RESOLUTION OF AMARD OF CONTRACT
N0. 3886
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AWARDING THE
CONTRACT FOR THE WORK DESCRIBED IN
RESOLUTION OF INTENTION NO. 3819.
RESOLVED, that the City Council of the City of Newport
Beach, California, having in open session on the 25th day of
September, 1950 publicly opened, examined and declared all
sealed proposals or bids for the following work to be done and
improvements to be made in said City, to -wit:
The grading, paving with plant mix material, installation of
house sewer and water connections, furnishing of corrugated metal
pipe for storm drain, and appurtenant work in connection therewit
in certain alleys in the City of Newport Beach lying between
Eleventh Street and Nineteenth Street, all as more particularly
described in Resolution of Intention No. 3819, passed and
adopted by the City Council of said City on the 24th day of
July, 1950 and on file in the office of the City Clerk of said
City.
For further particulars, reference is hereby made to said
Resolution of Intention No. 3819 and to the plans, profiles and
drawings No. 428, consisting of 4 sheets, on file in the office
of the City Engineer of said City of Newport Beach, and to the
specifications for the said work heretofore adopted by the said
City Council and on file in the office of the City Clerk of
said City, and all of said plans, profiles, drawings and
specifications heretofore approved by the City Council of said
City are incorporated herein and made a part hereof, and
reference is hereby made thereto for a more particular
description of said work.
Said City Council has determined and declared that the
contemplated work and improvement heretofore mentioned was,
in the opinion of said City Council, of more than local or

ordinary public benefit, and the City Council has made the
expenses of said work chargeable upon a district. For the
particular description of said district, reference is hereby
made to said Resolution of Intention No. 3819.
Said Council has determined and declared that serial bonds,
bearing interest at the rate of six per cent (6 %) per annum
and extending over a period ending nine (9) years from the
second day of January next succeeding the next October 15th
following their date, will be issued hereunder in the manner
provided by the "'Improvement Act of 1911 ", being Part 5,
Division 7 of the Streets and Highways Code of the State of
California, to represent each assessment of Twenty -five Dollars
($25.00) or more remaining unpaid for thirty (30) days after
the date of recording the warrant.
All of the work herein ordered shall be done and carried
through in pursuance of an act of the legislature of the State
of California, designated the "Improvement Act of 1911 ", being
Division 7 of the Streets and Highways Code.
Said City Council hereby rejects all of the said proposals
or bids, except the next hereinafter mentioned, and hereby
awards the contract for the said work and improvement to the
lowest, regular and responsible bidder, to -wit: To John J.
Swigart Company at the prices named in their bid for said
work, on file in the office of the City Clerk of said City.
The City Clerk of said City is hereby directed to cause a
NOTICE OF AFARD OF CONTRACT to be published in the manner and
form required by said Code, by two insertions in the "Newport -
Balboa Press ; a weekly newspaper published and circulated
in said City of Newport Beach and hereby designated for -the
purpose by the said City Council.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof held

on the 25th day of September, 1950 by the following vote,
to -wit:
AYES: Councilmen Finch, Drake, Greeley,
Blue, Isbell
NOES: Councilmen None
ABSENT: Councilmen None
