NO. 3819
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF DIE. -PORT BEACH, CALIFORNIA
DECLARING ITS INTENTION TO ORDER THE
IMPROVEMENT OF CERTAIN ALLEYS BETWEEF
ELEVENTH STREET AND NINETEENTH STREET
IN SAID CITY; DECLARING THE '-MRK TO M
OF MOTE TPAN LOCAL OR ORDINARY PUBLIC
BENEFIT ANTD DESCRIBING THE DISTRICT TO
BE BENTEFITED BY SAID ?STORK AND TO PAY THE
COSTS AND EXPENSES, AND FIXING A TIME AND
PLACE FOR HEARING OBJECTIONS TO SAID VO K
The City Council of the City of Newport Beach, pursuant to the
provisions of the Improvement Act of 1911 ", being Division 7 of
the Streets and Highways Code of the State of California, DOES
RESOLVE as follows:
SECTIO-I 1. That the public interest and convenience require,
and i_t is the intention of the City Council of the City of Newport
Beach, Californi ^., to order the following work to be done, to -wit:
DESCRIPTION OF I ?ORK
First: The gr-�.di.ng, paving with plant mix material, inetallat:
of house sewer and water connections, and appurtenant �r?ork in
connection therewith; in the first
ALLEY
lying Northerly from Balboa Boulevard, between Eighteenth Street
and Nineteenth Street; and in the first
ALLEY
lying Southerly from Balboa Boulevard, between Eleventh Street and
Thirteenth Street, and between Fourteenth Street and Fifteenth
Street, and between Nineteenth Street and the first alley lying
West of Fifteenth Street.
Second: The grading, paving with plant mix material,
installation of mater connections and appurtenant work in
connection therewith; in the first

SECTIOW? 3. That the said contemplated. work and. improvement,

in the opinion of said City Council, is of more then local or
21
ordinary public benefit, and the said City Council hereby makes
22
the expenses of said work and improvement chargeable upon a
23
district, which said district the said City Council hereby
24
declares to be the district benefited by said work ?nd improvement
25
and to be assessed to pa.y the costs and expenses thereof, .and
26
which district is described as follows:

429, consisting of three sheets, attached to and forming a part

of the Investigation Report prepared and Bled under the provisions

of the "Special Assessment Investigation, Limitation and Majority

Protest Act of 1931 ", Division W of said Streets and Highways
Code, heretofore approved by the City Council of said City on the
13th day of March, 1950 indicating by said boundary line the
extent of the territory included within the proposed assessment
district, and which map or plat is on file in the office of the
City Clerk of said City. Reference is hereby made to said map or
plat for a further, full and more particular description of said
assessment district, and the said map or plat so on file shall
govern for all details as to the extent of the said assessment
district.
DESCRIPTION OF BONDS
SECTION 4. That serial bonds, bearing interest at A rate of
six per cent (6 %) per annum, shall be issued to represent each
assessment of Twenty -five Dollars ($25.00) or more remaining
unpaid for thirty (30) days after the date of recording the wirra-L,
Said serial bonds shall extend over a period ending nine (9) years
from the second day of January next succeeding the next October
fifteenth following their date. Payments on the principal of
unpaid assessments and interest thereon shall be made by property
owners to the City Treasurer, and the same shall be disbursed. by
said City Treasurer, all as provided in the "Tmprovemont. Act of
1911 ", hereinafter referred to.

SECTION 5. NOTICE IS HEREBY GTvEW, that on the 26th 0 -y of
August, 1950, ,t the hour of ssven- thirty o'clock (7 :30 ) P.M.,
in the Council chembers of the City Council in the City %all of
said. City of Veomort Beach, any n.nd all persons, h,.ving nny
objections to the proposed work or improvement or to the extent
of the assessment district or to the proposed grades, m ^y nDpenr
and show cause why said work should not be done or carried out in
accordance with this Resolution of Intention. Protests must be
in writing and must be delivered to the City Clerk prior to the

time set for the hearing.

SECTION 6. That all of the work herein proposed sh -.J_1 be done

and carried through in pursuance of an act of the legislature of

the State of California, designated the "Improvement Act of 1911 ",

being Division 7 of the Streets and. Highways Code of the St-t2 of

this Resolution of Intention shall be published by the City Clerk,

publications in the proceedings under this *resolution of Tntention.

The City Clerk is directed to mi?.il notices of the .�dontion of

this Resolution of Intenti_on to all persons oxming rel1 nronerty

proposed to be assessed, whose names =.nd nddresses --�.ppe ^.r on the

last equalized assessment roll for city taxes, all in the manner ant

form provided for under Sections 5070, 5194 and 5195 of the said

i "Improvement Act of 1911" of said Streets and High7.7ays Code.

SECTION 8. The Superintendent of Streets of the City of
23
Newport Beach shall cause to be conspicuously posted along the line
24
of said. contemplated work or improvement and along all oven streets
25
within the district liable to be assessed for said work, notices of
26
the passage of this Resolution of Intention, in the time, form and
27
manner provided by s�aid. Code.
