HomeMy WebLinkAbout4030 - Corona del Mar Alley ImprovementsI • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 :f 32 RESOLUTION NO. 4030 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE REQUIREMENTS OF THE "SPECIAL ASSESSMENT INVESTIGATION LIMITATION AND MAJORITY PROTEST ACT OF 1931" BEING PART 2 OF DIVISION IV OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council of the City of Newport Beach, California, having heretofore instructed the City Engineer in the matter of the proposed improvement in certain alleys in Corona Del Mar, lying Southwesterly of Coast Boulevard (State Highway) between Avocado Avenue and Poppy Avenue, to procure the data and prepare a written report pursuant to the provisions of the "Speci Assessmen Investigation, Limitation and Majority Protest Act of 1931 ", being Part 2 of Division IV of the Streets and Highways Code of the State of California, and thereafter the said City Engineer presented to this City Council the said written report; WHEREAS, pursuant to the provisions of said Part 2, Division IV of the said Streets and Highways Code, the City Council shall, by resolution or ordinance, determine in general the nature, location and extent of the district or lands to be specially assessed to pay the costs thereof, or any part of such costs; and determine the statute under which it is proposed to conduct the proceedings for such improvement and for the issuance of bonds therein, if any. NOW, THEREFORE, BE IT RESOLVED AND DETERMINED by the City Council of the City of Newport Beach, California, as follows: I. That the written report presented by the City Engineer for the proposed improvement herein referred to is hereby and it is ordered that the said report be filed in the office of the City Clerk for public inspection -:. 2. That the proposed improvement herein mentioned is described as: - (a) Grading, paving with plant mix material, installation of house sewer and water connection, and appurtenant I work in connection therewith; in the first • 2 1 ALLEY 3 lying Southeasterly from Avocado Avenue, between the first alley • 4 lying Southwesterly from Coast Boulevard and a line parallel with 5 and distant 90 feet Southwesterly from the Southwesterly line of 6 Second Avenue, excepting that portion of said alley between the 7 Northeasterly line of Fourth Avenue and a line parallel with and 8 distant 60 feet Northeasterly from said Northeasterly line of 9 Fourth Avenue; and in the first 10 ALLEY 11 lying Southwesterly from Coast Boulevard, between Avocado Avenue 12 and the first alley lying Southeasterly from Acacia Avenue; and 13 in the 14 ALLEYS 15 in Blocks 34 35 131 133 135 136 137 139 140 141 ' 143 . . . . . . . . . . . 16 Southwesterly 250 feet of 234, Southwesterly 300 feet of 235, 17 Southwesterly 325 feet of 236, 237, 238, Southwesterly 360 feet 18 of 239, 240 except Northwesterly 90 feet, 241 except the South - 19 easterly 65 feet, 242, 243, 328 except 60 feet, 331 except the 20 Southwesterly 105 feet, 332 except the Southwesterly 30 feet, 21 333 except the Southwesterly 60 feet, Northeasterly 225 feet of 22 334, Northeasterly 150 feet of 335, 429, 430, 431, 432, 433, 434 23 437, 529, 530, 532, Southwesterly 330 feet.-of 533, 534, 629, 630 24 632, 729 and 730, as said alleys are shown on the map of Corona 25 Del Mar as per map recorded in Miscellaneous Maps Book 3, Pages 26 41 and 42, Records of Orange County, California; and in the 27 ALLEYS 28 in Block 337 of said Corona Del Mar, and the Southwesterly • 29 extension of the alley in said Block 337 a distance of 105 feet 30 into Bsyside Drive; and in the 31 ALLEYS 32 in Block 435 of said Corona Del Mar, between the limits and 1 • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 at the location shown on the map hereinafter referred to; and in the Northeasterly 150 feet of the ALLEY in Block 329 of said Corona Del Mar; and in the Northeasterly 260 feet of the FUUM !`_a in Block 138 of said Corona Del Mar. (b) Grading, paving with plant mix material and appurtenant work in connection therewith; in the ALLEY in Block 142 of said Corona Del Mar. The grading and paving shall extend 8.50 feet into street at all alleys intersecting First Avenue, Second Avenue, Third Avenue and Fourth Avenue. (c) The construction of reinforced concrete pipe storm drain and appurtenant work in connection therewith; in and across the ALLEY in Block 431 of said Corona Del Mar and extending Easterly and Westerly into Lots 8, 9, 10, 11 and 13 of said Block 431. (d) The construction of corrugated iron pipe storm drains and appurtenant work in connection therewith at the following locations; in the ALLEY in Block 334 of said Corona Del Mar, between a point distant 225 feet Southwesterly from First Avenue and extending Southwesterly in said alley and into Bayside Drive a distance of130 feet; and in the ALLEY in Block 335 of said Corona Del Mar, between a point distant 150 feet Southwesterly from First Avenue, and extending South- westerly in said alley and into Bayside Drive a distance of 135 1 • 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 • 29 30 31 32 feet; and in a public EASEMENT over the Northeasterly side of Lot 13 and the Northwesterly side of Lot 15 of Block 435 of said Corona Del Mar, and extending int Iris Avenue a distance of approximately 10 feet; and in a public EASEMENT over the Northeasterly side of Lot 10, Block 429 of said Corona Del Mar, and extending into Acacia Avenue a distance of approxi- mately 7 feet; and in the ALLEY in Block 332 of said Corona Del Mar, between a point distant 30 feet Northeasterly from Bayside Drive and extending Southwesterl in said alley and into said Bayside Drive a distance of 108 feet and in the ALLEY in Block 234 of said Corona Del Mar, between a point distant 25 feet Northeasterly from Seaview Avenue and extending Northeaste in said alley and into Bayside Drive a distance of 67 feet; and in the ALLEY in Block 236 of said Corona Del Mar, between a point distant 325 feet Northeasterly from Seaview Avenue and extending Northeaste in said alley and into Bayside Drive a distance of 68 feet. 3. That all of said work and improvement, proposed to be done, shall be constructed along the lines, between the points and at the places shown on Map 438, consisting of 5 sheets, filed with said report and by this reference made a part hereof. 4. That the district or lands to be specially assessed to pay the costs of said proposed improvement is shown upon Map 438, consisting of 5 sheets, filed with and forming a part of said written report.: Reference is hereby made to said map for further, full and more complete description of said assessment I 2 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 • 28 • 29 30 31 32 district, and the said map so on file shall govern for all details as to the extent of said assessment district. 5. That the proposed improvement shall be done under the provisions of the "Improvement Act of 1911 ", being Division VII of the Streets and Highways Code of the State of California. 6. That serial bonds, bearing interest at the rate of six per cent (6 %) per annum and extending over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date, shall be issued hereunder in the manner provided by the said "Improvement Act of 1911 ", being Part 5, Division VII of said Streets and Highways Code, to represent each assessment of twenty -five dollars ($25.00) or more remaining unpaid for thirty (30) days after the date of recording the asses - ment warrant. 7. That the said City Council hereby fixed Monday, the 23d day of March, 1953, at the hour of seven - thirty o'clock (7:30) P.M. as the date and hour, and the council chambers of the City Council in the City Hall of said city as the place of hearing on the written report of the City Engineer, and hereby orders such hearing to be held by the City Council of said city.
