvement Bond Act of 1915" of
the above mentioned Code; and said notices were deposited in
the United States Post Office at Newport Beach, California, on
the '7r4 day of c 4 , 1950;
That, also pursuant to said Section 8592 of said
Code, he duly posted conspicuously near the Council chamber door
of the City Council of said City .a copy of the published Notice
of Filing said list of unpaid assessments, a copy of vh ich notice
is also attached hereto; that said last named noticp was so
